People can buy 7-OH products in Missouri smoke shops, gas stations, convenience stores and online shops.\u00a0<\/span><\/p>\n<p><span>Hanaway on Thursday announced her office had issued \u201ccivil investigative demand\u201d letters, which are essentially subpoenas, to six companies that represent the \u201cmajor points of sale\u201d for both 7-OH and regular kratom products. The letters mandate the company to hand over multiple types of documents, including lab test results, research on health risks and safety label information.<\/span><\/p>\n<p><span>Consumers, Hanaway said in a press release, \u201cmay be exposed to unapproved, unsafe and deceptively marketed opioid-like drugs.\u201d<\/span><\/p>\n<p><span>According to the letters sent to each company, the attorney general\u2019s investigation targets the distribution of products containing 7-OH or \u201cany part of the plant Mitragyna speciosa,\u201d which is the kratom plant.<\/span><\/p>\n<p><span>\u201cWe are deeply concerned,\u201d she said, \u201cthat Missourians are being sold drug-like substances under the guise of harmless supplements, with no FDA approval, no safety testing, and in some cases no meaningful disclosure of what these products actually contain.\u201d\u00a0<\/span><\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"RE2KjRaeCO\">\n<p><a href=\"https:\/\/missouriindependent.com\/briefs\/missouri-warns-consumers-of-health-risks-associated-with-7-oh-products\/\">Missouri warns consumers of health risks associated with 7-OH products<\/a><\/p>\n<\/blockquote>\n<p><span>The Missouri Department of Health and Senior Services issued a <\/span><a href=\"https:\/\/missouriindependent.com\/briefs\/missouri-warns-consumers-of-health-risks-associated-with-7-oh-products\/\"><span>health advisory last month<\/span><\/a><span> warning consumers of potential health risks it says are associated with 7-OH.\u00a0<\/span><\/p>\n<p><span>The U.S. Food and Drug Administration sent <\/span><a href=\"https:\/\/www.fda.gov\/inspections-compliance-enforcement-and-criminal-investigations\/warning-letters\/shaman-botanicals-llc-709622-06252025\" target=\"_blank\"><span>warning letters<\/span><\/a><span> in June to six manufacturers of 7-OH, and federal action is still pending. The companies the FDA targeted are different from the ones Hanaway is investigating, except for one.<\/span><\/p>\n<p><span>Kansas-City-based <\/span><a href=\"https:\/\/ago.mo.gov\/wp-content\/uploads\/11-20-2025-Kratom-CID-to-Shaman-Botanicals.pdf\" target=\"_blank\"><span>Shaman Botanicals LLC<\/span><\/a><span> \u2014 the leading supplier of 7-OH in Missouri \u2014 received letters from both the FDA and Hanaway.<\/span><\/p>\n<p><span>The company\u2019s owner, Vince Sanders, has said Shaman was the first company to make 7-OH products.\u00a0<\/span><\/p>\n<p><span>Sanders replied to the FDA\u2019s questions about the company\u2019s products in August, told The Independent Friday, and has not yet heard back from the federal agency. The FDA warning has not stopped the company\u2019s production, which he said is higher than ever.<\/span><\/p>\n<p><span>The company\u2019s response to the FDA warning letter included 300 pages of expert testimony and 200 pages of legal opinion, he said.<\/span><\/p>\n<p><span>\u201cI\u2019ve got seven of the world\u2019s experts on there that wrote letters that are saying, \u2018Listen, you guys are completely wrong. Here\u2019s the science, here\u2019s the facts,\u2019\u201d Sanders said.<\/span><\/p>\n<p><span>He plans on providing the same information to Hanaway, he said. Sanders\u2019 other Kansas City company, <\/span><a href=\"https:\/\/ago.us20.list-manage.com\/track\/click?u=55bd24fd8f5e7d3dc227d1072&amp;id=d2a936d56c&amp;e=30e5a67b68\" target=\"_blank\"><span>CBD American Shaman LLC<\/span><\/a><span>, also received a letter from Hanaway.<\/span><\/p>\n<p><a href=\"https:\/\/ago.mo.gov\/wp-content\/uploads\/11-20-2025-Kratom-CID-to-CBD-Kratom.pdf\" target=\"_blank\"><span>CBD Kratom<\/span><\/a><span>, the largest kratom retailer in the country, was also among the recipients, along with St. Louis-area companies <\/span><a href=\"https:\/\/ago.mo.gov\/wp-content\/uploads\/11-20-2025-Kratom-CID-to-Green-Dragon.pdf\" target=\"_blank\"><span>Green Dragon CBD<\/span><\/a><span>, <\/span><a href=\"https:\/\/ago.us20.list-manage.com\/track\/click?u=55bd24fd8f5e7d3dc227d1072&amp;id=afeae29bb2&amp;e=30e5a67b68\" target=\"_blank\"><span>Emporium Smoke Shop<\/span><\/a><span> and <\/span><a href=\"https:\/\/ago.us20.list-manage.com\/track\/click?u=55bd24fd8f5e7d3dc227d1072&amp;id=adc903abfd&amp;e=30e5a67b68\" target=\"_blank\"><span>Moonlight Smoke Shop<\/span><\/a><span>.\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/www.documentcloud.org\/documents\/26293837-cbd-kratom-statement\/\" target=\"_blank\"><span>CBD Kratom issued a statement <\/span><\/a><span>Friday saying the company plans on taking the attorney general\u2019s process seriously and \u201cwelcome any opportunity to demonstrate the strength of our safety standards, compliance practices, and long-standing commitment to consumer education.\u201d\u00a0<\/span><\/p>\n<p><span>CBD Kratom does not manufacture or sell 7-OH products, according to the company\u2019s statement, and its leaders believe the investigation\u2019s scope is \u201cunusually broad.\u201d\u00a0<\/span><\/p>\n<p><span>The company pointed to the <\/span><a href=\"https:\/\/www.fda.gov\/news-events\/press-announcements\/fda-takes-steps-restrict-7-oh-opioid-products-threatening-american-consumers\" target=\"_blank\"><span>FDA<\/span><\/a><span>\u2019s distinction this summer between natural kratom and 7-OH.\u00a0<\/span><\/p>\n<p><span>In a July press release announcing the FDA\u2019s warning letters, the agency stated: \u201cWhile 7-OH occurs naturally in trace amounts in <\/span><a href=\"https:\/\/www.fda.gov\/news-events\/public-health-focus\/fda-and-kratom\" target=\"_blank\"><span>kratom<\/span><\/a><span>, the agency\u2019s letters focus on concentrated 7-OH products such as tablets, gummies, drink mixes, and shots, which may be dangerous.\u201d<\/span><\/p>\n<p><span>Kratom leaves come from a tropical tree found in Southeast Asia, and they can be crushed and then smoked, brewed with tea, or placed into gel capsules.<\/span><\/p>\n<p><span>The leaves contain an alkaloid called mitragynine. During digestion, the body converts it into 7-OH in small amounts. It\u2019s what gives people the opioid-like effect.<\/span><\/p>\n<p><span>The products the FDA is targeting contain a highly concentrated amount of 7-OH by taking mitragynine and chemically oxidizing it.\u00a0<\/span><\/p>\n<p><span>The way that 7-OH is being marketed as kratom is what has the FDA and some <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/07\/16\/fda-warns-kansas-city-manufacturer-of-illegal-marketing-pain-relieving-pills\/\"><span>medical experts concerned<\/span><\/a><span>.\u00a0<\/span><\/p>\n<p><span>Sanders argues his product is superior to most kratom products and shouldn\u2019t be taken off the market.\u00a0<\/span><\/p>\n<p><span>\u201cWe clearly have a better product,\u201d he said. \u201cConsumers voted with their dollar.\u201d<\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>Catherine Hanaway talks to reporters on Aug. 19 after being announced as the state&#8217;s next attorney general (Jason Hancock\/Missouri Independent).
