Darin Chappell of Rogersville, would make it harder for Missouri to reverse Medicaid work requirements if voters approve the constitutional amendment and if federal law changes. Chappell said his proposal is not intended to defund Medicaid expansion (Tim Bommel\/Missouri House Communications).<\/p>\n<p><span>Missouri Republicans voted Thursday to advance a plan to <\/span><a href=\"https:\/\/missouriindependent.com\/2026\/01\/16\/missouri-republicans-push-to-put-medicaid-work-requirements-into-state-constitution\/\"><span>add Medicaid work requirements to the state Constitution<\/span><\/a><span>, hoping to put the issue before voters in November.<\/span><\/p>\n<p><span>Democrats insist the <\/span><a href=\"https:\/\/documents.house.mo.gov\/billtracking\/bills261\/hlrbillspdf\/6310H.02C.pdf\" target=\"_blank\"><span>proposal<\/span><\/a><span>, which passed the Missouri House 99-48 on a party-line vote, would open the door for state lawmakers to defund the voter-approved expansion of Missouri\u2019s Medicaid program, MO HealthNet.<\/span><\/p>\n<p><span>House Minority Leader Ashley Aune, a Democrat from Kansas City, told reporters that defunding Medicaid expansion is \u201cthe one reason that Republicans want to put this measure in front of Missouri voters.\u201d<\/span><\/p>\n<p><span>Republican state Rep. Darin Chappell of Rogersville, the proposal\u2019s sponsor, told The Independent that this is not the intent of the bill.<\/span><\/p>\n<p><span>\u201cThe only individuals that would be unfunded are able-bodied adults [ages] 19 to 64, physically capable of working, and they\u2019re unwilling to work half-time, go to school half-time, [participate in] a work program [or] do community service for 80 hours a month,\u201d Chappell said.<\/span><\/p>\n<p><span>Chappell said his proposal is \u201cintended to mirror\u201d Medicaid work requirements passed by Congress in July 2025 as part of the One Big Beautiful Bill Act. Even though defunding expansion is not his intent, he said he can\u2019t predict how a court might rule should the issue come up in the future.\u00a0\u00a0<\/span><\/p>\n<p><span>\u201cI quit guessing how the courts will interpret something a long time ago,\u201d he told The Independent. \u201cI can only speak to my intentions.\u201d<\/span><\/p>\n<p><span>Starting next year,\u00a0 federal law will require states to verify that people who would otherwise qualify for Medicaid as part of the adult expansion group worked, volunteered or studied for 80 hours during the previous month in order to enroll. States will also have to recertify individuals\u2019 eligibility twice yearly rather than annually.<\/span><\/p>\n<p><span>The federal provisions will override current language on Medicaid in the Missouri Constitution starting next year even if Chappell\u2019s measure fails because the U.S. Constitution declares laws passed by Congress the \u201csupreme law of the land.\u201d<\/span><\/p>\n<p><span>But Chappell said during debate on his proposal last week that he wants Medicaid work requirements in Missouri to outlast any future changes to federal law.\u00a0<\/span><\/p>\n<p><span>\u201cSomeday that law may be changed,\u201d Chappell said, \u201cand I believe that this is good policy, and it needs to be on a permanent level within the state.\u201d<\/span><\/p>\n<p><b>    <\/b><\/p>\n<h4 class=\"editorialSubhed\">Legal questions<\/h4>\n<p>\t<\/p>\n<p><span>Aune told reporters that Republicans are trying to trick Missourians who support work requirements into voting to allow state lawmakers to defund Medicaid expansion.<\/span><\/p>\n<p><span>\u201cThey know, because the courts told them explicitly, that they cannot do it statutorily, so they have to do it constitutionally,\u201d Aune said. \u201cThey are taking it to the voters, but they\u2019re putting ballot candy on there to make Missourians think that they\u2019re voting on work requirements, which the federal government has already told us we have to impose.\u201d<\/span><\/p>\n<p><span>Chappell told The Independent that his proposal does not contain \u201cballot candy.\u201d<\/span><\/p>\n<p><span>\u201cThis is a functional application of common sense to a situation that has diminishing funds available for people in desperate need,\u201d he said.<\/span><\/p>\n<p><span>The ballot measure, if approved by Missouri voters, would strike from the state Constitution a prohibition on imposing \u201c<\/span><a href=\"https:\/\/www.sos.mo.gov\/CMSImages\/Publications\/MissouriConstitution.pdf\" target=\"_blank\"><span>greater or additional burdens or restrictions<\/span><\/a><span>\u201d on people who qualify for Medicaid as part of the adult expansion population.<\/span><\/p>\n<p><span>Missourians voted in August 2020 to expand Medicaid eligibility to include adults aged 19 to 64 with household incomes of 138% or less of the federal poverty guideline. In 2026, that\u2019s $45,540 a year for a family of four.<\/span><\/p>\n<figure class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-25779\" src=\"https:\/\/missouriindependent.com\/wp-content\/uploads\/2025\/06\/061125_aune1-scaled.jpg\" alt=\"\" width=\"2560\" height=\"1536\" \/><figcaption class=\"wp-caption-text\"><em>House Minority Leader Ashley Aune speaks at a press conference at the end of special session on June 11, 2025 (Annelise Hanshaw\/Missouri Independent).<\/em><\/figcaption><\/figure>\n<p><span>State lawmakers in 2021 blocked former Gov. Mike Parson\u2019s plan to fund Medicaid expansion in accordance with the voter-approved amendment. The Missouri Supreme Court <\/span><a href=\"https:\/\/missouriindependent.com\/2021\/07\/22\/missouri-supreme-court-rules-voter-approved-medicaid-expansion-is-constitutional\/\"><span>overturned<\/span><\/a><span> a trial court ruling affirming lawmakers\u2019 decision, and MO HealthNet <\/span><a href=\"https:\/\/missouriindependent.com\/briefs\/missouri-has-enrolled-4300-people-in-expanded-medicaid-program\/\"><span>began accepting applications<\/span><\/a><span> for expansion coverage in August 2021.<\/span><\/p>\n<p><span>The state Supreme Court referred to the section of the constitution that Chappell\u2019s proposal would delete when it ordered Missouri to expand Medicaid.<\/span><\/p>\n<p><span>\u201cWith no ambiguity, the amounts appropriated and other extrinsic evidence cannot be used to alter the plain language of the purposes stated \u2013 to fund MO HealthNet without distinguishing between benefits provided to individuals who are eligible as part of the pre-expansion and those eligible only under\u201d the amendment, the court wrote.<\/span><\/p>\n<p><span>The proposal also removes a provision requiring the state to seek maximum federal financial participation to fund Medicaid expansion.<\/span><\/p>\n<p><span>State Rep. Betsy Fogle of Springfield, ranking Democrat on the House Budget Committee, told The Independent that removing the two provisions endangers Medicaid expansion.<\/span><\/p>\n<p><span>\u201cI think very easily and clearly you could point to, that\u2019s an attempt to defund expansion,\u201d Fogle said.<\/span><\/p>\n<p><b>    <\/b><\/p>\n<h4 class=\"editorialSubhed\">High stakes<\/h4>\n<p>\t<\/p>\n<p><span>Chappell, who is chair of the House budget subcommittee covering social services, said potential savings from his proposal could help the state afford services for vulnerable Missourians. He referred to dozens of Missourians who crowded into a Capitol hearing room last week to oppose Gov. Mike Kehoe\u2019s proposed <\/span><a href=\"https:\/\/missouriindependent.com\/2026\/02\/13\/families-caregivers-plead-with-missouri-lawmakers-to-reverse-governors-disability-cuts\/\"><span>$80.7 million in cuts to programs that help people with developmental disabilities live safely in their homes<\/span><\/a><span>.<\/span><\/p>\n<p><span>\u201cI will not let $1 be wasted on someone who\u2019s capable and will not work, [and] be taken from those folks,\u201d Chappell told The Independent. \u201c\u2026Every dollar we spend is $1 that\u2019s no longer available.\u201d<\/span><\/p>\n<p><span>Republican state Rep. Renee Reuter of Imperial underlined the potential for work or volunteering to enrich people\u2019s lives.<\/span><\/p>\n<p><span>\u201cIt\u2019s important for our people to be encouraged to work, to be encouraged to find their purpose,\u201d she said.<\/span><\/p>\n<p><span>But Democrats said that layering state work requirements over the federal changes would cost the state money and hinder the ability of the Department of Social Services, which administers Medicaid enrollment and eligibility, to meet a series of rapidly approaching federal benchmarks.<\/span><\/p>\n<p><span>The <\/span><a href=\"https:\/\/documents.house.mo.gov\/billtracking\/bills261\/fiscal\/fispdf\/6310H.02P.ORG.pdf\" target=\"_blank\"><span>fiscal note<\/span><\/a><span> for Chappell\u2019s proposal indicates a cost of $9 million to put the issue on the ballot in November.\u00a0<\/span><\/p>\n<p><span>Social Services Director Jess Bax told lawmakers in January that if the department does not decrease its Medicaid error rates below 3% by October 2029 \u2014 while implementing the new changes \u2014 the state could face a <\/span><a href=\"https:\/\/missouriindependent.com\/2026\/01\/16\/missouri-republicans-push-to-put-medicaid-work-requirements-into-state-constitution\/\"><span>clawback of up to $1.2 billion<\/span><\/a><span> in federal funding. She said the state\u2019s error rate in 2019, the year of the last federal audit before the COVID-19 pandemic, was 35%.<\/span><\/p>\n<p><span>Democratic state Rep. Melissa Douglas of Kansas City said the proposal would make the department\u2019s job harder.<\/span><\/p>\n<p><span>\u201cWe stand here to remove barriers,\u201d she said.<\/span><\/p>\n<p><span>Democratic state Rep. Aaron Crossley of Independence said the state should spend money directly on services that help Missourians.<\/span><\/p>\n<p><span>\u201cWe should support policies that are going to get money to the people that need it most,\u201d Crossley said, \u201cand not to bureaucrats sitting in offices making monthly determinations on people\u2019s eligibility.\u201d<\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>The proposal, sponsored by Republican state Rep.
