{"id":5605,"date":"2025-09-30T17:42:43","date_gmt":"2025-09-30T22:42:43","guid":{"rendered":"https:\/\/westplexnews.com\/index.php\/2025\/09\/30\/missouri-judge-says-new-ballot-language-again-fails-to-mention-repeal-of-abortion-rights-2\/"},"modified":"2025-09-30T17:42:43","modified_gmt":"2025-09-30T22:42:43","slug":"missouri-judge-says-new-ballot-language-again-fails-to-mention-repeal-of-abortion-rights-2","status":"publish","type":"post","link":"https:\/\/westplexnews.com\/index.php\/2025\/09\/30\/missouri-judge-says-new-ballot-language-again-fails-to-mention-repeal-of-abortion-rights-2\/","title":{"rendered":"Missouri judge says new ballot language again fails to mention repeal of abortion rights"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"614\" src=\"https:\/\/missouriindependent.com\/wp-content\/uploads\/2024\/05\/051624_hoskins1-1024x614.jpg\" class=\"attachment-large size-large wp-post-image\" alt=\"\" \/><\/p>\n<p>Missouri Secretary of State Denny Hoskins has been ordered to rewrite ballot language for a proposed constitutional amendment that would ban most abortions (Annelise Hanshaw\/Missouri Independent).<\/p>\n<p><span>Missouri Secretary of State Denny Hoskins must try again to write ballot language for a proposed constitutional amendment that would ban most abortions, a Cole County judge ruled Tuesday.<\/span><\/p>\n<p><span>Circuit Judge Daniel Green, in his second ruling on the ballot description of the measure proposed by lawmakers, said that Hoskins got most of the language right.<\/span><\/p>\n<p><span>But Hoskins\u2019 language on the portion that will be the issue the question turns on \u2014 repealing the abortion rights protections approved by voters last year \u2014\u00a0 is \u201cinsufficient and unfair\u201d and must be revised, Green ruled.<\/span><\/p>\n<p><span>Hoskins rewrote the ballot language <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/05\/14\/missouri-republicans-shut-down-senate-debate-to-pass-abortion-ban-repeal-sick-leave-law\/\"><span>prepared by Republican lawmakers<\/span><\/a><span> after Green ruled it, also, did not alert voters that<\/span><a href=\"https:\/\/missouriindependent.com\/briefs\/judge-orders-revisions-to-ballot-language-for-missouri-abortion-ban-proposal\/\"><span> it would repeal the voter-approved amendment.<\/span><\/a><\/p>\n<p><span>The measure would repeal the citizen-led initiative passed in 2024 that made Missouri <\/span><a href=\"https:\/\/missouriindependent.com\/2024\/11\/05\/missouri-voters-overturn-states-near-total-abortion-ban\/\"><span>the first state to overturn an abortion ban<\/span><\/a><span> by guaranteeing the constitutional right to abortion up to the point of fetal viability.\u00a0<\/span><\/p>\n<p><span>On Wednesday, Green ruled that Hoskins also missed the mark by failing to inform voters of the repeal, taking issue with just one bullet point in Hoskins\u2019 summary that reads:\u00a0<\/span><\/p>\n<p><span>\u201cShall the Missouri Constitution be amended to:\u00a0\u00a0<\/span><\/p>\n<ul>\n<li><span>Amend Article I, section 36, approved in 2024; allowing abortions for medical emergencies, fetal anomalies, rape, and incest;\u201d<\/span><\/li>\n<\/ul>\n<p><span>This summary \u201cfails to adequately alert voters that the proposed constitutional amendment would abrogate <\/span><a href=\"https:\/\/revisor.mo.gov\/main\/OneSection.aspx?constit=y&amp;section=I%20%2036\" target=\"_blank\"><span>Article 1, Section 36 of the Missouri Constitution,<\/span><\/a><span> which voters recently approved,\u201d Green wrote.\u00a0<\/span><\/p>\n<p><span>Missouri Attorney General Catherine Hanaway\u2019s Office in briefings submitted Monday said Hoskins\u2019 latest language was sufficient because it stated the new amendment would cause a \u201cmodification\u201d of state statute and that repeal language would be inaccurate because the new amendment \u201cdoes not abolish all the constitutional rights first enshrined in Article I, section 36,\u201d including the right to miscarriage care.<\/span><\/p>\n<p><span>For example, the attorney general wrote, the new amendment \u201crecognizes a right to abortion in some cases, and such a right was unprecedented in the Missouri Constitution before the voters enacted Article I, section 36 in 2024.\u201d\u00a0<\/span><\/p>\n<p><span>Prior to the passage of the abortion rights amendment, nearly all abortions were illegal in Missouri, with limited exceptions for medical emergencies.<\/span><\/p>\n<p><span>Attorneys with The ACLU of Missouri and Stinson Law<\/span> <span>in briefings Monday said Hoskins\u2019 new language \u201cat best, pays lip service\u201d to Green\u2019s order but \u201cdoes not describe the probable effects of the measure.\u201d<\/span><\/p>\n<p><span>Hoskins is obligated, they argued, \u201cto tell voters that they are being asked to repeal, not merely amend, the right to reproductive freedom.\u201d<\/span><\/p>\n<p><span>Jefferson City attorney Chuck Hatfield, in his filing, also took issue with the use of a semi-colon in the statement, saying it contributes to the \u201cgrammatical nonsense\u201d of the language sure to leave voters confused.<\/span><\/p>\n<p><span>Green on Tuesday ruled that the remaining bullet points are now acceptable. They read:\u00a0<\/span><\/p>\n<p><span>\u201cShall the Missouri Constitution be amended to:<\/span><\/p>\n<ul>\n<li><span>Guarantee women\u2019s medical care for emergencies, ectopic pregnancies, and miscarriages;\u00a0<\/span><\/li>\n<li><span>Ensure women\u2019s safety during abortions;\u00a0<\/span><\/li>\n<li><span>Ensure parental consent for minors;\u00a0<\/span><\/li>\n<li><span>and Prohibit sex-change procedures for children?\u201d<\/span><\/li>\n<\/ul>\n<p><span>Under a law passed this year and <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/09\/24\/judge-rules-unconstitutional-law-missouri-attorney-general-special-appeal-power\/\"><span>upheld in a separate case by Green<\/span><\/a><span>, Hoskins has five days to submit revised ballot language to the court. If after that, Green decides the language still doesn\u2019t follow the law, Hoskins has one<\/span> <span>more opportunity to rewrite it. If Green still doesn\u2019t find the language satisfactory, the judge will rewrite it himself.\u00a0<\/span><\/p>\n<p><span>Hoskins was also responsible for writing the fair ballot statement that appears in polling places and on the office\u2019s website that summarize what both a \u201cyes\u201d and \u201cno\u201d vote mean.<\/span><\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"V1w1Y7uaL4\">\n<p><a href=\"https:\/\/missouriindependent.com\/2025\/09\/30\/missouri-abortion-ban-amendment-campaign-fundraising\/\">Campaign gears up to defeat Missouri abortion ban amendment<\/a><\/p>\n<\/blockquote>\n<p><span>Green previously told Hoskins to rewrite the \u201cfair ballot language\u201d summary posted to the secretary of state\u2019s website, calling the old language misleading for also failing to state abortion would be banned in most cases.\u00a0\u00a0<\/span><\/p>\n<p><span>In his ruling Tuesday, Green deemed the new summary was sufficient.\u00a0<\/span><\/p>\n<p><span>This approved summary states that a \u201cyes\u201d vote would guarantee women\u2019s medical care under specific scenarios, including ectopic pregnancies and miscarriages and allow abortions in the first 12 weeks festation in cases of rape or incest.
