(Photo by Kevin Dietsch\/Getty Images)<\/p>\n<\/figcaption><\/figure>\n<p class=\"p1\">The U.S. Supreme Court on Tuesday sided with a conservative Christian counselor who argued that Colorado\u2019s 2019 law banning \u201cconversion therapy\u201d for LGBTQ+ minors may <a href=\"https:\/\/coloradonewsline.com\/2025\/10\/07\/supreme-court-colorado-conversion-therapy\/\" target=\"_blank\">violate her First Amendment right<\/a> to free speech.<\/p>\n<p class=\"p1\">The court\u2019s 8-1 <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/24-539_fd9g.pdf\" target=\"_blank\">opinion<\/a>, authored by Justice Neil Gorsuch, holds that the Colorado law seeks to \u201cregulate speech based on viewpoint,\u201d and therefore a legal standard known as \u201cstrict scrutiny\u201d must be applied to it. The decision sends the case back to a lower court to apply that standard and determine the law\u2019s constitutionality.<\/p>\n<p class=\"p1\">\u201cThe First Amendment stands as a bulwark against any effort to prescribe an orthodoxy of views, reflecting a belief that each American enjoys an inalienable right to speak his mind and a faith in the free marketplace of ideas as the best means for finding truth,\u201d Gorsuch wrote. \u201cLaws like Colorado\u2019s, which suppress speech based on viewpoint, represent an egregious assault on both commitments.\u201d<\/p>\n<p class=\"p1\">Gov. Jared Polis, who signed <a href=\"https:\/\/leg.colorado.gov\/bills\/HB19-1129\" target=\"_blank\">House Bill 19-1129<\/a> into law in 2019, said in a statement Tuesday that he was \u201cevaluating the U.S. Supreme Court ruling and working to figure out how to better protect LGBTQ youth and free speech in Colorado.\u201d Polis is the first openly gay man elected governor of a U.S. state.<\/p>\n<div class=\"auxContainer newsroomSidebarContainer \">\n<div class=\"newsroomSidebar\">\n<p>States that <a href=\"https:\/\/www.mapresearch.org\/file\/MAP-Conversion-Therapy-Report-2025.pdf\" target=\"_blank\">protect<\/a> youth from \u201cconversion therapy\u201d:<\/p>\n<ul>\n<li>California<\/li>\n<li>Colorado<\/li>\n<li>Connecticut<\/li>\n<li>Delaware<\/li>\n<li>Hawaii<\/li>\n<li>Illinois<\/li>\n<li>Maine<\/li>\n<li>Maryland<\/li>\n<li>Massachusetts<\/li>\n<li>Michigan<\/li>\n<li>Minnesota<\/li>\n<li>Nevada<\/li>\n<li>New Hampshire<\/li>\n<li>New Jersey<\/li>\n<li>New Mexico<\/li>\n<li>New York<\/li>\n<li>Oregon<\/li>\n<li>Rhode Island<\/li>\n<li>Utah<\/li>\n<li>Vermont<\/li>\n<li>Virginia<\/li>\n<li>Washington<\/li>\n<li>Wisconsin<\/li>\n<\/ul>\n<\/div><\/div>\n<p class=\"p1\">\u201cColorado is for everyone, no matter who you are,\u201d Polis said. \u201cConversion therapy doesn\u2019t work, can seriously harm youth, and Coloradans should beware before turning over their hard-earned money to a scam.\u201d<\/p>\n<p>Therapist Kaley Chiles sued Colorado\u2019s Department of Regulatory Agencies over the ban in 2022. According to a report from The Trevor Project and the Movement Advancement Project, at least 22 other states and the District of Columbia have passed <a href=\"https:\/\/www.mapresearch.org\/file\/MAP-Conversion-Therapy-Report-2025.pdf\" target=\"_blank\">laws<\/a> to protect minors from conversion therapy, which could face similar legal challenges after the Supreme Court\u2019s ruling.<\/p>\n<p class=\"p1\">HB-1129 banned licensed mental health professionals from engaging in any practice \u201cthat attempts or purports to change an individual\u2019s sexual orientation or gender identity.\u201d In federal court proceedings, Colorado had <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-539\/370107\/20250819120909432_2025.08.19%20Chiles%20v.%20Salazar%2024-539%20Respondents%20Brief%20and%20App.pdf\" target=\"_blank\">argued<\/a> that such regulations fell within the state\u2019s well-established authority to license and regulate the \u201cprofessional conduct\u201d of health practitioners.<\/p>\n<p class=\"p1\">For decades, major medical associations in the U.S. and around the world \u2014 including the <a href=\"https:\/\/www.apa.org\/topics\/lgbtq\/sexual-orientation-change#:~:text=Sexual%20orientation%20and%20gender%20identity%20(SOGI)%20change%20efforts%20commonly%20use%20an%20array%20of%20psychosocially%20harmful%20techniques%2C%20including%20public%20shaming%20or%20inducing%20adverse%20physiological%20reactions.\" target=\"_blank\">American Psychological Association<\/a>, the American Academy of Pediatrics and dozens of others \u2014 have concluded that conversion therapy is not effective in changing sexual orientation or gender identity, while worsening patients\u2019 mental health and increasing rates of depression and suicidal ideation.<\/p>\n<p class=\"p1\">The Supreme Court ruling does not affect prohibitions on physical interventions like electroconvulsive therapy, the use of which on minors remains banned or regulated by Colorado and many other states.<\/p>\n<p class=\"p1\">But Chiles, a Colorado Springs resident, argued that the law\u2019s attempt to regulate what she could tell her clients in talk therapy runs afoul of the First Amendment. She characterized the therapy she offered as \u201cconsensual conversations\u201d responding to the voluntary \u201cgoals, desires and objectives\u201d communicated by her minor clients.<\/p>\n<p class=\"p1\">Chiles was represented in the case by the Alliance Defending Freedom, the national conservative Christian group that has also successfully challenged two other Colorado laws that sought to ban anti-LGBTQ+ discrimination, in the Supreme Court cases <a href=\"https:\/\/coloradonewsline.com\/2023\/06\/30\/colorado-designer-websites-same-sex-couples-supreme-court\/\" target=\"_blank\">303 Creative v. Elenis<\/a> and <a href=\"https:\/\/www.scotusblog.com\/cases\/case-files\/masterpiece-cakeshop-ltd-v-colorado-civil-rights-commn\/\" target=\"_blank\">Masterpiece Cakeshop v. Colorado Civil Rights Commission<\/a>.<\/p>\n<p class=\"p1\">\u201cLike Chiles, these clients \u2018believe their faith and their relationships with God\u2019 inform \u2018romantic attractions and that God determines their identity according to what He has revealed in the Bible,\u2019\u201d the plaintiffs\u2019 <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-539\/331462\/20241108125757340_USSC%20Petition%20for%20Writ%20of%20Certiorari.pdf\" target=\"_blank\">petition<\/a> said. \u201cThese clients believe their lives will be more fulfilling if aligned with the teachings of their faith, and they want to achieve freedom from what they see as harmful self-perceptions and sexual behaviors.\u201d<\/p>\n<p class=\"p1\">\n<h4 class=\"editorialSubhed\">Lone dissent<\/h4>\n<\/p><p class=\"p1\">Gorsuch rejected Colorado\u2019s argument that the law, in being applied to talk therapy, regulates \u201cconduct, not speech.\u201d<\/p>\n<p class=\"p1\">\u201cIn many applications, the State\u2019s law banning \u2018conversion therapy\u2019 may address conduct \u2014 such as aversive physical interventions,\u201d Gorsuch wrote. \u201cBut here, Ms. Chiles seeks to engage only in speech, and as applied to her the law regulates what she may say. Her speech does not become conduct just because the State may call it that.\u201d<\/p>\n<p class=\"p1\">Conservatives hold a 6-3 majority on the nation\u2019s highest court. Two liberal justices, Elena Kagan and Sonia Sotomayor, joined the majority in a concurring opinion, raising the specter of a law that instead sought to ban mental health care affirming gender identity changes.<\/p>\n<p class=\"p1\">\u201cConsider a hypothetical law that is the mirror image of Colorado\u2019s. Instead of barring talk therapy designed to change a minor\u2019s sexual orientation or gender identity, this law bars therapy affirming those things \u2026 The First Amendment would apply in the identical way,\u201d Kagan wrote. \u201cBecause the State has suppressed one side of a debate, while aiding the other, the constitutional issue is straightforward.\u201d<\/p>\n<p class=\"p1\">In the court\u2019s lone dissenting opinion, Justice Ketanji Brown Jackson wrote that under Colorado\u2019s law, \u201ctreatment-related speech is being restricted incidentally to the State\u2019s regulation of the provision of medical care.\u201d<\/p>\n<p class=\"p1\">\u201cIt is not at all clear how, or to what extent, state regulation of medical care involving practitioner speech can survive this holding,\u201d Jackson wrote. \u201cWhat\u2019s next?
