Santiago\/Getty Images)<\/p>\n<p dir=\"ltr\">ALEXANDRIA, Va. \u2014 Former FBI Director James Comey pleaded not guilty to two felony charges Wednesday in federal court in Virginia, in response to an indictment that followed an extraordinary pressure campaign from President Donald Trump.<\/p>\n<p dir=\"ltr\">A federal grand jury in Alexandria, Virginia,\u00a0<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.vaed.582136\/gov.uscourts.vaed.582136.1.0_3.pdf\" target=\"_blank\">indicted<\/a> Comey\u00a0<a href=\"https:\/\/www.newsfromthestates.com\/article\/former-fbi-director-comey-indicted-2-federal-charges-after-trump-urged-prosecution\" target=\"_blank\">in September<\/a> on one charge of making false statements to Congress during testimony in 2020 and another of obstructing a proceeding of Congress. (Photo by Ashley Murray\/States Newsroom)<\/figcaption><\/figure>\n<p dir=\"ltr\"><a href=\"https:\/\/www.newsfromthestates.com\/article\/comey-says-hes-standing-donald-trump-while-trump-calls-more-retribution\" target=\"_blank\">The indictment<\/a> came just days before the statute of limitations ran out.<\/p>\n<p dir=\"ltr\">A trial is set for early January.\u00a0Comey\u2019s lawyer, Patrick Fitzgerald, said he plans to file two batches of motions this month, including one alleging vindictive and selective prosecution.\u00a0<\/p>\n<p dir=\"ltr\">\u201cOur view is this prosecution was brought by President Trump,\u201d Fitzgerald said.<\/p>\n<h4>Trump told his AG: \u2018We can\u2019t delay any longer\u2019<\/h4>\n<p dir=\"ltr\">Trump has long targeted Comey for his role leading the FBI during an investigation into Russian interference in the 2016 presidential election.<\/p>\n<p dir=\"ltr\">Trump fired him after pressuring him to end the investigation and failing.\u00a0<\/p>\n<p dir=\"ltr\">Trump and Comey have publicly sparred since his dismissal. Comey has denied wrongdoing.<\/p>\n<p dir=\"ltr\">Trump in September\u00a0<a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/115239044548033727\" target=\"_blank\">posted<\/a> on social media urging Attorney General Pam Bondi to take action against Comey and other political enemies, demanding retribution for his own prosecutions.<\/p>\n<p dir=\"ltr\">\u201cPam: I have reviewed over 30 statements and posts saying that, essentially, \u2018same old story as last time, all talk, no action. Nothing is being done,\u2019\u201d Trump wrote. \u201cWe can\u2019t delay any longer, it\u2019s killing our reputation and credibility. They impeached me twice, and indicted me (5 times!), OVER NOTHING. JUSTICE MUST BE SERVED, NOW!!! President DJT.\u201d<\/p>\n<p dir=\"ltr\">The president then forced out the acting U.S. attorney for the Eastern District of Virginia when he declined to pursue charges against Comey. Trump replaced the office\u2019s top prosecutor with former personal lawyer Lindsey Halligan, who swiftly obtained an indictment.<\/p>\n<p dir=\"ltr\">Comey\u2019s legal team plans to fight Halligan\u2019s appointment as unlawful.<\/p>\n<h4>Classified information expected to be included<\/h4>\n<p dir=\"ltr\">U.S. District Judge Michael S. Nachmanoff for the Eastern District of Virginia agreed to Comey\u2019s request for a trial in January, after there were no objections from the government to schedule the proceeding beyond the Dec. 17 speedy trial deadline.<\/p>\n<p dir=\"ltr\">Fitzgerald\u2019s challenge to Halligan\u2019s appointment will be heard by a judge outside the Eastern District of Virginia according to standard protocol, Nachmanoff said, adding the separate track will have no bearing on Comey\u2019s case schedule.<\/p>\n<p dir=\"ltr\">Nachmanoff, who was nominated by former President Joe Biden, ordered the parties to swiftly agree on obtaining security clearances for Comey and Fitzgerald, as the government contends some of the evidence may be classified.<\/p>\n<p dir=\"ltr\">\u201cWe haven\u2019t seen a single piece of discovery to date,\u201d Fitzgerald told Nachmanoff, adding he had not received communication from government prosecutors until Tuesday.<\/p>\n<p dir=\"ltr\">Government prosecutor Nathaniel Lemons said he expects a \u201clarge amount\u201d of discovery will be classified. Discovery is the process of exchanging information about witnesses and evidence in a legal case.<\/p>\n<p dir=\"ltr\">\u201cWe\u2019re just getting our hands around the discovery as well,\u201d Lemons said.<\/p>\n<p dir=\"ltr\">Nachmanoff responded he is \u201ca little skeptical.\u201d<\/p>\n<p dir=\"ltr\">\u201cThis does not appear to be a particularly complex case,\u201d Nachmanoff said during the roughly 30-minute arraignment.<\/p>\n<p dir=\"ltr\">Fitzgerald told the judge the defense is \u201ca bit confused\u201d about the government\u2019s slow movement on producing discovery.<\/p>\n<p dir=\"ltr\">\u201cFrankly, we feel in this case the cart has been put before the horse,\u201d Fitzgerald said.<\/p>\n<p dir=\"ltr\">Nachmanoff ordered the parties to come to a discovery agreement by week\u2019s end, or risk the court setting one for them.<\/p>\n<p dir=\"ltr\">\u201cI want to get this resolved promptly. \u2026 There should be no reason this case gets off track because of the existence of classified information,\u201d he said.<\/p>\n<h4>Comey\u2019s family accompanies him<\/h4>\n<p dir=\"ltr\">Fitzgerald, who served as the U.S. attorney in Chicago for over a decade during the George W. Bush administration, is known for his\u00a0<a href=\"https:\/\/www.justice.gov\/archive\/osc\/documents\/2005_10_28_fitzgerald_press_conference.pdf\" target=\"_blank\">role<\/a> as Special Counsel in 2005 during the CIA leak case against Lewis \u201cScooter\u201d Libby.<\/p>\n<p dir=\"ltr\">Fitzgerald told Nachmanoff that representing Comey is \u201cthe honor of my life.\u201d<\/p>\n<p dir=\"ltr\">Several of Comey\u2019s family members attended the arraignment at the Eastern District\u2019s Albert V. Bryan Courthouse, including his daughter, Maurene Comey, who was fired earlier this year from her role as a federal prosecutor in Manhattan.\u00a0<\/p>\n<p dir=\"ltr\">Comey\u2019s son-in-law, Troy Edwards Jr., was also in attendance. Edwards resigned from his position as prosecutor for the Eastern District of Virginia immediately after Comey was indicted last month.\u00a0<\/p>\n<p dir=\"ltr\">Oral arguments are set for Nov. 19 and Dec. 9.
