Mike Kehoe and refused a delay of his execution by judges in the U.S. Eighth Circuit Court of Appeals.<\/span><\/p>\n<p><span>Attorneys for Lance Shockley, who was convicted in 2009 of the murder of Missouri State Highway Patrol Sgt. Carl DeWayne Graham Jr., filed a motion last week <\/span><a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ca8.112938\/gov.uscourts.ca8.112938.00805368071.0.pdf\" target=\"_blank\"><span>challenging<\/span><\/a><span> the Missouri Department of Corrections\u2019 refusal to allow Shockley\u2019s daughters, who are ordained ministers, to pray and lay hands upon him in the execution chamber.<\/span><\/p>\n<p><span>Judge David Stras wrote in his opinion that denying Shockley\u2019s request to be accompanied by his daughters would not place \u201ca substantial burden\u201d on Shockley\u2019s religious beliefs. Stras also wrote that \u201chaving family members in the execution chamber poses special dangers to everyone involved,\u201d including interfering with officials\u2019 response during a potential emergency.<\/span><\/p>\n<p><span>Jeremy Weis, Shockley\u2019s lead attorney and an assistant federal public defender, said Monday evening that his team could request a stay of execution from the U.S. Supreme Court.<\/span><\/p>\n<p><span>Earlier in the day Monday, Kehoe in a <\/span><a href=\"https:\/\/governor.mo.gov\/press-releases\/archive\/governor-kehoe-denies-clemency-request-mr-lance-shockley\" target=\"_blank\"><span>press release<\/span><\/a><span> described his denial of clemency as evidence of Missouri\u2019s \u201ccommitment to the pursuit of justice.\u201d Shockley\u2019s advocates have argued he should not be executed because he was sentenced to death by a judge after the jury could not reach agreement on the death penalty.\u00a0<\/span><\/p>\n<p><span>Missouri is one of only two states, along with Indiana, that allow judges to unilaterally choose the death penalty when a jury is split on how to sentence a defendant for a capital offense. In <\/span><a href=\"https:\/\/www.americanbar.org\/groups\/committees\/death_penalty_representation\/publications\/project_blog\/missouri-judge-imposes-life-sentence\/\" target=\"_blank\"><span>most other states<\/span><\/a><span>, a deadlocked jury results in a life sentence.\u00a0<\/span><\/p>\n<p><span>\u201c[Kehoe] didn\u2019t talk at all about the fact that the same jury that convicted him didn\u2019t say he should die,\u201d Weis said. \u201cI find that troubling and disappointing.\u201d<\/span><\/p>\n<p><span>Graham was found shot dead in the driveway of his home in Carter County in March 2005. He had been investigating Shockley\u2019s role in a fatal 2004 drunk driving accident, which the prosecution said gave Shockley a motive for murder.<\/span><\/p>\n<p><span>Kehoe noted in the press release that the Missouri Supreme Court, a federal district court, the Eighth Circuit Court of Appeals and the U.S. Supreme Court all reviewed Shockley\u2019s case and let the trial court\u2019s decision stand.<\/span><\/p>\n<p><span>\u201cMr. Shockley has received every legal protection afforded to him under the Missouri and United States Constitutions,\u201d Kehoe said, \u201cand his sentence will remain for his brutal and deliberate crime.\u201d\u00a0<\/span><\/p>\n<p><span>Weis said Thursday that Shockley\u2019s legal team had found after the trial that at least two of the 12 jurors who convicted Shockley voted for him to serve life in prison.<\/span><\/p>\n<p><span>Stras wrote in his opinion that Shockley\u2019s daughters will be able to lead spiritual rituals during their father\u2019s execution \u201cfrom behind a glass window.\u201d<\/span><\/p>\n<p><span>Department of Corrections policy allows defendants the presence of their chosen spiritual advisor as they are put to death.
