Mark Kelly\u2019s retirement rank and pay for appearing in the \u201cDon\u2019t Give Up The Ship\u201d video.\u00a0<\/p>\n<p dir=\"ltr\">The U.S. Court of Appeals for the District of Columbia Circuit\u2019s new schedule came just days after the Trump administration\u00a0<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cadc.42904\/gov.uscourts.cadc.42904.01208826156.0.pdf\" target=\"_blank\">requested an expedited timeline<\/a>.<\/p>\n<p dir=\"ltr\">\u201cIn light of the public\u2019s unusual interest in prompt disposition of this appeal, the government respectfully requests that this Court set an expedited briefing schedule that will allow the Court to hear oral argument this Term, before the Court\u2019s summer recess,\u201d Assistant Attorney General Brett A. Shumate wrote in a filing submitted Friday.\u00a0<\/p>\n<p dir=\"ltr\">The circuit court now expects the Trump administration to file a brief by March 20 explaining why it appealed\u00a0<a href=\"https:\/\/www.newsfromthestates.com\/article\/federal-judge-blocks-pentagon-attempt-demote-sen-mark-kelly-over-illegal-orders-video\" target=\"_blank\">the district court\u2019s ruling<\/a> and for Kelly\u2019s legal team to file its reply brief by April 27. Attorneys for both sides would then present their oral arguments May 7.\u00a0<\/p>\n<p dir=\"ltr\">Karen LeCraft Henderson, nominated by President George H.W. Bush in 1990; Cornelia T.L. Pillard, nominated by President Barack Obama in 2013; and Florence Y. Pan, nominated by President Joe Biden in 2022, make up the three-judge panel that will rule on the appeal.\u00a0\u00a0<\/p>\n<h4>90-second video<\/h4>\n<p dir=\"ltr\">The Defense Department\u2019s attempt to punish Kelly stems from when he and five other Democratic lawmakers posted\u00a0<a href=\"https:\/\/x.com\/SenatorSlotkin\/status\/1990774492356902948\" target=\"_blank\">a 90-second video<\/a> last year, telling members of the military and those in the nation\u2019s intelligence communities that they can and must refuse illegal orders.\u00a0<\/p>\n<p dir=\"ltr\">Kelly, a former Navy captain, was the only member of the group still subject to the military\u2019s judicial system, leading Defense Secretary Pete Hegseth\u00a0<a href=\"https:\/\/www.newsfromthestates.com\/article\/pentagon-will-try-penalize-arizona-sen-mark-kelly-illegal-orders-video\" target=\"_blank\">to issue a letter of censure and initiate proceedings<\/a> to downgrade the senator\u2019s retirement rank and pay.\u00a0<\/p>\n<p dir=\"ltr\">Kelly\u00a0<a href=\"https:\/\/www.newsfromthestates.com\/article\/arizona-us-sen-mark-kelly-sues-hegseth-over-penalties-illegal-orders-video\" target=\"_blank\">filed a lawsuit<\/a> in January, seeking to block those efforts on several fronts, including that it violated his constitutional rights.\u00a0<\/p>\n<p dir=\"ltr\">\u201cThe First Amendment forbids the government and its officials from punishing disfavored expression or retaliating against protected speech,\u201d Kelly\u2019s lawsuit stated. \u201cThat prohibition applies with particular force to legislators speaking on matters of public policy. As the Supreme Court held 60 years ago, the Constitution \u2018requires that legislators be given the widest latitude to express their views on issues of policy,\u2019 and the government may not recharacterize protected speech as supposed incitement in order to punish it.\u201d<\/p>\n<h4>Judge rules for Kelly<\/h4>\n<p dir=\"ltr\">Senior Judge Richard J. Leon of the District of Columbia District Court wrote in his 29-page ruling granting Kelly a preliminary injunction that \u201cit is a particularly valuable asset for our country to have retired veterans contributing to public discussion on military matters and policy.\u00a0<\/p>\n<p dir=\"ltr\">\u201cGiven their \u2018distinct perspective and specialized expertise,\u2019 it is essential for retired veterans to contribute to our \u2018public discourse\u2019 on issues of military policy. Allowing Defendants\u2019 actions against Senator Kelly to stand would further chill the speech of these retired servicemembers and thereby \u2018impoverish public debate on critical issues relating to our military and its role in domestic and foreign affairs.\u2019\u201d<\/p>\n<p dir=\"ltr\">The Department of Justice had sought a grand jury indictment against Kelly, Michigan Sen. Elissa Slotkin, Colorado Rep. Jason Crow, Pennsylvania Reps. Chris Deluzio and Chrissy Houlahan and New Hampshire Rep. Maggie Goodlander for their participation in the video. But it\u00a0<a href=\"https:\/\/www.newsfromthestates.com\/article\/democrats-decry-authoritarian-trump-attempt-indict-them-illegal-orders-video\" target=\"_blank\">was unsuccessful<\/a>.\u00a0<\/p>","protected":false},"excerpt":{"rendered":"<p>Arizona Democratic Sen.
