{"id":5913,"date":"2025-10-07T16:10:02","date_gmt":"2025-10-07T21:10:02","guid":{"rendered":"https:\/\/westplexnews.com\/index.php\/2025\/10\/07\/judge-approves-ballot-language-for-amendment-reinstating-missouri-abortion-ban-2\/"},"modified":"2025-10-07T16:10:02","modified_gmt":"2025-10-07T21:10:02","slug":"judge-approves-ballot-language-for-amendment-reinstating-missouri-abortion-ban-2","status":"publish","type":"post","link":"https:\/\/westplexnews.com\/index.php\/2025\/10\/07\/judge-approves-ballot-language-for-amendment-reinstating-missouri-abortion-ban-2\/","title":{"rendered":"Judge approves ballot language for amendment reinstating Missouri abortion ban"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/missouriindependent.com\/wp-content\/uploads\/2024\/06\/IMG_0817-1024x683.jpg\" class=\"attachment-large size-large wp-post-image\" alt=\"\" \/><\/p>\n<p>A surgical room is prepped for patients on Friday, June 21, 2024, at Planned Parenthood Great Plains in Overland Park, Kansas (Anna Spoerre\/The Missouri Independent).<\/p>\n<p><span>After two revisions, a Cole County judge has approved the language for <\/span><a href=\"https:\/\/www.senate.mo.gov\/25info\/bts_web\/bill.aspx?SessionType=R&amp;BillID=13399177\" target=\"_blank\"><span>a proposed abortion ban <\/span><\/a><span>that will go before voters in November 2026.<\/span><\/p>\n<p><span>Circuit Judge Daniel Green ruled Tuesday that the latest language drafted by Missouri Secretary of State Denny Hoskins and approved by Attorney General Catherine Hanaway is now \u201cfair and sufficient.\u201d It was Hoskins\u2019 second attempt to write a summary that will appear on the ballot, and the approved version still doesn\u2019t specifically mention that most abortions would be banned.\u00a0<\/span><\/p>\n<p><span>The language approved Tuesday by Green states:<\/span><\/p>\n<p><span>\u201cShall the Missouri Constitution be amended to:<\/span><\/p>\n<ul>\n<li><span>Guarantee women\u2019s medical care for emergencies, ectopic pregnancies, and miscarriages;\u00a0<\/span><\/li>\n<li><span>Ensure women\u2019s safety during abortions;\u00a0<\/span><\/li>\n<li><span>Ensure parental consent for minors;\u00a0<\/span><\/li>\n<li><span>Repeal Article I, section 36, approved in 2024; allow abortions for medical <\/span>emergencies, fetal anomalies, rape, and incest;<\/li>\n<li><span>and Prohibit sex-change procedures for children?\u201d<\/span><\/li>\n<li>\n<\/li><\/ul>\n<p><span>Until this week, the fourth bullet was the sticking point for Green, who said that Hoskins had to be more explicit in stating that a current constitutional amendment would be repealed. The previous ballot language used the word \u201camend\u201d rather than \u201crepeal,\u201d which Green called an <\/span><a href=\"https:\/\/missouriindependent.com\/briefs\/missouri-judge-orders-revised-ballot-language-repeal-abortion-rights\/\"><span>\u201cinsufficient and unfair\u201d<\/span><\/a><span> characterization of the measure.<\/span><\/p>\n<p><span>But attorneys representing abortion-rights organizations said even with the inclusion of the word \u201crepeal,\u201d the current language continues to be misleading, in part because it does not include the name of the amendment that would be repealed, instead assuming voters know that it\u2019s a reference to \u201cThe Right to Reproductive Freedom Initiative.\u201d\u00a0<\/span><\/p>\n<p><span>\u201cThe secretary\u2019s new bullet point four also still implies that (the amendment) gives rights to Missourians for the first time,\u201d attorneys Chuck Hatfield with Stinson LLP and Tori Schafer with the ACLU of Missouri, wrote in a court filing opposing the language on Monday. \u201cVoters should not be made to believe that, for the first time, Missourians will have access to abortions in certain circumstances.\u201d<\/span><\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"O48fgsxdT8\">\n<p><a href=\"https:\/\/missouriindependent.com\/2025\/10\/06\/missouri-attorney-general-subpoenas-planned-parenthood-patient-abortion-records\/\">Missouri attorney general subpoenas Planned Parenthood for patient abortion records<\/a><\/p>\n<\/blockquote>\n<p><span>The passage of the reproductive rights amendment, which was listed as Amendment 3 on the 2024 ballot, <\/span><a href=\"https:\/\/missouriindependent.com\/2024\/11\/05\/missouri-voters-overturn-states-near-total-abortion-ban\/\"><span>enshrined the right to abortion up to the point of fetal viability <\/span><\/a><span>in the state constitution. This legalized broader access to abortion than Missourians had seen in years.\u00a0<\/span><\/p>\n<p><span>Before November 2024, almost all abortions were illegal in Missouri, with limited exceptions for medical emergencies.\u00a0<\/span><\/p>\n<p><span>The <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/05\/14\/missouri-republicans-shut-down-senate-debate-to-pass-abortion-ban-repeal-sick-leave-law\/\"><span>proposed new ban,<\/span><\/a><span> which will also be listed as Amendment 3 on the 2026 ballot, would be slightly less restrictive than the near-total ban implemented in June 2022. It would allow abortions for survivors or rape or incest up to 12 weeks gestation, though it is not clear if or how a survivor would need to prove the assault in order to receive medical care.<\/span><\/p>\n<p><span>Hoskins was tasked with rewriting the ballot language<\/span><a href=\"https:\/\/missouriindependent.com\/2025\/09\/24\/judge-rules-unconstitutional-law-missouri-attorney-general-special-appeal-power\/\"><span> in keeping with a new law<\/span><\/a><span> after Green determined the initial wording by lawmakers failed to alert voters that <\/span><a href=\"https:\/\/missouriindependent.com\/briefs\/judge-orders-revisions-to-ballot-language-for-missouri-abortion-ban-proposal\/\"><span>the amendment would ban most abortions<\/span><\/a><span>.<\/span><\/p>\n<p><span>Today\u2019s decision confirms that our office is following the law and protecting the integrity of Missouri\u2019s ballot,\u201d Hoskins said in a statement Tuesday.\u00a0<\/span><\/p>\n<p><span>Hoskins was also responsible for writing the fair ballot statement that appears in polling places and on the office\u2019s website that summarize what both a \u201cyes\u201d and \u201cno\u201d vote mean.<\/span><\/p>\n<p><span>This approved fair ballot statement lays out that a \u201cyes\u201d vote would guarantee women\u2019s medical care under specific scenarios, including ectopic pregnancies and miscarriages, and allow abortions in the first 12 weeks festation in cases of rape or incest. It would also ban gender-affirming health care for minors.\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span>A \u201cno\u201d vote, Hoskins wrote, in part, would \u201climit abortion\u201d to specific scenarios.<\/span><\/p>\n<p><span>Attorneys for abortion-rights groups also took issue with this language, arguing in court filings Monday that it doesn\u2019t make clear that \u201cinstead of enshrining a right for the first time,\u201d the proposed amendment \u201creduces the protections currently existing in the constitution.\u201d<\/span><\/p>\n<p><span>The judge also weighed whether the inclusion of a ban on gender-affirming care for minors violates the constitution\u2019s prohibition on ballot questions containing more than one subject. Critics say the provision targeting transgender care <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/08\/27\/missouri-abortion-amendment-3-ballot-ban-cole-county-trial\/\"><span>\u00a0is nothing more than \u201cballot candy\u201d designed to trick voters.<\/span><\/a><span>\u00a0<\/span><\/p>\n<p><span>Green disagreed, giving the amendment approval for the ballot after concluding that <\/span><a href=\"https:\/\/missouriindependent.com\/briefs\/judge-orders-revisions-to-ballot-language-for-missouri-abortion-ban-proposal\/\"><span>abortion and gender-affirming health care were related enough<\/span><\/a><span> to meet constitutional requirements for a single subject.\u00a0<\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>A surgical room is prepped for patients on Friday, June 21, 2024, at Planned Parenthood Great Plains in Overland Park, Kansas (Anna Spoerre\/The Missouri Independent).
