Photo via Prosecuting Attorneys\u2019 Council of Georgia<\/p>\n<p>The Georgia election interference case against President Donald Trump appears to live on after the head of a nonpartisan state agency appointed himself the new prosecutor in the case.<\/p>\n<p>Peter J. Skandalakis, executive director of the Prosecuting Attorneys\u2019 Council of Georgia, will take over the case from embattled Fulton County District Attorney Fani Willis, Skandalakis announced Friday.<\/p>\n<p>Fulton County Superior Court Judge Scott McAfee had tasked Skandalakis with finding a replacement for Willis by Friday or he would allow the case to be dismissed.<\/p>\n<p>Skandalakis said he contacted \u201cseveral\u201d other prosecutors who declined to take up the case.<\/p>\n<p>\u201cThe decision to assume responsibility for this matter was reached only after careful and deliberate consideration,\u201d Skandalakis wrote. \u201cWhile it would have been simple to allow Judge McAfee\u2019s deadline to lapse or to inform the Court that no conflict prosecutor could be secured\u2014thereby allowing the case to be dismissed for want of prosecution\u2014I did not believe that to be the right course of action.\u201d<\/p>\n<p>Skandalakis said he recently received 101 banker boxes of documents related to the Trump investigation and an 8-terabyte hard drive containing the complete investigative file.<\/p>\n<figure class=\"wp-caption alignright\"><a href=\"https:\/\/georgiarecorder.com\/wp-content\/uploads\/2025\/08\/DSC0762-scaled.jpg\" target=\"_blank\"><img decoding=\"async\" loading=\"lazy\" class=\"size-medium wp-image-28211\" src=\"https:\/\/missouriindependent.com\/wp-content\/uploads\/2025\/11\/DSC0762-scaled.jpg\" alt=\"\" width=\"300\" height=\"200\"\/><\/a><figcaption class=\"wp-caption-text\">Lt. Ross Williams\/Georgia Recorder<\/figcaption><\/figure>\n<p>\u201cSince receiving these materials, I have diligently worked to familiarize myself with the record and the status of the proceedings,\u201d he said. \u201cAdditionally, I have attempted to review the evidence gathered and the hours of interviews and proffers of witnesses and former codefendants. Unfortunately, I have not had sufficient time to complete my review. With Judge McAfee\u2019s deadline now upon us and my review still ongoing, I have determined that the best course of action is to appoint myself to the case. This will allow me to complete a comprehensive review and make an informed decision regarding how best to proceed.\u201d<\/p>\n<p>McAfee has scheduled a conference with the parties to the case for Dec. 1.<\/p>\n<p>Skandalakis previously intervened in the case in a similar manner after Willis was disqualified from prosecuting Lt. Gov. Burt Jones, who, while a state senator, served as a so-called alternate elector after Trump lost the 2020 election. Willis had hosted a campaign event for Jones\u2019 political opponent.<\/p>\n<p>Skandalakis <a href=\"https:\/\/georgiarecorder.com\/briefs\/special-prosecutor-lt-gov-burt-jones-should-not-be-charged-in-georgia-election-interference-case\/\" target=\"_blank\">decided<\/a> last year not to bring criminal charges against Jones, ruling that he acted within the scope of his office.<\/p>\n<p>David Shafer, former chairman of the state GOP who was also one of the alternate electors and is a defendant in the Fulton County case, expressed confidence in Skandalakis in a statement authored by his attorney Craig Gillen in a since-deleted post on social media.<\/p>\n<p>\u201cWe are relieved that Mr. Skandalakis, a competent, experienced and objective professional prosecutor, will be in charge of the case and will conduct a thorough review of the evidence.\u201d<\/p>\n<p>A Fulton County grand jury<a href=\"https:\/\/georgiarecorder.com\/2023\/08\/14\/fulton-grand-jury-indicts-trump-members-of-his-inner-circle\/\" target=\"_blank\"> indicted<\/a> Trump in 2023 when he was out of office along with 18 others who allegedly formed a conspiracy to overturn the 2020 election, which Trump narrowly lost to President Joe Biden.<\/p>\n<figure class=\"wp-caption alignleft\"><a href=\"https:\/\/georgiarecorder.com\/wp-content\/uploads\/2024\/10\/DSC0906-1-scaled.jpg\" target=\"_blank\"><img decoding=\"async\" loading=\"lazy\" class=\"size-medium wp-image-28212\" src=\"https:\/\/missouriindependent.com\/wp-content\/uploads\/2025\/11\/DSC0906-1-scaled.jpg\" alt=\"\" width=\"300\" height=\"200\"\/><\/a><figcaption class=\"wp-caption-text\">Donald Trump. Ross Williams\/Georgia Recorder<\/figcaption><\/figure>\n<p>Following the loss, Trump had<a href=\"https:\/\/georgiarecorder.com\/briefs\/in-recorded-call-trump-pushed-official-to-overturn-georgia-vote\/\" target=\"_blank\"> famously called<\/a> Secretary of State Brad Raffensperger and asked him to \u201cfind\u201d the missing votes he would have needed to win. The alleged scheme also involved plans to submit a<a href=\"https:\/\/georgiarecorder.com\/2022\/06\/29\/updated-trumps-fake-electors-heres-the-full-list\/\" target=\"_blank\"> bogus<\/a> slate of electors to falsely certify that Trump had won the election, a<a href=\"https:\/\/georgiarecorder.com\/2023\/12\/18\/fulton-19-update-life-goes-on-jackpot-justice-for-giuliani-sorry-not-sorry\/\" target=\"_blank\"> harassment<\/a> campaign against Fulton County poll workers and a voting systems<a href=\"https:\/\/georgiarecorder.com\/2022\/09\/07\/familiar-cast-of-trump-election-deniers-emerges-with-new-video-showing-coffee-election-breach\/\" target=\"_blank\"> breach<\/a> in Coffee County.<\/p>\n<p>Four of the alleged co-conspirators pleaded guilty and agreed to testify against Trump and the other defendants, who maintained their innocence.<\/p>\n<p>But the beginning of the case\u2019s end came when an attorney for defendant Michael Roman, a former Trump campaign aide,<a href=\"https:\/\/georgiarecorder.com\/briefs\/judge-in-georgia-2020-election-interference-case-sets-hearing-on-accusations-of-prosecutor-misconduct\/\" target=\"_blank\"> introduced evidence<\/a> that Fulton County District Attorney Fani Willis had been involved in a romantic relationship with Nathan Wade, a special prosecutor she hired for the case with a lucrative contract, creating a potential conflict of interest.<\/p>\n<p>After dramatic testimony, including descriptions of vacations and cruises the two had taken together, a judge<a href=\"https:\/\/georgiarecorder.com\/2024\/03\/15\/fulton-county-judge-orders-changes-to-prosecution-team-in-2020-election-interference-case\/\" target=\"_blank\"> ordered<\/a> that either Wade or Willis\u2019 office needed to step aside from the case.<\/p>\n<figure class=\"wp-caption alignright\"><a href=\"https:\/\/georgiarecorder.com\/wp-content\/uploads\/2023\/10\/DSC0114_2-1024x683-1.jpg\" target=\"_blank\"><img decoding=\"async\" loading=\"lazy\" class=\"size-medium wp-image-28213\" src=\"https:\/\/missouriindependent.com\/wp-content\/uploads\/2025\/11\/DSC0114_2-1024x683-1.jpg\" alt=\"\" width=\"300\" height=\"200\"\/><\/a><figcaption class=\"wp-caption-text\">On Aug. 14, 2023 Fulton County District Attorney Fani Willis unveiled a grand jury\u2019s charges against former President Donald Trump and 18 others as part of a wide-ranging RICO case. Ross Williams\/Georgia Recorder<\/figcaption><\/figure>\n<p>Wade resigned from the case, but Willis was ultimately<a href=\"https:\/\/georgiarecorder.com\/2025\/09\/16\/da-fani-willis-loses-appeal-in-quest-to-lead-fulton-county-election-interference-case-against-trump\/\" target=\"_blank\"> disqualified<\/a> from pursuing the charges against Trump by the Georgia Court of Appeals because of the \u201csignificant appearance of impropriety\u201d stemming from their relationship. The Georgia Supreme Court<a href=\"https:\/\/georgiarecorder.com\/2025\/09\/16\/da-fani-willis-loses-appeal-in-quest-to-lead-fulton-county-election-interference-case-against-trump\/\" target=\"_blank\"> declined<\/a> to hear Willis\u2019 appeal in September, leaving the case officially in need of a new prosecutor.<\/p>\n<p>Georgia\u2019s case is the last criminal case still pending against Trump<b>.<\/b><\/p>\n<p>Prosecution against Trump himself may stall while he is serving as president, but the cases against other alleged co-conspirators could move forward, says Georgia State University law professor Anthony Michael Kreis.<\/p>\n<p>\u201cPete Skandalakis has two big bucket questions: the first one is, what does he want to do with the case more broadly as it goes for all of the co-defendants with the exception of Donald Trump, and then what does he want to do with the charges against Donald Trump?\u201d Kreis said.<\/p>\n<p>Skandalakis could proceed against the other co-defendants and sever Trump from the case until he leaves office, Kreis said, but that introduces new difficulties.<\/p>\n<p>\u201cThere\u2019s a lot of litigation that would have to be sorted through to figure out what kind of presidential immunity applies,\u201d Kreis said. \u201cAlso, just as a practical matter, unlike Fani Willis, who is probably going to be around, or a sitting district attorney who might be around in 2029 after the president leaves office, given the fact that this is a temporary appointment, I really sincerely doubt that Pete Skandalakis is just going to hang around for years waiting to try Donald Trump. So my view is it\u2019s incredibly unlikely that the charges against Donald Trump will ever see the light of day in a courtroom.\u201d<\/p>\n<p>\u201cTo me, the real question is what happens to all the other alleged co-conspirators and whether or not he decides to pursue those charges,\u201d Kreis added.<\/p>\n<p>Other legal threats previously hanging over the president\u2019s head have also gone Trump\u2019s way since he took office the second time in January.<\/p>\n<p>U.S. Justice Department special counsel Jack Smith<a href=\"https:\/\/georgiarecorder.com\/2024\/11\/26\/repub\/doj-special-counsel-smith-drops-federal-criminal-cases-against-trump\/\" target=\"_blank\"> dropped<\/a> a federal election interference case as well as a case alleging Trump mishandled classified documents after Trump\u2019s 2024 election victory because it would be illegal to continue prosecuting him after taking office.<\/p>\n<p>A New York state appeals court<a href=\"https:\/\/georgiarecorder.com\/2025\/08\/21\/repub\/new-york-appeals-court-overturns-465m-penalty-against-trump-keeps-fraud-finding\/\" target=\"_blank\"> overturned<\/a> a nearly $500 million civil penalty Trump was ordered to pay in a case involving fraudulent loan applications, though the judges left the fraud finding in place.<\/p>\n<p>Trump is<a href=\"https:\/\/georgiarecorder.com\/2025\/10\/28\/repub\/trump-claims-immunity-seeks-to-erase-felon-status-with-appeal-in-ny-court\/\" target=\"_blank\"> appealing<\/a> a New York conviction involving hush money payments to adult film star Stormy Daniels, which gave him the status of being the only felon elected president, and he\u2019s<a href=\"https:\/\/www.bbc.com\/news\/articles\/cj0egyzm5yjo\" target=\"_blank\" rel=\"noopener\"> seeking<\/a> Supreme Court intervention in a civil case over a claim that he sexually abused and defamed writer E.
