But what drew their attention was a provision tucked in the <\/span><a href=\"https:\/\/www.appropriations.senate.gov\/imo\/media\/doc\/agfy26conf.pdf\" target=\"_blank\"><span>bill<\/span><\/a><span> that would prohibit hemp products from having more than .4 milligrams of total THC per container. If the House approves it and the president signs it, the prohibition will go into effect in one year.\u00a0\u00a0<\/span><\/p>\n<p><span>The change, Grady said, will devastate his business.\u00a0<\/span><\/p>\n<p><span>\u201cWhen this is done,\u201d he said, \u201cwe\u2019ll lose 52% of our revenue, meaning we won\u2019t be able to stay in business.\u201d\u00a0<\/span><\/p>\n<p><span>On Tuesday \u2013 a day they would normally be focused on honoring veterans \u2013 the couple said they didn\u2019t have the energy.\u00a0<\/span><\/p>\n<p><span>\u201cYou\u2019re sick to your stomach all day long,\u201d said Kara Grady, \u201cknowing your hard work is for not.\u201d<\/span><\/p>\n<p><span>State officials <\/span><a href=\"https:\/\/missouriindependent.com\/2024\/10\/03\/cost-to-enforce-ban-on-intoxicating-hemp-products-in-missouri-estimated-at-nearly-900k\/\"><span>estimated last year<\/span><\/a><span> that 40,000 food establishments and smoke shops and 1,800 food manufacturers were selling products that would be banned under the proposed federal regulations.\u00a0<\/span><\/p>\n<p><span>That estimate was part of the Missouri Department of Health and Senior Services\u2019 2025 budget estimate to enforce former Gov. Mike Parson\u2019s abandoned<\/span><a href=\"https:\/\/missouriindependent.com\/2024\/08\/12\/hemp-industry-leaders-call-missouri-governors-order-banning-thc-products-an-overreach\/\"><span> 2024 order that would have banned intoxicating hemp products<\/span><\/a><span> in the state.<\/span><\/p>\n<p><span>Hemp was legalized in the 2018 Farm bill and naturally has very little THC, the intoxicating component mostly associated with marijuana.\u00a0<\/span><\/p>\n<p><span>But that potency can be increased with some <\/span><a href=\"https:\/\/missouriindependent.com\/2023\/04\/14\/missouri-lawmakers-take-aim-at-unregulated-delta-8-thc-hemp-products\/\"><span>science<\/span><\/a><span>.<\/span><\/p>\n<p><span>While marijuana products must be sold in dispensaries and be grown and manufactured in state-regulated facilities, <\/span><a href=\"https:\/\/missouriindependent.com\/briefs\/with-missouri-regulations-in-flux-whats-the-difference-between-hemp-and-marijuana\/\"><span>intoxicating hemp products are completely unregulated<\/span><\/a><span> by any governmental agency.\u00a0<\/span><\/p>\n<p><span>There\u2019s no state or federal law saying teenagers or children can\u2019t buy them or stores can\u2019t sell them to minors. However, some stores and vendors in Missouri have taken it upon themselves to impose age restrictions of 21 and up.<\/span><\/p>\n<figure class=\"wp-caption alignright\"><img decoding=\"async\" loading=\"lazy\" class=\"wp-image-28153 size-medium\" src=\"https:\/\/missouriindependent.com\/wp-content\/uploads\/2025\/11\/John-Grady-225x300.jpg\" alt=\"\" width=\"225\" height=\"300\" \/><figcaption class=\"wp-caption-text\"><em>John Grady, owner of Slappyhappy Hemp Company, has owned a hemp farm in Missouri since 2023 and last year opened a hemp emporium in Rosebud (Photo submitted).<\/em><\/figcaption><\/figure>\n<p><span>Missouri state Rep. Dave Himan, a Republican from O\u2019Fallon, said he was planning on pre-filing legislation on Dec. 1 that would have established a licensing system to allow Missouri businesses to sell the low-dose hemp-derived THC beverages and edibles.\u00a0<\/span><\/p>\n<p><span>If the federal spending bill passes, his bill will reflect the .4 milligram limit of THC per package \u2013 and that also includes THC-A, which transforms into THC when heated.<\/span><\/p>\n<p><span>\u201cWe are really kind of looking now to see what the federal government\u2019s going to do,\u201d he said, \u201cand if we need to make adjustments in my bill to mirror what the federal government\u2019s going to put in place.\u201d<\/span><\/p>\n<p><span>This will be Hinman\u2019s second year \u2014 and Missouri\u2019s <\/span><a href=\"https:\/\/missouriindependent.com\/2023\/04\/14\/missouri-lawmakers-take-aim-at-unregulated-delta-8-thc-hemp-products\/\"><span>fourth year<\/span><\/a><span> \u2013 trying to regulate intoxicating hemp products. Previous attempts failed because the proposed bills, backed by the marijuana industry, would have banned the products.\u00a0<\/span><\/p>\n<p><span>Last year, several bills failed to advance because the hemp industry itself couldn\u2019t agree on provisions for things including THC limits and licensing requirements.\u00a0<\/span><\/p>\n<p><span>A <\/span><a href=\"https:\/\/missourihemphoax.com\/\" target=\"_blank\"><span>report<\/span><\/a><span> released last month by the Missouri Cannabis Trade Association, which represents the marijuana industry, tested<\/span><span> 55 intoxicating hemp products purchased from smoke shops and gas stations statewide. Results showed that nearly all of them were above the total THC limit that\u2019s outlined in the pending federal spending bill.<\/span><\/p>\n<p><span>While the debate in previous years has often been seen as a marijuana industry versus the hemp industry, both of those players have a growing common foe \u2013 the black-market marijuana products that are posing as certified hemp products, Hinman said.\u00a0<\/span><\/p>\n<p><span>\u201cThere are some great people out there that own mom-and-pop shops that really are doing the right thing,\u201d Hinman said.\u00a0<\/span><\/p>\n<p><span>However, just last week, Hinman met with a group that brought in packages of about 40 different THC products purchased throughout the state that resemble Skittles, M&amp;M\u2019s and chips that would easily be mistaken by children as regular products.\u00a0<\/span><\/p>\n<p><span>\u201cThat continues to proliferate throughout our state,\u201d he said, \u201cand it\u2019s just getting worse and worse. So we\u2019ve got to do something. And it\u2019s actually not even hemp, it\u2019s truly marijuana out there, and it\u2019s really hurting the business.\u201d<\/span><\/p>\n<p><span>Eapen Thampy, a lobbyist who represents several hemp businesses, agreed that the \u201cbad actors\u201d have expanded and pose a threat to legitimate hemp businesses.<\/span><\/p>\n<p><span>\u201cWe\u2019re under attack from the marijuana industry that wants to protect their monopoly,\u201d Thampy said, \u201cand we\u2019re under attack from bad actors who don\u2019t care who they hurt to make a buck. We\u2019re sort of the collateral damage in that picture.\u201d<\/span><\/p>\n<p><span>Thampy said the hemp industry is hopeful that Congress will take up the issue before the ban is implemented in a year, if the spending bill is approved. However, a Senate amendment to remove the language was defeated last night by a 76-24 vote, making the success of a separate bill unlikely.\u00a0<\/span><\/p>\n<p><span>President Donald Trump told reporters Monday that he supports the deal and the House could vote on the bill as early as Wednesday. <\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>Slaphappy Hemp farm in Rosebud (photo submitted).
