(Steph Quinn\/Missouri Independent).<\/p>\n<p><span>Missouri lawmakers are weighing a slate of bills aimed at reining in artificial intelligence, from proposals targeting \u201cdeepfakes\u201d to limits on the technology\u2019s use in political campaigns.<\/span><\/p>\n<p><span>At the same time, lawmakers are also considering measures that would limit the liability of companies that develop or deploy AI systems when those systems cause harm.<\/span><\/p>\n<p><span>But as the proposals move through the legislative process, some lawmakers questioned whether the bills have had enough discussion, pointing to the complexity and rapid development of AI technologies.\u00a0<\/span><\/p>\n<p><span>Republican state Rep. Wendy Hausman of St. Peters, said her bill, \u201c<\/span><a href=\"https:\/\/house.mo.gov\/bill.aspx?bill=HB1887&amp;year=2026&amp;code=R\" target=\"_blank\"><span>The Taylor Swift Act<\/span><\/a><span>,\u201d aims to provide \u201cclear civil remedies\u201d for Missourians unwillingly featured in deepfakes, or fake, AI-generated images of them.<\/span><\/p>\n<p><span>The bill would provide a path for Missourians to sue when someone has distributed or published an AI-generated sexual image of them without their written consent. In cases of AI-generated digital depictions of children and teens, a legal guardian would be able to file suit even if the depiction was not sexual.\u00a0<\/span><\/p>\n<p><span>It\u2019s one of many bills on deepfakes under discussion in the General Assembly. Seven lawmakers jointly presented similar proposals to the House Emerging Issues Committee this week and said they planned to combine their bills as they moved forward.<\/span><\/p>\n<p><span>Republican state Rep. George Hruza of Huntleigh told The Independent that he believes the sponsors will present a \u201creasonable\u201d bill for the committee to vote on. But during the committee hearing, he asked the sponsors to distill the \u201cbest practices\u201d from their proposals.<\/span><\/p>\n<p><span>\u201cClearly, these are all important bills sitting here,\u201d Hruza said. \u201cI have no clue which one I should consider or we should consider.\u201d<\/span><\/p>\n<p><span>Lawmakers are also navigating contested territory as they seek to outline AI companies\u2019 liability for the impacts of their products, looking to other states\u2019 examples amid <\/span><a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/12\/eliminating-state-law-obstruction-of-national-artificial-intelligence-policy\/\" target=\"_blank\"><span>federal opposition to a \u201cpatchwork\u201d of state laws<\/span><\/a><span>.<\/span><\/p>\n<p><span>A <\/span><a href=\"https:\/\/house.mo.gov\/Bill.aspx?bill=HB1746&amp;year=2026&amp;code=R\" target=\"_blank\"><span>bill<\/span><\/a><span> sponsored by Republican state Reps. Scott Miller of St. Charles and Phil Amato of Arnold would shield companies from criminal liability if they adhere to a set of voluntary federal safety guidelines established by the National Institute of Standards and Technology, called the <\/span><a href=\"https:\/\/www.nist.gov\/itl\/ai-risk-management-framework\" target=\"_blank\"><span>AI Risk Management Framework<\/span><\/a><span>.<\/span><\/p>\n<p><span>Miller told The Independent that the bill, which is being amended ahead of a committee vote, would outline how companies can show that they are \u201cputting a good foot forward\u201d and restrict legal action against companies that do so.<\/span><\/p>\n<p><span>\u201cIt\u2019s establishing proper oversight and then limiting the liability when deployers or developers of AI are following in compliance with [federal guidelines],\u201d Miller said.<\/span><\/p>\n<p><b>    <\/b><\/p>\n<h4 class=\"editorialSubhed\">A patchwork?<\/h4>\n<p>\t<\/p>\n<p><span>Miller consulted with Ohio lawmakers while working on his bill. Like <\/span><a href=\"https:\/\/ohiocapitaljournal.com\/2025\/11\/17\/whats-in-ohios-proposal-banning-ai-personhood\/\" target=\"_blank\"><span>legislation moving through Ohio\u2019s legislature<\/span><\/a><span>, the bill would prohibit people from marrying an AI partner and bar AI from owning property.<\/span><\/p>\n<p><span>Stating AI\u2019s \u201cnon-sentience,\u201d Miller said, is necessary to ensure that courts can trace liability to a human actor.<\/span><\/p>\n<p><span>\u201cThere\u2019s always a human being that\u2019s responsible for it,\u201d Miller said.\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/legislature.idaho.gov\/statutesrules\/idstat\/Title5\/T5CH3\/SECT5-346\/\" target=\"_blank\"><span>Idaho law<\/span><\/a><span> already prohibits granting personhood to AI. <\/span><a href=\"https:\/\/ai-law-center.orrick.com\/us-ai-law-tracker-see-all-states\/\" target=\"_blank\"><span>More than 20 states<\/span><\/a><span> have laws regulating AI-generated intimate depictions, and Texas, New Jersey, New Hampshire and Arizona already have laws on deepfakes more broadly.<\/span><\/p>\n<p><span>Miller said that because his bill incorporates the national risk management framework, he doesn\u2019t believe it will run afoul of federal policies.<\/span><\/p>\n<p><span>President Donald Trump issued an <\/span><a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/12\/eliminating-state-law-obstruction-of-national-artificial-intelligence-policy\/\" target=\"_blank\"><span>executive order<\/span><\/a><span> in December warning against conflicting state AI regulations and calling for the establishment of a task force to challenge state laws that don\u2019t \u201csustain and enhance the United States\u2019 global AI dominance.\u201d<\/span><\/p>\n<p><span>\u201cEven if we\u2019re not 100% online with what the federal government may come down with, I suspect they\u2019ll be referencing their own national standards,\u201d Miller said. \u201cSo if we\u2019re reasonably close to that, then we shouldn\u2019t be\u2026far off.\u201d<\/span><\/p>\n<p><b>    <\/b><\/p>\n<h4 class=\"editorialSubhed\">Deepfakes<\/h4>\n<p>\t<\/p>\n<p><span>Most, but not all, of the bills on deepfakes focus on intimate or sexual digital depictions, and some pertain specifically to images of children and teens. The bills differ on which offenses would be subject to criminal penalties or civil damages. Some differ in their definitions of AI, while some don\u2019t explicitly refer to AI at all.<\/span><\/p>\n<p><span>Hausman\u2019s bill would also make it a felony to disclose or threaten to disclose AI-generated sexual depictions of someone in order to harm their reputation or finances. The first offense would carry a maximum penalty of four years\u2019 imprisonment, while subsequent violations would be punishable by up to 10 years in prison.<\/span><\/p>\n<p><span>\u201cNo Missourian should have their private, intimate images weaponized, and technology should not be a tool for coercion or humiliation,\u201d she said.<\/span><\/p>\n<p><span>An identical bill sponsored by Republican state <\/span><a href=\"https:\/\/www.senate.mo.gov\/26info\/BTS_Web\/Bill.aspx?SessionType=r&amp;BillID=136\" target=\"_blank\"><span>Sen. Travis Fitzwater <\/span><\/a><span>of Holts Summit was approved by a Senate committee on Feb. 4. Hausman\u2019s bill is also similar to legislation sponsored by Republican state <\/span><a href=\"https:\/\/house.mo.gov\/Bill.aspx?bill=HB1913&amp;year=2026&amp;code=R\" target=\"_blank\"><span>Rep. Cecelie Williams<\/span><\/a><span> of Dittmer that passed the House last year.<\/span><\/p>\n<p><span>A bill from Republican state <\/span><a href=\"https:\/\/house.mo.gov\/Bill.aspx?bill=HB2035&amp;year=2026&amp;code=R\" target=\"_blank\"><span>Rep. Jeff Farnan<\/span><\/a><span> of Stanberry is similar to Hausman and Williams\u2019 legislation, but it would set a maximum of $10,000 in damages. It would also add AI-generated content to Missouri\u2019s definition of child pornography, as would a bill sponsored by Republican state <\/span><a href=\"https:\/\/house.mo.gov\/bill.aspx?bill=HB1839&amp;year=2026&amp;code=R\" target=\"_blank\"><span>Rep. Sherri Gallick<\/span><\/a><span>. A bill from Republican state <\/span><a href=\"https:\/\/archive.house.mo.gov\/bill.aspx?bill=HB2862&amp;year=2026&amp;code=R\" target=\"_blank\"><span>Rep. David Dolan<\/span><\/a><span> would require courts to rule on \u201cdigital impersonations\u201d within two business days, since \u201cwe all know that justice delayed is justice denied.\u201d<\/span><\/p>\n<p><span>A bill sponsored by Republican state <\/span><a href=\"https:\/\/www.senate.mo.gov\/26info\/BTS_Web\/Bill.aspx?SessionType=r&amp;BillID=52370\" target=\"_blank\"><span>Sen. Joe Nicola<\/span><\/a><span> of Grain Valley would require disclosure of the use of AI in political advertisements and election communications.<\/span><\/p>\n<p><span>Republican state <\/span><a href=\"https:\/\/house.mo.gov\/Bill.aspx?bill=HB2361&amp;year=2026&amp;code=R\" target=\"_blank\"><span>Rep. Melissa Schmidt<\/span><\/a><span> of Eldridge is sponsoring a bill that would require online platforms to establish procedures for users to request the removal of digital sexual depictions of them. Platforms would be required to remove the content within 48 hours of receiving the request.<\/span><\/p>\n<p><span>The broadest proposal comes from Republican state <\/span><a href=\"https:\/\/house.mo.gov\/bill.aspx?bill=HB2321&amp;year=2026&amp;code=R\" target=\"_blank\"><span>Rep. Bill Lucas<\/span><\/a><span> of DeSoto. It would make it a crime to distribute any deepfake without consent, with a penalty of up to two years\u2019 imprisonment, a fine of up to $20,000 or both. The bill specifies harsher punishments for online publication of deepfakes, if the content is \u201csexual or pornographic,\u201d or if the content damages someone\u2019s reputation or puts them in danger. The maximum penalty \u2014 for sexual content that damages someone\u2019s reputation or safety \u2014 would be five years in prison and a fine of up to $110,000.<\/span><\/p>\n<p><span>Lawmakers agreed that the bills cover an important topic, but some raised concerns that considering seven distinct bills at once would prevent them from asking questions to help make the legislation better.<\/span><\/p>\n<p><span>Democratic state Rep. Wick Thomas of Kansas City said the bills were different enough that they \u201c[didn\u2019t] even know what to ask.\u201d<\/span><\/p>\n<p><span>\u201cIt is impossible with this amount of bills that are all very different, or at least subtly different in some of them, to ask the important questions that need to be asked without seeing the House committee substitute,\u201d Thomas said.<\/span><\/p>\n<p><span>Thomas told The Independent that without more discussion, the bill sponsors would lose out on opportunities to strengthen the bill.<\/span><\/p>\n<p><span>\u201cThe point of these committees is that they get hard questions from both sides of the aisle so that they can make the bill better,\u201d Thomas said.\u00a0<\/span><\/p>\n<p><span>Democratic state Rep. Elizabeth Fuchs of St. Louis suggested adding an expiration date to the law that would prompt lawmakers to reconsider it several years into its implementation.<\/span><\/p>\n<p><span>\u201cDo we maybe want to come to this again in a couple years\u2026so that we can as a legislative body come back and say, \u2018Did we make the right decisions about AI?\u201d Fuchs said.<\/span><\/p>\n<p><span>Lucas said he is optimistic that the deepfakes bills will advance.<\/span><\/p>\n<p><span>\u201cI have full faith and confidence in this committee,\u201d he said, \u201cto meld all these bills into one good thing that we can pass in the House.\u201d<\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>Republican state Reps.
