WASHINGTON \u2014 A pair of blockbuster cases to be heard by the U.S. Supreme Court could carry far-reaching implications for transgender rights, even as the Trump administration during the past year has rolled out a broad anti-trans agenda targeting everything from sports to military service.<\/p>\n

The court on Jan. 13 will hear challenges to laws in\u00a0Idaho<\/a> and\u00a0West Virginia<\/a> banning transgender athletes from participating in women\u2019s sports. Both cases center on whether the laws violate the Equal Protection Clause of the 14th Amendment.<\/p>\n

The West Virginia case before the Supreme Court also questions whether the state\u2019s law violates Title IX \u2014 a landmark federal civil rights law that bars schools that receive federal funding from practicing sex-based discrimination.\u00a0<\/p>\n

Lower court rulings have temporarily blocked the states from implementing the bans, to varying extents, and Republican attorneys general in Idaho and West Virginia have asked the Supreme Court to intervene.\u00a0<\/p>\n

\u201cWe know we have an uphill fight, and our hope is certainly that we prevail,\u201d Joshua Block, senior counsel for the American Civil Liberties Union\u2019s LGBT & HIV Project, who will be presenting oral arguments in the West Virginia case, said at a Jan. 8 ACLU press briefing.\u00a0<\/p>\n

\u201cBut we also hope that regardless of what happens, this case isn\u2019t successfully used as a tool to undermine the rights of transgender folks more generally in areas far beyond just athletics.\u201d\u00a0<\/p>\n

The outcome of the oral arguments before a court dominated 6-3 by conservative justices will be closely watched. Nearly 30 states have laws that ban trans students\u2019 participation in sports consistent with their gender identity, according to the\u00a0Movement Advancement Project<\/a>, an independent think tank.<\/p>\n

Idaho case\u00a0\u00a0<\/h4>\n

The justices are taking up both cases in one day. First will be\u00a0Little v. Hecox,\u00a0<\/a>which contests a 2020 Idaho law that categorically bans trans athletes from competing on women\u2019s and girls\u2019 sports teams.\u00a0<\/p>\n

Lindsay Hecox sued over the ban in 2020, just months before the law was set to take effect.\u00a0<\/p>\n

Though Hecox wanted to try out for the women\u2019s track and cross-country teams at Boise State University, the Idaho law \u2014 the\u00a0first of its kind<\/a> in the nation \u2014 would have prevented her from doing so because she is transgender.\u00a0<\/p>\n

A federal court in Idaho halted the law from taking effect later that year. A federal appeals court initially upheld the ruling in 2023 but later adjusted the scope of it in 2024 to only apply to Hecox, not other athletes.\u00a0<\/p>\n

Idaho appealed to the Supreme Court in July 2024.<\/p>\n

Since that time, Hecox has asked both an Idaho federal court and the Supreme Court to drop the case.\u00a0<\/p>\n

An\u00a0Idaho federal judge<\/a> in October rejected that attempt, but the Supreme Court deferred the request until after oral argument \u2014 meaning justices could still dismiss the case.<\/p>\n

\u201cThe Supreme Court is trying to decide whether Idaho can preserve women\u2019s sports based on biological sex, or must female be redefined based on gender identity,\u201d Idaho Attorney General Ra\u00fal Labrador said at a Jan. 8 press briefing ahead of the oral arguments.<\/p>\n

\u201cI think Idaho is just trying to protect fairness, safety and equal protection for girls and women in sports,\u201d Labrador said at the briefing alongside West Virginia Attorney General John McCuskey, hosted by the conservative legal advocacy group Alliance Defending Freedom.\u00a0\u00a0<\/p>\n

West Virginia case<\/h4>\n

After the Idaho case, the justices will hear arguments in\u00a0West Virginia v. B.P.J.<\/a>, which centers on a 2021 Mountain State law that also bans trans athletes from participating on women\u2019s and girls\u2019 sports teams.\u00a0<\/p>\n

McCuskey argued that his state\u2019s law \u201csupports and bolsters the original intent and the continuing intent and purpose of Title IX.\u201d\u00a0<\/p>\n

McCuskey said the law complies with the Equal Protection Clause because it \u201ctreats all biological males and all biological females identically\u201d and \u201cdoesn\u2019t ban anyone from playing sports.\u201d\u00a0<\/p>\n

Becky Pepper-Jackson, who was 11 at the time, wanted to try out for the girls\u2019 cross-country team when starting middle school, but would have been prevented from doing so under the West Virginia law because she is transgender.\u00a0<\/p>\n

Her mother sued on her behalf in 2021.<\/p>\n

A federal appeals court in 2024 barred West Virginia from enforcing the ban, prompting the state to ask the nation\u2019s highest court to intervene.\u00a0\u00a0<\/p>\n

White House, Congress zero in on trans athletes<\/h4>\n

Meanwhile, President Donald Trump\u2019s administration has taken steps at the federal level to prohibit trans athletes\u2019 participation in women\u2019s sports teams aligning with their gender identity.\u00a0<\/p>\n

Trump\u00a0signed an executive order<\/a> in February 2025 that banned such participation and made it the\u00a0policy<\/a> of the United States to \u201crescind all funds from educational programs that deprive women and girls of fair athletic opportunities, which results in the endangerment, humiliation, and silencing of women and girls and deprives them of privacy.\u201d<\/p>\n

The\u00a0NCAA promptly changed its policy<\/a> to comply with the order, limiting \u201ccompetition in women\u2019s sports to student-athletes assigned female at birth only.\u201d\u00a0<\/p>\n

In late 2024, prior to the policy shift, NCAA President Charlie Baker\u00a0told Congress<\/a> that of the more than half-million total athletes in NCAA schools, he knew of fewer than 10 who were transgender.\u00a0<\/p>\n

The\u00a0GOP-led House<\/a> passed a measure in January 2025 that would bar transgender students from participating on women\u2019s school sports teams consistent with their gender identity.\u00a0<\/p>\n

But Senate Democrats in March\u00a0blocked an attempt<\/a> at imposing such a ban and codifying Trump\u2019s executive order.\u00a0<\/p>\n

Forty-eight GOP members of Congress argued in a September\u00a0amicus brief<\/a> supporting Idaho and West Virginia that \u201cif allowed to stand, the interpretation of the lower courts will unsettle the very promises that Congress made to generations of young women and men through Title IX.\u201d\u00a0<\/p>\n

On the flip side,\u00a0130 congressional Democrats<\/a> stood behind the two transgender athletes in a November amicus brief, noting that \u201ccategorical bans preventing transgender students from participating on sports teams consistent with their gender identity impose significant harm on all children \u2014 especially girls.\u201d\u00a0<\/p>\n

The group argued that such bans \u201cdo not meet the standards this Court has put in place to assess discrimination based on sex \u2014 whether as a matter of Title IX or under the Equal Protection Clause.\u201d\u00a0<\/p>\n

Trump\u2019s broader anti-trans agenda has extended beyond athletic participation in the nearly one year since he took office.\u00a0<\/p>\n

He signed executive orders that:\u00a0make it<\/a> the \u201cpolicy of the United States to recognize two sexes, male and female;\u201d restrict access to\u00a0gender-affirming care<\/a> for kids; and aim to bar openly\u00a0transgender service members<\/a> from the U.S. military.\u00a0<\/p>\n

\u2018Textbook discrimination\u2019\u00a0<\/h4>\n

The\u00a0Human Rights Campaign<\/a>, an LGBTQ+ advocacy group, has noted that there has been \u201cconsiderable disinformation and misinformation about what the inclusion of transgender youth in sports entails\u201d and that trans students\u2019 sports participation \u201chas been a non-issue.\u201d<\/p>\n

In a\u00a0statement<\/a> ahead of oral arguments, HRC\u2019s senior director of legal policy Cathryn Oakley said \u201cevery child, no matter their background, race, or gender, should have access to a quality education where they can feel safe to learn and grow \u2014 and for many kids that involves being a part of a school sports team.\u201d<\/p>\n

Oakley added that \u201cto deny transgender kids the chance to participate in school sports alongside their peers simply because of who they are is textbook discrimination \u2014 and it\u2019s unconstitutional.\u201d\u00a0<\/p>","protected":false},"excerpt":{"rendered":"
