It applied only to those \u201caffiliated with a public or private elementary or secondary school in an official capacity.\u201d<\/span><\/p>\n<p><span>The law is part of a larger trend placing higher scrutiny on what books are offered by libraries and schools. In Missouri, efforts earlier this year to place new restrictions on digital libraries and expand the officials who could face prosecution were debated but did not pass.<\/span><\/p>\n<p><span>\u201cThe ACLU has been seeing an increase in the last at least five years in book removal from school libraries and public libraries for a variety of reasons,\u201d Wilcox said. \u201cAnd it all culminated in this law being passed.\u201d<\/span><\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"1H0mAtgbMG\">\n<p><a href=\"https:\/\/missouriindependent.com\/2023\/05\/31\/missouri-rule-takes-effect-putting-library-funds-in-jeopardy-over-obscene-material\/\">Missouri rule takes effect putting library funds in jeopardy over \u2018obscene\u2019 material<\/a><\/p>\n<\/blockquote>\n<p><span>The Missouri Association of School Librarians and Missouri Library Association, represented by Stinson LLP and the ACLU of Missouri, challenged the law in 2023 after \u201chundreds\u201d of titles were removed from shelves.<\/span><\/p>\n<p><span>\u201cLibrarians and school professionals statewide now assess prospective and existing titles in their collections based on fear, rather than expertise,\u201d their <\/span><a href=\"https:\/\/www.courts.mo.gov\/fv\/c\/Suggestions%20in%20Support%20of%20Plaintiffs%20Motion%20for%20Summary%20Judgment.PDF?courtCode=16&amp;di=28487444\" target=\"_blank\"><span>attorneys wrote in July<\/span><\/a><span>. \u201cThey have been reluctant, or have refused, to add new art, books, or even digital access to such materials that contain diverse or marginalized content or viewpoints, lest some unknown government official determine the work contains prohibited \u2018explicit sexual material.\u2019\u201d<\/span><\/p>\n<p><span>The state has long <\/span><a href=\"https:\/\/revisor.mo.gov\/main\/OneSection.aspx?section=573.040&amp;bid=56402\" target=\"_blank\"><span>prohibited<\/span><\/a><span> people from giving pornographic material to minors. The decades-old law uses a different definition of pornography, one that has been held up in courts as only prohibiting speech unprotected by the First Amendment.<\/span><\/p>\n<p><span>But the 2022 law extends beyond that precedent, plaintiffs attorneys argued, impeding free speech rights.<\/span><\/p>\n<p><span>The case was originally filed against county prosecutors but is currently being defended by the Missouri Attorney General\u2019s Office.<\/span><\/p>\n<p><span>Deputy Solicitor General Samuel Freedlund labeled librarians\u2019 arguments as insufficient, since they hadn\u2019t presented evidence of the law being enforced.<\/span><\/p>\n<p><span>\u201cAbsent evidence of any instance of any defendant actually enforcing the law against any of plaintiffs\u2019 members, plaintiffs can only raise hypothetical enforcement examples in their vagueness challenge \u2014 an approach Missouri courts have consistently rejected as facially insufficient to raise a vagueness challenge,\u201d <\/span><a href=\"https:\/\/www.courts.mo.gov\/fv\/c\/Defendant-Intervenors%20Memorandum%20in%20Support%20of%20their%20Motion%20for%20Summary%20Judgment.PDF?courtCode=16&amp;di=28488819\" target=\"_blank\"><span>he wrote<\/span><\/a><span>.<\/span><\/p>\n<p><span>Circuit Court Judge J. Dale Youngs offered little insight into the basis of his decision in the brief ruling, though he acknowledged in a footnote that with his <\/span><a href=\"https:\/\/www.16thcircuit.org\/Data\/Sites\/1\/media\/news\/news_releases\/judges-burnett-and-youngs-to-retire.pdf\" target=\"_blank\"><span>retirement coming at the end of the month<\/span><\/a><span>, \u201ctime is a factor.\u201d\u00a0<\/span><\/p>\n<p><span>\u201cMoreover, the court recognizes \u2014 now more than ever \u2014 its status as a \u2018way station\u2019 to the Supreme Court of Missouri,\u201d Youngs wrote. \u201cWhat the parties here need is a decision that can be fully and finally considered by an appellate court that \u2014 consistent with its standard of review \u2014 gives no deference to what this court thinks or why.\u201d<\/span><\/p>\n<p><span>Wilcox said the judge\u2019s decision, while brief, shows large agreement with plaintiffs\u2019 arguments.<\/span><\/p>\n<p><span>\u201cBy granting our motion on all counts and denying the state, the court did agree with all of our legal arguments and found that there were undisputed facts supporting those arguments,\u201d she said.<\/span><\/p>\n<p><span>In the months leading up to summary judgment, \u201cthousands of pages of documents were exchanged\u201d in discovery.<\/span><\/p>\n<p><span>The attorney general\u2019s office did not respond to a request for comment.<\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>The Jackson County Courthouse in Kansas City, as photographed Dec. 30, 2022 (Annelise Hanshaw\/Missouri Independent).
