{"id":7919,"date":"2025-12-04T11:56:02","date_gmt":"2025-12-04T17:56:02","guid":{"rendered":"https:\/\/westplexnews.com\/index.php\/2025\/12\/04\/missouri-appeals-court-rewrites-ballot-proposal-to-clarify-a-yes-would-end-right-to-abortion-2\/"},"modified":"2025-12-04T11:56:02","modified_gmt":"2025-12-04T17:56:02","slug":"missouri-appeals-court-rewrites-ballot-proposal-to-clarify-a-yes-would-end-right-to-abortion-2","status":"publish","type":"post","link":"https:\/\/westplexnews.com\/index.php\/2025\/12\/04\/missouri-appeals-court-rewrites-ballot-proposal-to-clarify-a-yes-would-end-right-to-abortion-2\/","title":{"rendered":"Missouri appeals court rewrites ballot proposal to clarify a \u2018yes\u2019 would end right to abortion"},"content":{"rendered":"<p><img decoding=\"async\" width=\"1024\" height=\"615\" src=\"https:\/\/missouriindependent.com\/wp-content\/uploads\/2024\/05\/IMG_0034-1024x615.jpg\" class=\"attachment-large size-large wp-post-image\" alt=\"\" loading=\"lazy\" \/><\/p>\n<p>Students hold up anti-abortion signs at the Midwest March for Life on May 1, 2024, at the Missouri State Capitol (Anna Spoerre\/Missouri Independent).<\/p>\n<p><span>A Missouri appeals court rewrote the language for a proposed abortion ban set to appear on the November 2026 ballot after the judges concluded Thursday the previous wording drafted by Republican Secretary of State Denny Hoskins <a href=\"https:\/\/missouriindependent.com\/2025\/12\/03\/missouri-appeals-court-arguments-abortion-ban-ballot-measure\/\">was riddled with errors.<\/a><\/span><\/p>\n<p><span>The judges found both the ballot language and the summary statement that will be posted at polling places \u201cfail to sufficiently advise voters\u201d that the proposed amendment would repeal and replace the reproductive rights amendment voters passed in November 2024 to legalize abortion.\u00a0<\/span><\/p>\n<p><span><a href=\"https:\/\/www.courts.mo.gov\/fv\/c\/Opinion.PDF?courtCode=WA&amp;di=506254\" target=\"_blank\">The new ballot language<\/a> certified by the Missouri Court of Appeals reads:\u00a0<\/span><\/p>\n<p><span>\u201cShall the Missouri Constitution be amended to:<\/span><\/p>\n<ul>\n<li><span>Repeal the 2024 voter-approved Amendment providing reproductive healthcare rights, including abortion through fetal viability;<\/span><\/li>\n<li><span>Allow abortions for rape and incest (under twelve-weeks\u2019 gestation), emergencies, and fetal anomalies;<\/span><\/li>\n<li><span>Allow legislation regulating abortion;<\/span><\/li>\n<li><span>Ensure parental consent for minors\u2019 abortions;<\/span><\/li>\n<li><span>Prohibit gender transition procedures for minors?\u201d<\/span><\/li>\n<\/ul>\n<p><span>Western District Court of Appeals Presiding Judge W. Douglas Thomson and judges Thomas Chapman and Janet Sutton filed the opinion less than 24 hours after hearing arguments in their courtroom Wednesday afternoon.<\/span><\/p>\n<p><span>Hoskins\u2019 now-rejected ballot language, in-part, asked if voters wanted to: \u201cRepeal Article I, section 36, approved in 2024; allow abortions for medical emergencies, fetal anomalies, rape, and incest.\u2019\u201d<\/span><\/p>\n<p><span>Attorneys for Dr. Anna Fitz-James, who filed the lawsuit, picked this statement apart, scrutinizing the assumption that voters would know what \u201cArticle 1, section 3 of the constitution is, the exclusion of the 12-week gestation limit for survivors, as well as the misuse of a semi-colon, which could be interpreted to mean citizens would be newly gaining these abortion rights.<\/span><\/p>\n<p><span>The appeals court agreed with them on all three counts.<\/span><\/p>\n<p><span>The judges also re-wrote Hoskins\u2019 initial ballot language that asked if voters wanted to: \u201cGuarantee women\u2019s medical care for emergencies, ectopic pregnancies and miscarriages.\u201d<\/span><\/p>\n<p><span>The appeals court found that wording to be \u201cmisleading,\u201d because while the proposed amendment would prevent the state from interfering with an individual\u2019s ability to access such care, it \u201cdoes not guarantee the care itself.\u201d<\/span><\/p>\n<p>\u201cWith bills filed already threatening prosecution against providers and patients, it is crucial that Missourians know they are being asked to end the protections for reproductive health care that we just passed in the last general election,\u201d Tori Schafer, director of policy and campaigns for the ACLU of Missouri, and an attorney for Fitz-James, said in a statement Thursday.<\/p>\n<p><span>Fitz-James also argued the proposed amendment violates a <\/span><a href=\"https:\/\/revisor.mo.gov\/main\/OneSection.aspx?section=III+++50&amp;constit=y\" target=\"_blank\"><span>statute<\/span><\/a><span> that prevents ballot measures from encompassing more than one subject. She argued that gender-affirming care is a different subject from reproductive health care.<\/span><\/p>\n<p><span>The appeals judges agreed with the lower court\u2019s assessment that the proposed amendment \u201cpasses constitutional muster\u201d and does not violate the single subject rule.\u00a0<\/span><\/p>\n<p><span>\u201cBecause gender transition surgeries or hormone therapies may affect the ability to reproduce, gender transition surgeries and hormone therapies may be connected with, or incident to, reproductive health care,\u201d the judges wrote.\u00a0<\/span><\/p>\n<p>Missouri Attorney General Catherine Hanaway in a statement Thursday evening said she disagreed with the court rewriting the language, adding \u201cthere was no legitimate reason to displace it.\u201d But she called the decision to keep the measure on the ballot a \u201cdecisive victory.\u201d<\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"ibF0Y2rJyQ\">\n<p><a href=\"https:\/\/missouriindependent.com\/2025\/11\/20\/missouri-challenges-fda-approval-generic-mifepristone-limit-medication-abortion\/\">Missouri challenges FDA approval of new generic mifepristone in push to limit abortion<\/a><\/p>\n<\/blockquote>\n<p><span>Abortion rights groups have accused lawmakers of including the ban to win over more voters. Gender-affirming health care for minors is <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/10\/15\/how-missouri-became-a-battleground-over-gender-affirming-care\/\"><span>currently banned in Missouri,<\/span><\/a><span> though a challenge to the law is before the <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/09\/24\/ruling-upholding-missouri-transgender-care-ban-had-factual-errors-attorneys-argue\/\"><span>state supreme court.\u00a0<\/span><\/a><\/p>\n<p><span>But they disagreed with how Hoskins worded this part of the language, which initially asked if voters wanted to \u201cprohibit sex-change procedures for children.\u201d The judges said this wording incorrectly attempted to use the words \u201cgender\u201d and \u201csex\u201d interchangeably.\u00a0<\/span><\/p>\n<p><span>The court also re-wrote the ballot summary to reflect the new ballot language.\u00a0<\/span><\/p>\n<p><span>A new law passed this year allows the secretary of state three attempts to write fair ballot language. Hoskins has so far used two, but the appeals court ruled Thursday that he wouldn\u2019t be given his third try at the wording.<\/span><\/p>\n<p><span>The latest decision could be appealed to the Missouri Supreme Court.\u00a0<\/span><\/p>\n<p><span>The proposed constitutional amendment was drafted and approved by Missouri\u2019s Republican supermajority in May. A lawsuit over the initial ballot language, which failed to state the amendment would ban abortion, was filed in July by Fitz-James. Fitz-James, who submitted the language for the reproductive rights initiative petition, said the latest amendment was intentionally deceptive.\u00a0<\/span><\/p>\n<p><span>While abortion up until the point of fetal viability is a constitutional right in Missouri because of\u00a0 the abortion rights amendment voters approved, only several dozen abortions have occurred as legal battles over abortion regulations that remain in state statute play out in the courts.\u00a0<\/span><\/p>\n<p><em>This story was updated at 12:15 p.m. to include a statement from Tori Schafer of the ACLU of Missouri.
