(krisanapong detraphiphat\/Getty Images)\" loading=\"lazy\" \/><\/p>\n<p>Health insurance claim form (krisanapong detraphiphat\/Getty Images).<\/p>\n<p dir=\"ltr\">WASHINGTON \u2014 Two leading Democrats on a U.S. House panel called on the head of an agency within the U.S. Department of Labor responsible for protecting workers\u2019 benefits to take action to address improper health insurance claim denials, in a Tuesday\u00a0<a href=\"https:\/\/democrats-edworkforce.house.gov\/imo\/media\/doc\/scott_desaulnier_letter_to_ebsa_assistant_secretary_aronowitz_re_claim_denials.pdf\" target=\"_blank\">letter<\/a> provided exclusively to States Newsroom.\u00a0\u00a0<\/p>\n<p dir=\"ltr\">Reps. Bobby Scott of Virginia and Mark DeSaulnier of California \u2014 the respective ranking members of the House Committee on Education and Workforce and its Subcommittee on Health, Employment, Labor, and Pensions \u2014 offered three recommendations to Daniel Aronowitz. He is the assistant secretary of the DOL\u2019s Employee Benefits Security Administration, or EBSA.\u00a0<\/p>\n<p dir=\"ltr\">\u201cImproper claim denials impose substantial health and financial hardships on individuals, leading to delays in necessary treatments, worsened health outcomes, and high out-of-pocket costs,\u201d Scott and DeSaulnier wrote.<\/p>\n<p dir=\"ltr\">\u201cIn far too many tragic cases, denials lead to the unnecessary deaths of people who have earned benefits through their plan, but are nonetheless denied the care that could have saved their lives,\u201d they added.\u00a0<\/p>\n<h4>Improvements called for in collecting data on denials<\/h4>\n<p dir=\"ltr\">As head of EBSA, Aronowitz is responsible for administering, regulating and enforcing\u00a0<a href=\"https:\/\/www.dol.gov\/agencies\/ebsa\/about-ebsa\/about-us\/history-of-ebsa-and-erisa\" target=\"_blank\">Title I of the Employee Retirement Income Security Act<\/a>, or ERISA, which is intended to protect participants\u2019 and their beneficiaries\u2019 interests when it comes to benefit plans under their employers.\u00a0<\/p>\n<p dir=\"ltr\">DOL\u00a0<a href=\"https:\/\/www.dol.gov\/sites\/dolgov\/files\/EBSA\/researchers\/statistics\/retirement-bulletins\/annual-report-on-self-insured-group-health-plans-2025.pdf\" target=\"_blank\">estimated<\/a> roughly 136 million participants and beneficiaries were covered by approximately 2.6 million ERISA-covered group health plans in 2022.\u00a0\u00a0<\/p>\n<p dir=\"ltr\">As part of their recommendations, Scott and DeSaulnier called on Aronowitz to \u201cimplement long-delayed transparency requirements to collect data on health claim denials by insurance companies and group health plans.\u201d<\/p>\n<p dir=\"ltr\">The two suggested building upon Form 5500, ERISA\u2019s annual reporting requirement, to \u201cimprove data collection from group health plans.\u201d\u00a0<\/p>\n<h4>Staffing at agency, Trump budget cuts cited<\/h4>\n<p dir=\"ltr\">Scott and DeSaulnier also urged Aronowitz to \u201ccommit to fully enforcing the law and to ensuring that EBSA is adequately staffed to fulfill its mission,\u201d pointing to a decline in more\u00a0<a href=\"https:\/\/www.psca.org\/news\/psca-news\/2025\/4\/ebsa-loses-over-20-of-staff-from-resignations\/\" target=\"_blank\">than a fifth of the agency\u2019s staff<\/a> under President Donald Trump\u2019s administration.\u00a0<\/p>\n<p dir=\"ltr\">Trump\u2019s\u00a0<a href=\"https:\/\/www.dol.gov\/sites\/dolgov\/files\/general\/budget\/2026\/FY2026BIB.pdf\" target=\"_blank\">fiscal 2026 budget request<\/a> for DOL also called for $181 million in funding for EBSA, a $10 million proposed cut from the prior fiscal year.\u00a0<\/p>\n<p dir=\"ltr\">The Senate Appropriations Committee passed its annual bill to fund DOL, including EBSA, back in July and\u00a0<a href=\"https:\/\/www.appropriations.senate.gov\/imo\/media\/doc\/fy26_lhhs_senate_bill_summary.pdf\" target=\"_blank\">maintained funding for the program<\/a> in fiscal 2026 at $191 million.\u00a0<\/p>\n<p dir=\"ltr\">The corresponding panel in the House also\u00a0<a href=\"https:\/\/appropriations.house.gov\/news\/press-releases\/committee-approves-fy26-labor-health-and-human-services-education-and-related\" target=\"_blank\">approved its bill<\/a> to fund DOL in September, aligning with the administration\u2019s request of cutting funding for EBSA by $10 million in fiscal 2026.\u00a0<\/p>\n<p dir=\"ltr\">The Democrats also recommended Aronowitz take steps to \u201cimprove consumers\u2019 ability to appeal wrongfully denied health benefits.\u201d\u00a0<\/p>\n<p dir=\"ltr\">They encouraged the assistant secretary to consult the Advisory Council on Employee Welfare and Pension Benefit Plans and to \u201creverse\u201d DOL\u2019s current posture regarding the council.\u00a0<\/p>\n<p dir=\"ltr\">Scott and DeSaulnier noted that DOL took several steps to \u201cundermine\u201d the council, including \u201cdelaying public release of its report, purging documents such as testimonies from consumer advocates from the Department\u2019s website, and, to date, failing to convene the Council for any of the four statutorily-mandated meetings.\u201d\u00a0<\/p>\n<p dir=\"ltr\">The department did not immediately respond to a request for comment Tuesday.\u00a0<\/p>","protected":false},"excerpt":{"rendered":"<p>Health insurance claim form (krisanapong detraphiphat\/Getty Images).
