(Photo by Amanda Watford\/Stateline)<\/p>\n<p>The Federal Communications Commission <a href=\"https:\/\/www.fcc.gov\/document\/fcc-approves-incarcerated-peoples-communications-services-reforms\" target=\"_blank\" rel=\"noopener\">voted<\/a> to roll back limits on how much companies can charge incarcerated people and their families for phone and video calls.<\/p>\n<p>The 2-1 vote in late October reverses rate caps the FCC <a href=\"https:\/\/docs.fcc.gov\/public\/attachments\/FCC-24-75A1.pdf\" target=\"_blank\" rel=\"noopener\">adopted<\/a> last year under a 2023 <a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/senate-bill\/1541\/text\" target=\"_blank\" rel=\"noopener\">law<\/a> that allows the agency\u00a0to set limits on prison phone and video call rates. Critics say the rates are kept high by limited competition among major providers such as Securus Technologies and ViaPath.<\/p>\n<p>Under the new interim <a href=\"https:\/\/docs.fcc.gov\/public\/attachments\/DOC-415061A1.pdf\" target=\"_blank\" rel=\"noopener\">rules<\/a>, phone calls will cost up to $0.11 per minute in large prisons and $0.18 per minute in the smallest jails. Video calls will cost up to $0.23 per minute in large facilities and as much as $0.41 in small ones.<\/p>\n<p>Only three states \u2014 Florida, Kentucky and Oklahoma \u2014 currently have rates above the new rates, meaning most prison systems across the country are already below the previously adopted 2024 rate caps.<\/p>\n<p>The new 2025 rates will take effect 120 days after being published in the Federal Register.<\/p>\n\n<p>In June, the FCC had abruptly <a href=\"https:\/\/www.fcc.gov\/document\/carr-acts-address-unintended-consequences-2024-ipcs-order\" target=\"_blank\" rel=\"noopener\">announced<\/a> a two-year delay in implementing the 2024 rate caps after receiving <a href=\"https:\/\/www.fcc.gov\/ecfs\/document\/10307465317480\/1\" target=\"_blank\" rel=\"noopener\">complaints<\/a> from local sheriffs and prison telecom companies. Republican attorneys general from 14 states also filed a <a href=\"https:\/\/www.reuters.com\/legal\/republican-state-ags-sue-fcc-over-inmate-phone-call-rules-2024-10-02\/\" target=\"_blank\" rel=\"noopener\">lawsuit<\/a> last year challenging the commission\u2019s authority to limit how much prisons and jails can charge for phone calls, arguing that the rules deprived correctional facilities of needed funding.<\/p>\n<p>Republican Commissioners Brendan Carr and Olivia Trusty, both appointed by President Donald Trump, supported the rollback. Carr argued the previous caps limited facilities\u2019 ability to recover safety and security costs, such as monitoring calls, leading some to scale back or eliminate calling services altogether. Trusty said the 2024 rules \u201cdid not always strike the right balance,\u201d and cited \u201cunintended consequences\u201d like service disruptions in some facilities.<\/p>\n<p>At least one small jail \u2014 in Baxter County, Arkansas \u2014 <a href=\"https:\/\/mhobserver.com\/baxter-county-jail-to-end-inmate-phone-service-due-to-new-fcc-rules\/\" target=\"_blank\" rel=\"noopener\">ended<\/a> phone services earlier this year in protest of the lower rate caps.<\/p>\n<p>Democratic Commissioner Anna Gomez, appointed by President Joe Biden, voted against the order and called it \u201cindefensible.\u201d She said the decision gives monopoly telecom providers \u201cthe authority to increase the costs for families to maintain critical connections with their loved ones in prison.\u201d<\/p>\n<p>Advocates for incarcerated people condemned the vote.<\/p>\n<p>\u201cThese changes are a betrayal of the families who entrusted the FCC to protect them from the notoriously predatory correctional telecom industry,\u201d Bianca Tylek, the executive director of Worth Rises, said in a <a href=\"https:\/\/worthrises.org\/pressreleases\/2025\/10\/29\/worth-rises-condemns-fcc-rollback-of-correctional-telecom-regulations-citing-manipulation-by-industry-and-harm-to-incarcerated-families\" target=\"_blank\" rel=\"noopener\">news release<\/a>. Worth Rises is a nonprofit advocacy organization dedicated to dismantling the prison industry.<\/p>\n\n<p>Some <a href=\"https:\/\/www.prisonpolicy.org\/blog\/2021\/12\/21\/family_contact\/\" target=\"_blank\" rel=\"noopener\">research<\/a> suggests that incarcerated people who maintain consistent contact with loved ones are significantly more likely to succeed upon release and are less likely to reoffend.<\/p>\n<p>The FCC\u2019s latest decision comes months after New York <a href=\"https:\/\/stateline.org\/2025\/08\/01\/new-york-becomes-latest-state-to-offer-free-phone-calls-in-prisons\/\" target=\"_blank\">joined<\/a> California, Colorado, Connecticut, Massachusetts, and Minnesota in offering <a href=\"https:\/\/connectfamiliesnow.com\/data\" target=\"_blank\" rel=\"noopener\">free phone calls<\/a> in state prisons. Colorado\u2019s policy won\u2019t take full effect until 2026.<\/p>\n<p>At least two states \u2014 <a href=\"https:\/\/marylandmatters.org\/2025\/01\/10\/advocates-try-again-on-bill-to-halt-the-practice-of-charging-inmates-for-phone-calls\/\" target=\"_blank\" rel=\"noopener\">Maryland<\/a> and Missouri \u2014 considered legislation this year to make prison and jail calls more affordable.
