(Photo by Marty Schladen\/Ohio Capital Journal)<\/p>\n<\/figcaption><\/figure>\n<p>State officials across the country are looking to crack down on fraud and mistakes in the nation\u2019s largest food assistance program, spurred by looming federal rules that will force states with high error rates to pay more.<\/p>\n<p>But the Republican proposals mostly focus on more frequently verifying the eligibility of individual households that participate in the Supplemental Nutrition Assistance Program (SNAP), rather than on broader administrative shortcomings that allow most of the waste and fraud to occur.<\/p>\n<p>Policies such as verifying recipients\u2019 eligibility each month \u2014 which can involve cross-checking multiple databases or collecting extra documentation \u2014 might increase state agencies\u2019 workloads without lowering error rates. This is especially likely if states don\u2019t boost funding to handle the extra paperwork, investigate fraud or resolve recipient and agency errors.<\/p>\n<p>Eliza Kinsey, an assistant professor at the University of Pennsylvania\u2019s Perelman School of Medicine who focuses on hunger, said staffing shortages, outdated technology and changes to eligibility rules that require oversight are making it harder for state agencies to avoid overpaying or underpaying recipients \u2014 the errors that will cost states money under the new federal rules.<\/p>\n<p>\u201cThe fact that we\u2019re seeing error rates that are higher really makes sense, given the context of what\u2019s going on in SNAP right now,\u201d Kinsey said.<\/p>\n<div class=\"auxContainer newsroomSidebarContainer \">\n<div class=\"newsroomSidebar\">\n<p>SNAP serves nearly 42 million people \u2014 more than 1 in 10 U.S. residents. More than half are children under 18 or adults 60 and older.<\/p>\n<p>Each month, participating households receive an average of $187 in benefits per person to buy food.<\/p>\n<\/div><\/div>\n<p>SNAP, formerly known as food stamps, is a federal-state program that provides recipients with a debit card that can be used to purchase food at grocery stores and other retailers. SNAP errors and fraud often get conflated, but they\u2019re largely separate issues: Errors are unintentional mistakes by SNAP agencies or recipients, while fraud is intentional theft.<\/p>\n<p><a href=\"https:\/\/www.fns.usda.gov\/snap\/qc#:~:text=Payment%20errors%20are%20largely%20unintentional%20and%20may%20be%20on%20the%20part%20of%20the%20state%20agency%20or%20the%20SNAP%20household.%20For%20example%2C%20the%20state%20agency%20incorrectly%20calculates%20a%20household%E2%80%99s%20expenses%2C%20or%20a%20client%20forgets%20to%20provide%20the%20state%20with%20an%20update%20on%20their%20income.\" target=\"_blank\">SNAP errors<\/a> occur when the state overpays or underpays SNAP recipients. They\u2019re caused either by unintentional recipient mistakes \u2014 forgetting to report a change in how many people live in the household, for example \u2014 or by an agency processing error, such as incorrectly calculating a household\u2019s expenses.<\/p>\n<p>States have encountered <a href=\"https:\/\/www.cbpp.org\/research\/food-assistance\/snap-includes-extensive-payment-accuracy-system#:~:text=Relatively%20few%20SNAP%20errors%20represent%20dishonesty%20or%20fraud%20on%20the%20part%20of%20recipients%2C%20such%20as%20lying%20to%20eligibility%20workers%20to%20get%20benefits.\" target=\"_blank\">instances of individual recipient fraud<\/a>, though they can go uninvestigated when resources are scarce. Large sums, in the millions, have been stolen by sophisticated crime rings that electronically \u201cskim\u201d money from the debit cards that SNAP recipients use to purchase food.<\/p>\n<p>State SNAP error rates <a href=\"https:\/\/www.congress.gov\/crs-product\/IF10860#:~:text=Based%20on%20annual%20SNAP%20Quality,statement%20critical%20of%20the%20increases.\" target=\"_blank\">include<\/a> recipient fraud, recipient errors, and state agency errors.<\/p>\n<p>Alabama earned<a href=\"https:\/\/www.al.com\/news\/2025\/06\/4-million-in-alabama-ebt-card-funds-stolen-in-1-month-what-you-need-to-do.html\" target=\"_blank\"> local<\/a> and<a href=\"https:\/\/www.foxnews.com\/politics\/food-stamp-fraud-numbers-expose-which-states-draining-most-taxpayer-dollars#:~:text=Initial%20data%20from%20the%20USDA%E2%80%99s%20Food%20and%20Nutrition%20Service%20show%20Alabama%20leading%20the%20nation%20with%20more%20than%2026%2C000%20stolen%20SNAP%20benefit%20claims.\" target=\"_blank\"> national<\/a> media attention last year when initial U.S. Department of Agriculture data from early 2025 showed it leading the nation in stolen SNAP benefit claims, ahead of much more populous California and New York.<\/p>\n<p>\u201cThere\u2019s a lot of talk about SNAP fraud, and a lot of it is misrepresented,\u201d Nancy Buckner, commissioner of the Alabama Department of Human Resources, which administers Alabama\u2019s SNAP program, told state lawmakers at a January budget hearing. \u201cThe biggest SNAP fraud in this country are those people that are doing it electronically.\u201d<\/p>\n<p>In recent years, her department noticed SNAP purchases being made in states nowhere near Alabama, she said, including New York, Pennsylvania, Massachusetts and Maine.<\/p>\n<p>\u201cIt was obvious to us we don\u2019t have that many Alabama clients shopping in those other states,\u201d she said. <a href=\"https:\/\/dhr.alabama.gov\/chipped-ebt-cards-rolling-out-statewide-02102026\/\" target=\"_blank\">This month<\/a>, Alabama became<a href=\"https:\/\/www.fns.usda.gov\/snap\/ebt\/modernization#:~:text=A%20plain%20text%20description%20of%20the%20map%20below%20is%20available.\" target=\"_blank\"> the second state<\/a>, behind California, to issue SNAP debit cards to recipients with the kind of microchips that are standard on commercial debit cards. Chipped cards are harder to steal from than those with magnetic strips only.<\/p>\n<p>In the middle of it all, states are staring down massive cuts in federal funding. President Donald Trump\u2019s One Big Beautiful Bill Act puts states on the hook for more administrative costs and forces states to pay a higher share of benefits, in some cases hundreds of millions of dollars, if they have higher error rates.<\/p>\n<p>\u201cThe federal government is telling states, you have to pay more in administrative costs, and you have to bring your error rates down simultaneously,\u201d said Kinsey. \u201cIt feels like those two changes are in opposition with each other.\u201d<\/p>\n<h4 class=\"editorialSubhed\">Error prone<\/h4>\n<p>Last month, Alabama state lawmakers grilled Buckner, demanding to know her plan for lowering the state\u2019s error rate.<\/p>\n<p>Under Trump\u2019s new law, Alabama\u2019s SNAP administrative costs will rise by $39 million. Meanwhile, the state\u2019s error rate, which Buckner expects to be about 9%, is <a href=\"https:\/\/fns-prod.azureedge.us\/sites\/default\/files\/resource-files\/snap-fy24QC-PER.pdf\" target=\"_blank\">below the national average<\/a>, but high enough to allow the feds to force the state to cover 10% of its SNAP benefits starting in fiscal 2028.<\/p>\n<div class=\" newsroomBlockQuoteContainer  \">\n<div class=\"newsroomBlockQuoteSVGContainer\"><\/div>\n<div class=\"newsroomBlockQuoteQuoteContainer\">\n<p class=\"newsroomBlockQuote \">The federal government is telling states, you have to pay more in administrative costs, and you have to bring your error rates down simultaneously. It feels like those two changes are in opposition with each other.<\/p>\n<\/div>\n<div class=\"newsroomBlockQuoteAuthorContainer\">\n<p><b>\u2013 Eliza Kinsey, assistant professor at the University of Pennsylvania\u2019s Perelman School of Medicine<\/b><\/p>\n<\/div>\n<\/div>\n<p>All told, Alabama could be on the hook for an additional $200 million or more per year by 2028.<\/p>\n<p>\u201cIs there anything that can be done to prevent running into that $200 million wall?\u201d Alabama state Sen. Greg Albritton, a Republican, asked Buckner during a budget hearing in January. \u201cRight now I think that the train\u2019s got the light on, heading straight for us.\u201d<\/p>\n<p>Buckner said she hoped for some extra wiggle room from the feds, but provided few details on how the department could lower Alabama\u2019s error rate enough to avoid financial penalties.<\/p>\n<p>Currently, the federal government pays for SNAP benefits and splits administration costs 50\/50 with states. But starting in October, under the One Big Beautiful Bill Act, all states will be on the hook for 75% of their own administrative costs. And the new law allows the feds to penalize states for their SNAP errors, requiring them to pay from 5%-15% of their SNAP benefit costs if their error rates are over 6%.<\/p>\n<p>The only states under the 6% threshold, per the most recent data available from USDA, which oversees the program, were Idaho, Nebraska, Nevada, South Dakota, Utah, Vermont, Wisconsin and Wyoming.<\/p>\n<p>Republicans say these new rules will reduce the federal government\u2019s investment in SNAP while giving states some \u201c<a href=\"https:\/\/mikejohnson.house.gov\/news\/documentsingle.aspx?DocumentID=2622#:~:text=Phases%20in%20a%20state%20cost%20share%C2%A0starting%20at%205%25%20in%202028%2C%20with%20higher%20contributions%20from%20states%20with%20high%20error%20rates%2C%C2%A0giving%20states%20real%20skin%20in%20the%20game.\" target=\"_blank\">skin in the game<\/a>\u201d when it comes to being responsible with federal money.<\/p>\n<p>\u201cOne of the problems is the federal programs don\u2019t mandate the prevention, detection and prosecution of fraud,\u201d said Dawn Royal, with the United Council on Welfare Fraud, a national membership group focused on fraud in public assistance programs. \u201cAnd so states are unwilling to spend state money in order to protect federal money.\u201d<\/p>\n<p>In Alabama, the USDA replaced<a href=\"https:\/\/www.fns.usda.gov\/data-research\/data-visualization\/snap-replacement-stolen-benefits-dashboard\" target=\"_blank\"> nearly $16 million in stolen benefits<\/a> from fiscal 2023 to fiscal 2025, according to federal data.<\/p>\n<p>The Alabama Senate is currently considering a <a href=\"https:\/\/legiscan.com\/AL\/bill\/SB61\" target=\"_blank\">bill<\/a> that would require state agencies to<a href=\"https:\/\/alabamareflector.com\/2026\/01\/21\/senate-committee-approves-bill-requiring-cross-checks-for-medicaid-snap-enrollees\/\" target=\"_blank\"> conduct monthly checks<\/a> of other state databases to make sure SNAP enrollees remain eligible.<\/p>\n<p>Buckner told state lawmakers that increasing eligibility checks for SNAP benefits would \u201cshoot that error rate up, way up.\u201d The state\u2019s Legislative Fiscal Office estimated the additional work for both Medicaid and SNAP under the pending bill could cost $16.7 million per year.<\/p>\n<p>\u201cMonthly reporting is not the answer to that, at all,\u201d she said.<\/p>\n<p>But other states are looking at similar measures.<\/p>\n<p>Lawmakers in states including<a href=\"https:\/\/legiscan.com\/ID\/bill\/H0730\/2026\" target=\"_blank\"> Idaho<\/a>,<a href=\"https:\/\/legiscan.com\/KS\/text\/SB363\/id\/3329464\" target=\"_blank\"> Kansas<\/a> and<a href=\"https:\/\/www.wyoleg.gov\/Legislation\/2026\/SF0106\" target=\"_blank\"> Wyoming<\/a> have introduced bills to require their state SNAP administrators to check eligibility of SNAP recipients more frequently.<a href=\"https:\/\/legiscan.com\/MO\/text\/SB1616\/id\/3347586\" target=\"_blank\"> Missouri<\/a>,<a href=\"https:\/\/legiscan.com\/OK\/text\/HB4422\/2026\" target=\"_blank\"> Oklahoma<\/a> and<a href=\"https:\/\/legiscan.com\/UT\/text\/HB0471\/2026\" target=\"_blank\"> Utah<\/a> bills would require verification of citizenship or legal immigration status before approving applicants for SNAP benefits. A Wisconsin bill would require the state\u2019s Democratic governor to <a href=\"https:\/\/www.newsfromthestates.com\/article\/legislation-would-push-state-give-trump-administration-snap-data\" target=\"_blank\">bow to a White House demand <\/a>to turn over state data on SNAP recipients.<\/p>\n<p>And in Arizona, GOP lawmakers <a href=\"https:\/\/www.newsfromthestates.com\/article\/republicans-push-stricter-snap-penalties-beyond-federal-requirements\" target=\"_blank\">wanted to go even further<\/a> than the new federal requirements. Last week Democratic Gov. Katie Hobbs <a href=\"https:\/\/azmirror.com\/briefs\/hobbs-vetoes-republican-bills-that-would-have-imposed-harsher-penalties-on-arizona-food-assistance\/\" target=\"_blank\">vetoed<\/a> a package of Republican bills that would have required the state agency administering SNAP to get its error rate below 3% by 2030 or face financial penalties, and <a href=\"https:\/\/www.newsfromthestates.com\/article\/republicans-push-stricter-snap-penalties-beyond-federal-requirements#:~:text=And%20the%20bill%20from%20Rep.%20Nick%20Kupper%2C%20R-Surprise%2C%20would%20cut%20another%2010%25%20from%20DES%E2%80%99s%20budget%20if%20it%20fails%20to%20implement%20a%20corrective%20action%20plan%20to%20bring%20the%20payment%20error%20rate%20under%203%25.%C2%A0\" target=\"_blank\">cut an additional 10% from its budget<\/a> if the state failed to take corrective action.<\/p>\n<h4 class=\"editorialSubhed\">States target fraud<\/h4>\n<p>SNAP fraud has made state and national headlines in recent years, but there\u2019s not a broad consensus on the scale of the problem nor how to address it.<\/p>\n<p>Some SNAP fraud is perpetrated by recipients who lie in order to get SNAP benefits for which they\u2019re not eligible. But there\u2019s also organized electronic<a href=\"https:\/\/www.gao.gov\/blog\/stolen-snap-benefits-cost-beneficiaries-millions\" target=\"_blank\"> SNAP theft<\/a>, which involves thieves taking control of EBT accounts through electronic methods such as card skimming or cloning, bot attacks and phishing scams. <a href=\"https:\/\/www.congress.gov\/crs-product\/IN12419#:~:text=Card%20skimming%20occurs%20when%20illegally%20installed%20devices%20inside%20Automated%20Teller%20Machines%20(ATM)%20or%20point-of-sale%20(POS)%20terminals%20capture%20card%20data%2C%20including%20personal%20identification%20numbers.%20That%20captured%20information%20is%20then%20used%20to%20make%20unauthorized%20purchases%20and%20steal%20from%20a%20victim%27s%20account.\" target=\"_blank\">Skimming<\/a> is a form of theft where devices are illegally installed inside sales terminals at a store and capture card data. That data is then used to make unauthorized purchases or steal from the victim\u2019s account.<\/p>\n<p>In December, a longtime USDA employee was sentenced to two years in prison for her role in what the U.S. Department of Justice called<a href=\"https:\/\/www.justice.gov\/usao-sdny\/pr\/usda-employee-sentenced-two-years-prison-multimillion-dollar-food-stamp-fraud-and\" target=\"_blank\"> a \u201csprawling fraud and bribery scheme\u201d<\/a> that generated more than $66 million in unauthorized SNAP transactions. The same month, two Romanian nationals were indicted for their role in allegedly stealing <a href=\"https:\/\/www.justice.gov\/usao-or\/pr\/romanian-nationals-unlawfully-residing-united-states-indicted-conspiring-steal-snap\" target=\"_blank\">more than $160,000 in benefits<\/a> in Oregon and elsewhere. In 2025, California reported <a href=\"https:\/\/lacounty.gov\/2025\/02\/06\/da-hochman-announces-charges-in-public-benefits-ebt-fraud-scheme-in-lancaster\/#:~:text=In%20the%20past%20year%2C%20the,occurred%20in%20Los%20Angeles%20County\" target=\"_blank\">more than $100 million<\/a> in stolen funds from California SNAP recipients\u2019 EBT cards.<\/p>\n<p>States reported replacing more than $360 million in stolen benefits from fiscal 2023-2025, according to federal data. Experts and state officials differ on whether recipients or organized crime rings are the biggest threats to SNAP. But since the federal government<a href=\"https:\/\/www.fns.usda.gov\/snap\/sunset-stolen-benefits-replacement-plan\" target=\"_blank\"> stopped reimbursing stolen SNAP benefits<\/a> at the end of 2024, more states are looking at ways to address fraud.<\/p>\n<p>States including Arkansas, Maryland, Massachusetts, Michigan, New Jersey, Oklahoma and Virginia are joining Alabama and California in <a href=\"https:\/\/www.fns.usda.gov\/snap\/ebt\/modernization\" target=\"_blank\">rolling out chip cards<\/a> to make it harder for skimmers to steal SNAP benefits.<\/p>\n<p>\u201cSNAP fraud is rampant,\u201d said Royal, of the United Council on Welfare Fraud. \u201cIf anybody tells you that there\u2019s not SNAP fraud out there, they\u2019re trying to pull the wool over your eyes. It exists in all 50 states.
