Mark Kelly sued Defense Secretary Pete Hegseth and the department on Monday for trying to demote Kelly\u2019s retirement rank and pay after he appeared in a video where he and other lawmakers told service members they didn\u2019t need to follow illegal orders.\u00a0<\/p>\n<p dir=\"ltr\">Kelly\u2019s suit, filed in the federal district court for the District of Columbia, says attempts by the Trump administration to punish him violate the First Amendment, the separation of powers, due process protections and the Speech and Debate clause of the Constitution.<\/p>\n<p dir=\"ltr\">\u201cPete Hegseth is coming after what I earned through my twenty-five years of military service, in violation of my rights as an American, as a retired veteran, and as a United States Senator whose job is to hold him\u2014and this or any administration\u2014accountable,\u201d Kelly wrote in a statement. \u201cHis unconstitutional crusade against me sends a chilling message to every retired member of the military: if you speak out and say something that the President or Secretary of Defense doesn\u2019t like, you will be censured, threatened with demotion, or even prosecuted.\u201d<\/p>\n<p dir=\"ltr\">Kelly appeared in\u00a0<a href=\"https:\/\/x.com\/SenatorSlotkin\/status\/1990774492356902948\" target=\"_blank\">the video<\/a> alongside Michigan Sen. Elissa Slotkin, Colorado Rep. Jason Crow, Pennsylvania Reps. Chris Deluzio and Chrissy Houlahan and New Hampshire Rep. Maggie Goodlander \u2014 all of whom are former members of the military or intelligence agencies, though none of the others are still subject to the military\u2019s legal system.<\/p>\n<p dir=\"ltr\">President Donald Trump\u00a0<a href=\"https:\/\/www.newsfromthestates.com\/article\/trump-accuses-6-democratic-lawmakers-seditious-behavior-punishable-death\" target=\"_blank\">was irate<\/a> after seeing the video, posting on social media that he believed it represented \u201cSEDITIOUS BEHAVIOR, punishable by DEATH!\u201d<\/p>\n<h4>DOD investigation<\/h4>\n<p dir=\"ltr\">The Defense Department\u00a0<a href=\"https:\/\/www.newsfromthestates.com\/article\/pentagon-investigates-arizona-sen-mark-kelly-after-he-appears-video-blasted-trump\" target=\"_blank\">announced<\/a> in late November that it was looking into \u201cserious allegations of misconduct\u201d against Kelly, a retired Navy captain, for participating in the video.\u00a0<\/p>\n<p dir=\"ltr\">Kelly said\u00a0<a href=\"https:\/\/www.newsfromthestates.com\/article\/arizonas-kelly-vows-stay-outspoken-despite-threats-over-illegal-order-video\" target=\"_blank\">during a press conference<\/a> on Capitol Hill in December the Defense Department investigation into him, along with\u00a0<a href=\"https:\/\/www.newsfromthestates.com\/article\/democrats-threatened-trump-over-video-say-theyre-now-being-probed-fbi\" target=\"_blank\">one by the FBI<\/a> into all of the lawmakers in the video, marked \u201ca dangerous moment for the United States of America when the president and his loyalists use every lever of power to silence United States senators for speaking up.\u201d<\/p>\n<p dir=\"ltr\">Hegseth, who originally threatened to court-martial Kelly, said in early January the Defense Department would instead downgrade his retirement rank and pay.\u00a0<\/p>\n<p dir=\"ltr\">\u201cCaptain Kelly has been provided notice of the basis for this action and has thirty days to submit a response,\u201d Hegseth wrote in\u00a0<a href=\"https:\/\/x.com\/SecWar\/status\/2008189258528665898\" target=\"_blank\">a social media post<\/a>. \u201cThe retirement grade determination process directed by Secretary Hegseth will be completed within forty five days.\u201d<\/p>\n<p dir=\"ltr\">Kelly said at the time he would challenge Hegseth\u2019s course of action.\u00a0<\/p>\n<h4>First Amendment cited<\/h4>\n<p dir=\"ltr\">The\u00a0<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.288365\/gov.uscourts.dcd.288365.1.0_1.pdf\" target=\"_blank\">46-page lawsuit<\/a> marks the next step in the months-long saga, with Kelly asking a federal judge to declare the effort to demote him \u201cunlawful and unconstitutional.\u201d<\/p>\n<p dir=\"ltr\">\u201cThe First Amendment forbids the government and its officials from punishing disfavored expression or retaliating against protected speech,\u201d the lawsuit states. \u201cThat prohibition applies with particular force to legislators speaking on matters of public policy. As the Supreme Court held 60 years ago, the Constitution \u2018requires that legislators be given the widest latitude to express their views on issues of policy,\u2019 and the government may not recharacterize protected speech as supposed incitement in order to punish it.\u201d<\/p>\n<p dir=\"ltr\">The lawsuit alleges that the Pentagon\u2019s actions against Kelly \u201calso trample on protections the Constitution singles out as essential to legislative independence.\u201d\u00a0<\/p>\n<p dir=\"ltr\">\u201cIt appears that never in our nation\u2019s history has the Executive Branch imposed military sanctions on a Member of Congress for engaging in disfavored political speech,\u201d the lawsuit states. \u201dAllowing that unprecedented step here would invert the constitutional structure by subordinating the Legislative Branch to executive discipline and chilling congressional oversight of the armed forces.\u201d<\/p>\n<p dir=\"ltr\">Kelly\u2019s legal team\u00a0<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.288365\/gov.uscourts.dcd.288365.2.1.pdf\" target=\"_blank\">asked<\/a> the judge to grant \u201cemergency relief\u201d in their favor by Friday, Jan. 16.<\/p>\n<p dir=\"ltr\">The case was assigned to Senior Judge Richard J.
