Klein was joined at the news conference by, from left, John Lyman, president of the Columbia Board of Education, Erica Dickson and Suzette Waters, board members (Rudi Keller\/Missouri Independent).<\/p>\n<p><span style=\"font-weight: 400\">Missouri\u2019s fourth-largest school district <\/span><a href=\"https:\/\/www.courts.mo.gov\/fv\/c\/Plaintiffs%20Verified%20Petition%20for%20Declaratory%20Judgment%20and%20Injunctive%20Relief.PDF?courtCode=19&amp;di=3751075\" target=\"_blank\"><span style=\"font-weight: 400\">sued the state<\/span><\/a><span style=\"font-weight: 400\"> Monday to prevent establishment of a new charter school in Boone County.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Columbia Public Schools wants the courts to declare <\/span><a href=\"https:\/\/missouriindependent.com\/2024\/04\/18\/missouri-house-narrowly-sends-private-school-tax-credit-charter-expansion-to-governors-desk\/\"><span style=\"font-weight: 400\">a law passed in 2024<\/span><\/a><span style=\"font-weight: 400\"> unconstitutional, arguing that it is a local law for one county masquerading as a general law for the entire state.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The district waited to file the lawsuit until <\/span><a href=\"https:\/\/www.frontierschools.org\/\" target=\"_blank\"><span style=\"font-weight: 400\">Frontier Schools<\/span><\/a><span style=\"font-weight: 400\">, a Kansas City-based charter operator, <\/span><a href=\"https:\/\/www.columbiamissourian.com\/news\/k12_education\/a-second-charter-school-applies-to-open-to-columbia-this-one-with-a-stem-focus\/article_7932a4d9-05b3-4ff6-a74f-c302a205e11e.html\" target=\"_blank\"><span style=\"font-weight: 400\">applied to the State Board of Education<\/span><\/a><span style=\"font-weight: 400\"> because it represents a threat to the district\u2019s financial health, district leaders said at a news conference.<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cThese actions are about protecting constitutional principles and ensuring the public education decisions in Boone County are made by people who are accountable to the voters and the families that live here,\u201d said John Lyman, president of the Columbia Board of Education.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The district alleges that the law allowing a charter school in Boone County was passed without the proper notification <\/span><a href=\"https:\/\/revisor.mo.gov\/main\/OneSection.aspx?section=III++++42&amp;bid=31798&amp;constit=y\" target=\"_blank\"><span style=\"font-weight: 400\">required by the Missouri Constitution<\/span><\/a><span style=\"font-weight: 400\"> for \u201clocal or special laws.\u201d In addition to overturning the law, the lawsuit asks the court to prevent the state board from voting on the application while the lawsuit is pending.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In a message to parents explaining why the district filed the lawsuit, the board insisted it did not oppose the concept of school choice for parents.<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cParents can choose now to send their children to a private or parochial school, and there are scholarships for families in need,\u201d the message stated. \u201cPublic education exists to serve all children and charters simply do not.\u201d<\/span><\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"mibXsnyrrB\">\n<p><a href=\"https:\/\/missouriindependent.com\/2024\/04\/01\/caleb-rowden-pushes-for-charter-schools-in-his-county-over-objections-from-local-districts\/\">Caleb Rowden pushes for charter schools in his county over objections from local districts<\/a><\/p>\n<\/blockquote>\n<p><iframe loading=\"lazy\" src=\"https:\/\/missouriindependent.com\/2024\/04\/01\/caleb-rowden-pushes-for-charter-schools-in-his-county-over-objections-from-local-districts\/embed\/#?secret=202ToJFI0v#?secret=mibXsnyrrB\" data-secret=\"mibXsnyrrB\" width=\"500\" height=\"282\" frameborder=\"0\"><\/iframe><\/p>\n<p><span style=\"font-weight: 400\">Along with suing to overturn the law, the district sent a letter signed by all seven local board members to the state board asking them to reject the Frontier application.<\/span><\/p>\n<p><span style=\"font-weight: 400\">To open in the fall of 2026, Frontier would require approval of its application by Jan. 31. The board is scheduled to meet Jan. 14 and 15, but no agenda has been posted.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">If the Jan. 31 deadline is missed, Frontier will aim to open in 2027, spokeswoman Jennifer Gray said in an email to The Independent.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The timing for board consideration is uncertain because the application is under review, said Lucas Bond, spokesman for the Department of Elementary and Secondary Education.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Bond declined to comment on the lawsuit.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Prior to 2024, state law <\/span><a href=\"https:\/\/revisor.mo.gov\/main\/OneSection.aspx?section=160.400&amp;bid=54611&amp;hl=\" target=\"_blank\"><span style=\"font-weight: 400\">allowed charter schools<\/span><\/a><span style=\"font-weight: 400\"> in Kansas City, St. Louis, unaccredited districts and by sponsorship of the local school board.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The 2024 law made no reference to the need to address educational, administrative or statewide needs by allowing charters to open Boone County, the lawsuit states. Instead, it is an unconstitutional local law, it states, because it uses a population definition for the county \u2014 more than 150,000 people and fewer than 200,000 \u2014 to say where charters would be allowed.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The Constitution says no such law can be passed <\/span><a href=\"https:\/\/revisor.mo.gov\/main\/OneSection.aspx?section=III++++42&amp;bid=31798&amp;constit=y\" target=\"_blank\"><span style=\"font-weight: 400\">without published notice<\/span><\/a><span style=\"font-weight: 400\"> 30 days before it is filed, the lawsuit alleges.<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cThe state cannot avoid these constitutional obligations by disguising a one-county law behind a pretextual temporary population bracket,\u201d the lawsuit states.<\/span><\/p>\n<figure id=\"attachment_20251\" class=\"wp-caption alignnone\" style=\"max-width:100%;width:1630px\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-20251\" src=\"https:\/\/missouriindependent.com\/wp-content\/uploads\/2024\/05\/051724_rowden1-300x200.jpg\" alt=\"\" width=\"1630\" height=\"1086\" \/><figcaption class=\"wp-caption-text\">Then-Senate President Pro Tem Caleb Rowden, R-Columbia, sponsored the law allowing a charter school in Boone County. (Annelise Hanshaw\/Missouri Independent)<\/figcaption><\/figure>\n<p><span style=\"font-weight: 400\">The Senate\u2019s top leader in 2024, then-President Pro Tem Caleb Rowden, a Columbia Republican, inserted the provision in a wide-ranging education bill over <\/span><a href=\"https:\/\/missouriindependent.com\/2024\/04\/01\/caleb-rowden-pushes-for-charter-schools-in-his-county-over-objections-from-local-districts\/\"><span style=\"font-weight: 400\">objections of local education leaders<\/span><\/a><span style=\"font-weight: 400\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">State Sen. Stephen Webber, a Columbia Democrat who succeeded Rowden in the district, has, for the second year, filed a bill to <\/span><a href=\"https:\/\/www.senate.mo.gov\/26Info\/BTS_Web\/Bill.aspx?SessionType=R&amp;BillID=549\" target=\"_blank\"><span style=\"font-weight: 400\">repeal the charter law<\/span><\/a> <span style=\"font-weight: 400\">provision for Boone County.<\/span><\/p>\n<p><span style=\"font-weight: 400\">There are two charter schools under discussion for Boone County but only Frontier has submitted an application. Frontier, which operates four schools in Kansas City, is asking the state board to approve an elementary charter school focused on science, technology, engineering and math, or STEM, education.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The application anticipates enrolling 184 students in grades pre-K through second grade in its first year, growing to 584 and educating students through the fifth grade by the fifth year of operation.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The application states that the demand for the school is based on the evidence of interest found in \u201cnational and regional research.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">For Columbia, \u201cthe combination of population growth, rising early childhood enrollment, and limited STEM-intensive options in the public elementary system creates a strong market.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">The district already operates <\/span><a href=\"https:\/\/resources.finalsite.net\/images\/v1707858780\/cpsk12org\/phqcf8xg4b4fzd8wshrr\/Fall2020STEMBrochure.pdf\" target=\"_blank\"><span style=\"font-weight: 400\">one STEM-focused elementary school<\/span><\/a><span style=\"font-weight: 400\">, with an enrollment of about 220, and provides several STEM enrichment programs including the Boone County Nature School operated in partnership with the Missouri Department of Conservation.<\/span><\/p>\n<p><span style=\"font-weight: 400\">With 18,034 students, Columbia is behind only Springfield, North Kansas City and Rockwood School District in St. Louis County in total enrollment.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">In the letter to the state board, Columbia board members targeted what they say is evidence of a cut-and-paste approach for stating the achievement goals of the proposed school. Frontier\u2019s application states that \u201cthe Performance Contract (with sponsor St. Louis University) requires that academic goals meet or exceed the aggregated pupil performance of Kansas City Public Schools.\u201d<\/span><\/p>\n<figure id=\"attachment_7803\" class=\"wp-caption alignnone\" style=\"max-width:100%;width:1616px\"><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-7803\" src=\"https:\/\/missouriindependent.com\/wp-content\/uploads\/2021\/08\/Benton-Elementary-first-day-08242021-1-300x198.jpeg\" alt=\"Two yellow school buses are show in bright sunshine outside a two-story brick school building in Columbia, Missouri.\" width=\"1616\" height=\"1066\" \/><figcaption class=\"wp-caption-text\"><em>School buses wait in 2021 outside Thomas Hart Benton Elementary, Columbia\u2019s STEM magnet school (Rudi Keller\/Missouri Independent).<\/em><\/figcaption><\/figure>\n<p><span style=\"font-weight: 400\">That shows Frontier is a franchise education program seeking to syphon state and local tax money away from public schools, board member Suzette Waters said at the news conference.<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cWe do not believe our community is interested in a fast-food-style education for our children,\u201d Waters said. \u201cTruly the best way to know if there is public interest in a charter school in Boone County is to let citizens vote on it.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">Columbia Superintendent Jeff Klein said the charter, if approved, would divert about $4 million of state and local tax money away from the district in the first year and $9 million a year if it meets enrollment goals. The district has a $433 million annual budget, but the reduction in student numbers would not be concentrated, so costs would not change.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Frontier has done no community meetings to measure support and shown no reason why the district is not performing, Klein said.<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cOur district already provides quality, choice, innovation and proven outcomes within a system that is fully accredited, fiscally responsible and deeply connected to its community,\u201d he said.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Frontier defended its application, and the need for its school in Columbia, in written responses to questions from The Independent.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The school would comply with state law on its attendance area, support students with special education needs and contribute to educating Columbia\u2019s growing population, the answers stated.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Community meetings will be held after the application is approved to explain the program and attract enrollment, Frontier stated.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cFrontier would engage more directly with families, community members, and local stakeholders to share detailed information about the school and to better understand community interest and needs,\u201d the statement read.<\/span><\/p>\n<p><span style=\"font-weight: 400\">A community youth training and employment organization, Job Point, was the first to announce plans for a <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/10\/09\/first-missouri-charter-school-outside-kansas-city-st-louis-metros-will-focus-on-workforce-training\/\"><span style=\"font-weight: 400\">charter school in Columbia<\/span><\/a><span style=\"font-weight: 400\"> but the organization has not followed through with a formal application.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The district has consulted with Job Point on how its program can work with the district, Klein said.
