Brian Seitz of Branson, would also decrease the statute of limitations for personal injury lawsuits and civil claims against insurance companies for uninsured or underinsured motorists.<\/span><\/p>\n<p><span>Survivors of childhood sexual abuse currently have only 10 years after they turn 21 to file suit, which advocates argue isn\u2019t enough time because it can take decades for people to understand that they were abused. Seitz\u2019s bill would give them until they turn 41.\u00a0<\/span><\/p>\n<p><span>With no change in those limits since 2004 and \u201cpowerful lobbies that used to oppose this bill now in support,\u201d Seitz said, \u201cwe will do what we can at this time.\u201d\u00a0<\/span><\/p>\n<p><span>\u201cThe perfect fix,\u201d he said, \u201cis no statute of limitations for victims of sexual abuse.\u201d\u00a0\u00a0<\/span><\/p>\n<p><span>The House passed the bill 95-12, with 39 lawmakers voting present. It now heads to the Senate for consideration.<\/span><\/p>\n<p>        <a href=\"https:\/\/missouriindependent.com\/subscribe\"><\/a><\/p>\n<div class=\"subscribeShortcodeContainer\">\n<div class=\"subscribeTextContainer\">\n                <i class=\"fas fa-envelope\"><\/i>\n<p>GET THE MORNING HEADLINES.<\/p>\n<\/div>\n<div class=\"subscribeButtonContainer\">\n                <button>SUBSCRIBE<\/button>\n            <\/div>\n<\/div>\n<p>        <\/p>\n<p><span>Seitz\u2019s legislation last year extending the childhood sexual abuse statute of limitations was added as an amendment to a bill reducing the window for filing personal injury lawsuits, sponsored by Republican state Rep. Matthew Overcast of Ava. <\/span><span>A spokesperson for the Missouri Insurance Coalition <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/06\/16\/missouri-republican-says-special-interests-killed-bill-aiding-child-sex-abuse-survivors\/\"><span>told The Independent<\/span><\/a><span> at the time that the amendment was added to assuage concerns about unintentional effects of the tort reform bill on the childhood statute of limitations.<\/span><\/p>\n<p><span>This year, Seitz introduced the legislation as a <\/span><a href=\"https:\/\/documents.house.mo.gov\/billtracking\/bills261\/hlrbillspdf\/4713H.01I.pdf\" target=\"_blank\"><span>stand-alone bill<\/span><\/a><span>, and tort reform elements similar to Overcast\u2019s 2025 bill were <\/span><a href=\"https:\/\/documents.house.mo.gov\/billtracking\/bills261\/hlrbillspdf\/4713H.02C.pdf\" target=\"_blank\"><span>added<\/span><\/a><span> in the House Commerce Committee.\u00a0<\/span><\/p>\n<p><span>Seitz\u2019s bill would not change the current five-year statute of limitations for survivors to take civil action against institutions that facilitated their abuse, such as summer camps or boarding schools.<\/span><\/p>\n<p><span>Missouri is one of 18 states that sets the statute of limitations under 35, according to <\/span><a href=\"https:\/\/childusa.org\/2025-sol-tracker\/\" target=\"_blank\"><span>Child USA<\/span><\/a><span>, and dozens of states have passed reforms on the statute of limitations for survivors in recent years.<\/span><\/p>\n<p><span>A Senate committee passed a separate bill last month, sponsored by Republican state Sen. Brad Hudson of Cape Fair, that would <\/span><a href=\"https:\/\/missouriindependent.com\/briefs\/missouri-senate-weighs-ending-statute-of-limitations-for-childhood-sexual-abuse\/\"><span>eliminate the statute of limitations<\/span><\/a><span> for childhood sexual abuse survivors. It has not yet come up for debate in the full Senate.\u00a0<\/span><\/p>\n<p><span>This is the fourth year in a row that an effort by Seitz to extend the statute of limitations for childhood sexual assault has advanced. The bill was <\/span><a href=\"https:\/\/missouriindependent.com\/2023\/05\/18\/bill-inspired-by-sexual-abuse-allegations-at-kanakuk-kamps-dies-in-missouri-legislature\/\"><span>partly inspired<\/span><\/a><span> by survivors of abuse at the Christian sports camp Kanakuk Kamps near Branson.<\/span><\/p>\n<p><span>In the previous three years, these efforts have fallen victim to concerns from insurance lobbyists that it would expose them to older claims that are costly and difficult to defend against.<\/span><\/p>\n<p><span>Seitz described the bill as the culmination of \u201cyears of bipartisan work.\u201d<\/span><\/p>\n<p><span>During House debate this week, Republican state Rep. Bryant Wolfin of Ste. Genevieve asked why the tort provisions were added.<\/span><\/p>\n<p><span>\u201cIt seems like we might have log-rolled this issue onto your bill, which was fantastic, to potentially try to get something that might be a little more controversial along the line,\u201d Wolfin said.<\/span><\/p>\n<p><span>Democratic state Rep. Will Jobe of Independence said that victims in personal injury cases often have to wait for criminal charges against defendants to be resolved before filing civil actions.\u00a0<\/span><\/p>\n<p><span>Since the statute of limitations for most felonies is three years, Jobe said, victims could be left with little or no time to seek redress.<\/span><\/p>\n<p><span>\u201cWe\u2019re attaching this wonderful and absolutely needed bill to something that is really going to hurt people,\u201d Jobe said.<\/span><\/p>\n<p><span>Before Wednesday\u2019s vote, Seitz said the rights of survivors of childhood sexual abuse \u201calways was and remains the primary portion\u201d of the bill.<\/span><\/p>\n<p><b>    <\/b><\/p>\n<h4 class=\"editorialSubhed\">Holding institutions accountable<\/h4>\n<p>\t<\/p>\n<p><span>In addition to abolishing the statute of limitations for survivors, the Senate bill sponsored by Hudson would add language that survivors can sue institutions that played a role in their abuse \u201cat any time.\u201d<\/span><\/p>\n<p><span>\u201cBy assigning an arbitrary statute of limitations for childhood sexual abuse, we are siding with abusers and perpetrators over survivors and making Missouri a sanctuary state for pedophiles,\u201d Hudson said during a committee hearing last month.\u00a0<\/span><\/p>\n<p><span>Kayla Onder, a St. Louis-based attorney who leads her firm\u2019s sexual abuse department, told The Independent that most survivors don\u2019t come forward until decades after their abuse \u2014 often because they didn\u2019t realize that they had been abused.<\/span><\/p>\n<p><span>\u201cUsually you have a client that was diagnosed with something, they\u2019re receiving those mental health treatments, and they start to realize, \u2018What I\u2019m experiencing now isn\u2019t just a random break in my mental health,\u2019\u201d Onder said. \u201cIt\u2019s layered from the abuse I experienced as a child.\u201d<\/span><\/p>\n<p><span>Onder said the legislation lawmakers are considering will help strengthen survivors\u2019 voice and help them find closure.<\/span><\/p>\n<p><span>\u201cWhen you\u2019re sexually assaulted, especially as a child, you might not have a physical injury that you can see then and there at that moment,\u201d she said. \u201cBut it doesn\u2019t mean that an injury did not occur.\u201d<\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>Republican state Rep.
