{"id":5453,"date":"2025-09-26T15:49:58","date_gmt":"2025-09-26T20:49:58","guid":{"rendered":"https:\/\/westplexnews.com\/index.php\/2025\/09\/26\/latest-language-for-missouri-ballot-measure-fails-to-mention-amendment-would-ban-abortion-2\/"},"modified":"2025-09-26T15:49:58","modified_gmt":"2025-09-26T20:49:58","slug":"latest-language-for-missouri-ballot-measure-fails-to-mention-amendment-would-ban-abortion-2","status":"publish","type":"post","link":"https:\/\/westplexnews.com\/index.php\/2025\/09\/26\/latest-language-for-missouri-ballot-measure-fails-to-mention-amendment-would-ban-abortion-2\/","title":{"rendered":"Latest language for Missouri ballot measure fails to mention amendment would ban abortion"},"content":{"rendered":"<p><img decoding=\"async\" width=\"1024\" height=\"614\" src=\"https:\/\/missouriindependent.com\/wp-content\/uploads\/2024\/05\/051724_hoskins1-1024x614.jpg\" class=\"attachment-large size-large wp-post-image\" alt=\"\" loading=\"lazy\" \/><\/p>\n<p>Missouri Secretary of State Denny Hoskins speaks to reporters in May 2024 during his time as a state senator (Annelise Hanshaw\/Missouri Independent).<\/p>\n<p><span>Secretary of State Denny Hoskins on Friday pitched his first revision of ballot language for a <a href=\"https:\/\/documents.house.mo.gov\/billtracking\/bills251\/hlrbillspdf\/2454H.05T.pdf\" target=\"_blank\">Missouri constitutional amendment<\/a> that would ban abortion \u2014 without mentioning the ban \u2014 at the Cole County Circuit Court.\u00a0<\/span><\/p>\n<p><span>Next week, Judge Daniel Green will decide if it is a ball or a strike.<\/span><\/p>\n<p><span>Last Friday, Green ordered Hoskins to rewrite the ballot language approved by lawmakers after finding it was \u201c<\/span><a href=\"https:\/\/missouriindependent.com\/briefs\/judge-orders-revisions-to-ballot-language-for-missouri-abortion-ban-proposal\/\"><span>insufficient and unfair\u201d<\/span><\/a><span> because it failed to mention the amendment would repeal abortion rights.\u00a0<\/span><\/p>\n<p><span>In his ruling, Green wrote that the original ballot title \u201cfails to adequately alert voters that it would eliminate\u201d the constitutional right to reproductive health care that Missourians approved last fall.<\/span><\/p>\n<p><span>Under a law passed this year and <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/09\/24\/judge-rules-unconstitutional-law-missouri-attorney-general-special-appeal-power\/\"><span>upheld this week by Green<\/span><\/a><span>, Hoskins had seven days to submit his revisions. Now, the two sides in the case have three days to submit analysis.<\/span><\/p>\n<p><span>If Green rules Hoskins failed, he will have five days to try again.<\/span><\/p>\n<p><span>The new ballot language written by Hoskins states in full:\u00a0<\/span><\/p>\n<p><span>\u201cShall the Missouri Constitution be amended to:<\/span><\/p>\n<ul>\n<li><span>Guarantee women\u2019s medical care for emergencies, ectopic pregnancies, and<\/span><\/li>\n<li><span>miscarriages;<\/span><\/li>\n<li><span>Ensure women\u2019s safety during abortions;<\/span><\/li>\n<li><span>Ensure parental consent for minors;<\/span><\/li>\n<li><span>Amend Article I, section 36, approved in 2024; allowing abortions for<\/span><\/li>\n<li><span>medical emergencies, fetal anomalies, rape, and incest; and<\/span><\/li>\n<li><span>Prohibit sex-change procedures for children?\u201d<\/span><\/li>\n<\/ul>\n<p><span>The <\/span><a href=\"https:\/\/revisor.mo.gov\/main\/OneSection.aspx?section=I++++36&amp;bid=54984&amp;constit=y\" target=\"_blank\"><span>reproductive rights amendment that<\/span><\/a><span> Missourians narrowly approved last fall legalized all abortions up until the point of fetal viability. Access to the procedure remains limited as Planned Parenthood affiliates have sued the state over a series of abortion regulations that remain on the books.\u00a0<\/span><\/p>\n<p><span>\u201cMy main focus has been protecting Missouri\u2019s families and the Constitution,\u201d Hoskins said in a statement Friday. \u201cThis ballot title and language reflects my commitment to upholding the values Missourians hold dear. My office remains dedicated to ensuring voters are presented with clear and accurate information as they consider this important measure.\u201d<\/span><\/p>\n<p>Tori Schafer, Director of Policy and Campaigns at the ACLU of Missouri, said the language remains \u201cpurposefully misleading and inaccurate.\u201d<\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"M4fdJSWJYL\">\n<p><a href=\"https:\/\/missouriindependent.com\/2025\/09\/24\/judge-rules-unconstitutional-law-missouri-attorney-general-special-appeal-power\/\">\u2018A fundamental right\u2019: Judge strikes down law giving Missouri AG special appeal power<\/a><\/p>\n<\/blockquote>\n<p><span>Green also told Hoskins to rewrite the \u201cfair ballot language\u201d summary posted to the secretary of state\u2019s website, calling the old language misleading for also failing to state abortion would be banned in most cases.<\/span><\/p>\n<p><span>Hoskins\u2019 new summary states that a \u201cyes\u201d vote would guarantee women\u2019s medical care under specific scenarios, including ectopic pregnancies and miscarriages and allow abortions in the first 12 weeks festation in cases of rape or incest.
