Also requested through a subpoena were operational and clinical protocols, equipment patient records, contractual arrangements and documentation of compliance.\u00a0<\/span><\/p>\n<p><span>\u201cDespite the Missouri attorney general\u2019s blatant attempts to overturn the will of the people, all patients expect and have the right for their medical records to be private,\u201d leadership with Planned Parenthood Great Plains, Planned Parenthood Great Rivers and the ACLU of Missouri said in a joint statement. \u201cPoliticians have no place in the exam room with patients and their medical providers, and that\u2019s why we will keep fighting for patients and their rights.\u201d<\/span><\/p>\n<p><span>The attorney general\u2019s office, newly <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/09\/09\/catherine-hanaway-missouri-attorney-general-andrew-bailey\/\"><span>under the leadership of Catherine Hanaway,<\/span><\/a><span> did not immediately respond to a request for comment Monday.\u00a0<\/span><\/p>\n<p><span>The Missouri Attorney General\u2019s Office also subpoenaed two former Planned Parenthood Great Rivers board members, one physician contracted by Planned Parenthood Great Rivers and the chief medical officer of Planned Parenthood Great Plains, who was handed a subpoena during recess of a court hearing related to abortion access on Sept. 10.<\/span><\/p>\n<p><span>\u201cThis is nothing more than an attempt to harass (Planned Parenthood) and should not be permitted by the court,\u201d attorneys for the clinics wrote in a court filing asking Jackson County Circuit Judge Jerri Zhang to throw out the subpoenas.\u00a0<\/span><\/p>\n<p><span>Last November, Missourians voted to <\/span><a href=\"https:\/\/missouriindependent.com\/2024\/11\/05\/missouri-voters-overturn-states-near-total-abortion-ban\/\"><span>codify the right to reproductive health care<\/span><\/a><span>, including abortion up to the point of fetal viability, in the state constitution. A day later, Planned Parenthood and the ACLU of Missouri <\/span><a href=\"https:\/\/missouriindependent.com\/2024\/11\/06\/missouri-abortion-access-planned-parenthood-lawsuit-amendment-3\/\"><span>sued the state in an effort to take down several abortion regulations <\/span><\/a><span>that remain part of state statute, arguing that those regulations are now unconstitutional because they burden abortion patients and providers.\u00a0<\/span><\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"zAFmtenoBY\">\n<p><a href=\"https:\/\/missouriindependent.com\/briefs\/missouri-secretary-of-state-hoskins-second-attempt-abortion-ban-ballot-language\/\">Missouri secretary of state submits second attempt at abortion ban ballot language<\/a><\/p>\n<\/blockquote>\n<p><span>That lawsuit is set to go to trial in January. Until then, Zhang temporarily enjoined \u2014\u00a0or struck down \u2014\u00a0some of the regulations, <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/07\/03\/missouri-abortion-rights-amendment-trumps-most-restrictions-judge-rules\/\"><span>allowing Planned Parenthood to begin offering procedural abortions again<\/span><\/a><span>.\u00a0<\/span><\/p>\n<p><span>Planned Parenthood is also awaiting a decision from Zhang after asking her to enjoin even more state regulations that the clinic argues are preventing clinics from prescribing mifepristone and misoprostol, which are used in medication abortions. As of Monday, <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/09\/11\/laws-regulations-medication-abortion-mifepristone-misoprostol-missouri\/\"><span>Missourians could not access medication abortion <\/span><\/a><span>from an in-state provider because of these regulations.<\/span><\/p>\n<p><span>Planned Parenthood is currently offering procedural abortions at its clinics in Kansas City, <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/03\/04\/abortion-returns-columbia-missouri-planned-parenthood-clinic\/\"><span>Columbia<\/span><\/a><span> and St. Louis.\u00a0<\/span><\/p>\n<p><strong>    <\/strong><\/p>\n<h4 class=\"editorialSubhed\">A separate battle for patient records<\/h4>\n<p>\t<\/p>\n<p><span>Last month, the Missouri Court of Appeals gave the green light for the attorney general\u2019s office to subpoena patient health information in a separate case involving the <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/09\/16\/appeals-court-gives-missouri-ag-pathway-to-transgender-center-patient-records\/\"><span>Washington University Transgender Center.<\/span><\/a><span> But it has to be done under more stringent parameters, the court ruled.\u00a0<\/span><\/p>\n<p><span>The attorney general\u2019s office initially requested \u201call electronic health records of (the center\u2019s) clients\u201d and a list of all the center\u2019s patients. The higher court is now requiring that only the minimum required health information be turned over.<\/span><\/p>\n<p><span>The appeals court reversed a<\/span><a href=\"https:\/\/missouriindependent.com\/2024\/07\/08\/judge-rules-missouri-ag-has-no-right-to-medical-records-of-transgender-minors-at-wash-u\/\"><span> ruling last year <\/span><\/a><span>in which a district judge said the center did not have to turn over patient information protected by the Health Information Portability and Accountability Act, also known as HIPAA.<\/span><\/p>\n<p><span>In that case,\u00a0 the attorney general\u2019s office argued that it qualifies as a<\/span><a href=\"https:\/\/www.courts.mo.gov\/fv\/c\/Appellants%20Brief.PDF?courtCode=EA&amp;di=513469\" target=\"_blank\"><span> \u201chealth oversight agency,\u201d <\/span><\/a><span>and as such should be privy to patient information protected by HIPPA.\u00a0<\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>An abortion procedure room pictured on March 3 at Planned Parenthood in Columbia (Anna Spoerre\/Missouri Independent).
