(Photo by David Becker\/Getty Images)<\/p>\n<p dir=\"ltr\">WASHINGTON \u2014 The U.S. Supreme Court appeared ready to expand presidential power after hearing a case Monday on whether President Donald Trump can hire and fire members of independent federal agencies without cause.<\/p>\n<p dir=\"ltr\">The high court\u2019s decision, expected by the end of the term in late June, could heighten presidential influence over agencies created by Congress that oversee monetary policy, nuclear safety, consumer advocacy and trade, among other major policy areas.<\/p>\n<p dir=\"ltr\">The court\u2019s conservative supermajority speculated that Congress could wield more and more power over the executive branch regarding how independent multimember agencies are structured, for example establishing term limits for commissioners.<\/p>\n<p dir=\"ltr\">Oral arguments centered on a 90-year-old Supreme Court precedent protecting the five-member panel atop the Federal Trade Commission from being fired for reasons other than \u201cinefficiency, neglect of duty, or malfeasance.\u201d\u00a0<\/p>\n<p dir=\"ltr\">The 1935\u00a0<a href=\"https:\/\/tile.loc.gov\/storage-services\/service\/ll\/usrep\/usrep295\/usrep295602\/usrep295602.pdf\" target=\"_blank\">decision<\/a>, referred to by its short title Humphrey\u2019s executor, upheld the Federal Trade Commission Act\u2019s removal protection provision after President Franklin D. Roosevelt fired FTC Commissioner William Humphrey before his seven-year term ended. He died shortly after, and his executor sued and won.<\/p>\n<h4>Slaughter fired in March<\/h4>\n<p dir=\"ltr\">Monday\u2019s case stems from Trump\u2019s March firing of Rebecca Slaughter, an FTC commissioner since 2018, when she was named during Trump\u2019s first term. President Joe Biden reappointed her and the Senate unanimously confirmed her for a second term in 2023.<\/p>\n<p dir=\"ltr\">Trump fired Slaughter on March 28 in an email that said her \u201ccontinued service on the FTC is inconsistent with my administration\u2019s priorities.\u201d Slaughter sued and won in federal district court and at the Court of Appeals for the D.C. Circuit.<\/p>\n<p dir=\"ltr\">U.S. Solicitor General John Sauer argued to the justices Monday that Congress is \u201cshaving away from the president\u2019s control.\u201d<\/p>\n<p dir=\"ltr\">The conservative justices homed in on Sauer\u2019s argument.<\/p>\n<p dir=\"ltr\">In an exchange between Justice Amy Coney Barrett and Slaughter\u2019s counsel, Amit Agarwal, Barrett said, \u201cIf we decide this case in your favor, we don\u2019t know what a Congress in 15 or 20 or 30 years might do.\u201d<\/p>\n<p dir=\"ltr\">Agarwal responded, \u201cWe haven\u2019t seen this problem materializing at all.\u201d<\/p>\n<p dir=\"ltr\">\u201cThe real world danger that is imminent right now, that we know will happen, and that is that if petitioners get their way, everything is on the chopping block,\u201d he said.<\/p>\n<p dir=\"ltr\">A few minutes later, Justice Brett Kavanaugh challenged Agarwal\u2019s argument that if the president wants a structural change to an independent agency, he or she can work with Congress.<\/p>\n<p dir=\"ltr\">\u201cYou\u2019ve mentioned many times, you can just go to Congress to fix this. Well, once the power is taken away from the president, it\u2019s very hard to get it back in the legislative process,\u201d Kavanaugh said.<\/p>\n<p dir=\"ltr\">Agarwal disagreed and argued that \u201cexactly the opposite\u201d has happened, in that Congress has ceded power to the executive branch over time.<\/p>\n<h4>Debate over stability in agencies<\/h4>\n<p dir=\"ltr\">Kavanaugh also took issue with Agarwal\u2019s argument that statutory guardrails baked into laws that govern independent agencies provide stability across administrations.<\/p>\n<p dir=\"ltr\">Agarwal pressed back, calling it \u201ca problem on steroids\u201d if independent agencies were completely shaken up every time a presidential administration changes and staggered terms were ignored.<\/p>\n<p dir=\"ltr\">\u201cThe whole point of this structure is to guarantee a modicum of stability that private, regulated entities can depend upon, and that is jeopardized by at-will presidential removal,\u201d Agarwal said.<\/p>\n<p dir=\"ltr\">Justice Ketanji Brown Jackson, one of three liberal justices, said the administration\u2019s appeal to justices could \u201copen the door for the president to come in, each new president, and clean house in terms of all of the individuals who are running that agency.\u201d<\/p>\n<p dir=\"ltr\">\u201cNotwithstanding their expertise and knowledge and experience and the things that they are doing to promote the mission of the agency,\u201d Jackson said. \u201cAnd presumably the president could install whoever he wanted in those positions.\u201d<\/p>\n<p dir=\"ltr\">Argawal responded: \u201cThink about it in terms of commissions like the Federal Elections Commission. Would anyone want those sensitive election-related determinations to be under the plenary control of a political actor?\u00a0<\/p>\n<p dir=\"ltr\">\u201cThink about the Nuclear Regulatory Commission. Can\u2019t Congress and the president come together and say those types of technical determinations that could have massive implications for the public in all kinds of ways, should be made by a multimember body of experts?\u201d he continued.<\/p>\n<p dir=\"ltr\">But during his rebuttal, Sauer warned of a scenario where \u201cCongress could reconstruct virtually the entire executive branch outside the president\u2019s control.\u201d<\/p>\n<h4>Fed firing up next<\/h4>\n<p dir=\"ltr\">The arguments lasted two-and-a-half hours and could be a preview of oral arguments in January that will center on Trump\u2019s\u00a0<a href=\"https:\/\/www.newsfromthestates.com\/article\/fed-member-lisa-cook-remain-board-while-her-case-decided-us-supreme-court\" target=\"_blank\">firing of Federal Reserve Board governor Lisa Cook<\/a>.<\/p>\n<p dir=\"ltr\">The seven-member board governing the central bank sets U.S. policy, including interest rates. Trump has slammed Federal Reserve leadership for months for not lowering interest rates at a faster pace.<\/p>\n<p dir=\"ltr\">The case comes on the heels of a federal appeals court\u00a0<a href=\"https:\/\/ecf.cadc.uscourts.gov\/n\/beam\/servlet\/TransportRoom?servlet=ShowDoc&amp;pacer=i&amp;caseId=41816&amp;dls_id=01208802438\" target=\"_blank\">decision<\/a> Friday that Trump \u201cpermissibly removed\u201d members earlier this year from the National Labor Relations Board and the Merit Systems Protection Board.<\/p>\n<p dir=\"ltr\">The FTC was established in 1914 under President Woodrow Wilson to protect consumers from unfair business practices.<\/p>\n<p dir=\"ltr\">Sauer, formerly the Missouri solicitor general, was previously the president\u2019s own defense lawyer and\u00a0<a href=\"https:\/\/www.newsfromthestates.com\/article\/us-supreme-court-floats-return-trial-court-trump-presidential-immunity-case\" target=\"_blank\">argued<\/a> on Trump\u2019s behalf before the Supreme Court last year on the question of presidential\u00a0<a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-939_e2pg.pdf\" target=\"_blank\">immunity<\/a>.\u00a0<\/p>","protected":false},"excerpt":{"rendered":"<p>Federal Trade Commissioner Rebecca Slaughter participates in a privacy roundtable at CES 2020 at the Las Vegas Convention Center on Jan. 7, 2020 in Las Vegas, Nevada.
