Nick Schroer, a Defiance Republican, in the Missouri Senate in 2025 (Annelise Hanshaw\/Missouri Independent).<\/p>\n<p><span>A push for Missouri to immediately adopt planned <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/12\/23\/new-federal-regulations-complicate-missouri-debate-over-intoxicating-hemp\/\"><span>federal limits<\/span><\/a><span> on intoxicating hemp products ran into a filibuster in the state Senate Wednesday, with critics demanding any changes wait until national regulations go into effect in November.<\/span><\/p>\n<p><span>Democratic state Sen. Karla May of St. Louis led the two-hour filibuster of a <a href=\"https:\/\/www.senate.mo.gov\/26info\/BTS_Web\/Bill.aspx?SessionType=R&amp;BillID=443\" target=\"_blank\">bill<\/a> that would immediately ban hemp-derived THC beverages and edibles as soon as the legislation was passed and signed into law.\u00a0<\/span><\/p>\n<p><span>May argued during a Senate debate Wednesday that the federal limits will likely change before they\u2019re enacted later this year. Congress passed the provision to ban these products as part of the federal spending package last year.<\/span><\/p>\n<div class=\"halfwidth\">\n<div class=\"tipContainer\">\n<div class=\"tipTextContainer\">\n<h4>Need to get in touch?<\/h4>\n<h4>Have a news tip?<\/h4>\n<\/div>\n<div class=\"tipIconContainer\">\n\t\t\t\t<a href=\"mailto:info@missouriindependent.com\"><button>CONTACT US<\/button><\/a>\n\t\t\t<\/div>\n<\/div>\n<\/div>\n<p><span>She offered an <a href=\"https:\/\/www.senate.mo.gov\/ChamberInfo\/view.pdf\" target=\"_blank\">amendment<\/a> that would align the Senate bill with a <\/span><a href=\"https:\/\/house.mo.gov\/Bill.aspx?bill=HB2641&amp;year=2026&amp;code=R\" target=\"_blank\"><span>proposal<\/span><\/a><span> sponsored in the House by Republican state Rep. Dave Hinman of O\u2019Fallon to allow Missouri to sell the products if Congress permits them nationwide.\u00a0<\/span><\/p>\n<p><span>Hinman\u2019s bill has cleared a House committee and is ready to be debated by the full chamber.\u00a0<\/span><\/p>\n<p><span>\u201cWhen Congress voted on this whole thing, this was just literally to reopen the government,\u201d May said. \u201cI mean, this wasn\u2019t even a thoughtful conversation.\u201d<\/span><\/p>\n<p><span>The bill debated Wednesday evening, sponsored by Republican state Sen. David Gregory of Chesterfield, would prohibit hemp products from containing more than 0.4 milligrams of THC per container and more than a total THC concentration of .3% on a dry weight basis, rather than only delta-9 THC. These mirror the federal limits.<\/span><\/p>\n<p><a href=\"https:\/\/missouriindependent.com\/2026\/02\/11\/missouri-ag-sues-st-louis-smoke-shop-for-selling-intoxicating-thc-candy-bars\/\"><span>Intoxicating hemp products with as much as 1,000mg of THC <\/span><\/a><span>are being sold in smoke shops \u2014 outside of Missouri\u2019s licensed marijuana dispensaries \u2014 and they aren\u2019t regulated by any government agency. Missouri lawmakers have failed to pass legislation regulating these products <\/span><a href=\"https:\/\/missouriindependent.com\/2023\/04\/14\/missouri-lawmakers-take-aim-at-unregulated-delta-8-thc-hemp-products\/\"><span>since 2023<\/span><\/a><span>.\u00a0<\/span><\/p>\n<p><span>Gregory argues his bill and the federal provision close loopholes that were opened when Congress legalized hemp in the 2018 Farm Bill.\u00a0<\/span><\/p>\n<p><span>\u201cMy bill continues with Congress\u2019 intent from three months ago, and of course, our great folks of Missouri\u2019s intent,\u201d Gregory said, \u201cwhich is: if it is intoxicating from the cannabis plant, it is marijuana and must be highly regulated under these specific rules.\u201d\u00a0<\/span><\/p>\n<p><span>May has been a <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/04\/10\/intoxicating-hemp-regulations-stall-in-missouri-senate-after-7-hour-filibuster\/\"><span>consistent critic <\/span><\/a><span>of attempts to put a complete ban on intoxicating hemp products, arguing that they just need to be regulated.\u00a0<\/span><\/p>\n<p><span>May said the amendment she offered Wednesday to Gregory\u2019s bill was a \u201cgood compromise\u201d because it would still align state and federal rules if Congress rewrites the federal limits.\u00a0<\/span><\/p>\n<p><span>\u201cIt\u2019s not getting rid of your language,\u201d May told Gregory. \u201cAnd if (Congress does) nothing, your language will be the law of the land for Missouri.\u201d<\/span><\/p>\n<p><span>Gregory said her amendment went a \u201clittle too far\u201d for him because Missouri would just be doing \u201cwhatever the feds tell us.\u201d He said these products must be regulated urgently to protect children.<\/span><\/p>\n<p><span>After more than two hours of discussion, the Senate was forced to adjourn when it couldn\u2019t get enough lawmakers in the chamber to achieve a quorum.\u00a0<\/span><\/p>\n<p><span>State officials <\/span><a href=\"https:\/\/missouriindependent.com\/2024\/10\/03\/cost-to-enforce-ban-on-intoxicating-hemp-products-in-missouri-estimated-at-nearly-900k\/\"><span>estimated <\/span><\/a><span>in 2024 that 40,000 food establishments and smoke shops and 1,800 food manufacturers were selling products that would be banned under the proposed federal regulations. It includes low-dose THC seltzers, such as Mighty Kind and Triple, that have <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/10\/27\/thc-beverage-boom-faces-missouri-crackdown-amid-regulatory-concerns-safety-risks\/\"><span>increased in popularity<\/span><\/a><span> at liquor stores and bars.\u00a0<\/span><\/p>\n<p><span>May said lawmakers need to consider these businesses when making decisions.<\/span><\/p>\n<p><span>\u201cIt\u2019s a complicated situation,\u201d May said. \u201cAnd I think that we have to make sure that we don\u2019t have unintended consequences, and destroy things that do not need to be destroyed.\u201d<\/span><\/p>\n<figure class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-24111 size-full\" src=\"https:\/\/missouriindependent.com\/wp-content\/uploads\/2025\/02\/Triple-1-scaled.jpg\" alt=\"\" width=\"2560\" height=\"1920\" \/><figcaption class=\"wp-caption-text\"><em>State Rep. Dave Hinman, a Republican from O\u2019Fallon, toured the warehouse of St. Louis-based Triple High Seltzer, a hemp-derived THC beverage, on Feb. 7, 2025 with the company\u2019s founder Will Spartin (Rebecca Rivas\/Missouri Independent).<\/em><\/figcaption><\/figure>\n<p><span>Hinman told The Independent Thursday that he spent about 20 hours working on his bill this week so it hopefully wouldn\u2019t run into as many roadblocks as Gregory experienced in a full-chamber debate.<\/span><\/p>\n<p><span>\u201cThere\u2019s so many if\u2019s involved in this,\u201d Hinman said, \u201cand trying to legislate that is really difficult.\u201d<\/span><\/p>\n<p><span>There are three potential scenarios, he said, that could happen before November, when the federal limits are set to go into effect.\u00a0<\/span><\/p>\n<p><span>The feds could stay the course with the current limits, he said, which \u201cputs all of the hemp businesses out of business.\u201d Congress could redefine what hemp is, and change the .4 milligram of THC per container limit to permit low-dose THC beverages and edibles.\u00a0\u00a0<\/span><\/p>\n<p><span>\u201cSo in that case, we\u2019re looking to see what would happen if they just modify that piece of the puzzle,\u201d he said.\u00a0<\/span><\/p>\n<p><span>The third option is if Congress approves a two-year extension, he said, and \u201ckick it down the can.\u201d That would mean Missouri would need to put some kind of regulation in the meantime, he said.\u00a0<\/span><\/p>\n<p><span>\u201cWe\u2019re trying to write legislation that effectively would cover all three of those things,\u201d he said, \u201cSo that\u2019s what these tough negotiations are all about is trying to accomplish the goal of letting everyone succeed in this marketplace, if it\u2019s possible by federal law.\u201d<\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>Sen.
