{"id":4983,"date":"2025-09-16T10:42:58","date_gmt":"2025-09-16T15:42:58","guid":{"rendered":"https:\/\/westplexnews.com\/index.php\/2025\/09\/16\/appeals-court-says-trump-cant-remove-federal-reserves-lisa-cook-2\/"},"modified":"2025-09-16T10:42:58","modified_gmt":"2025-09-16T15:42:58","slug":"appeals-court-says-trump-cant-remove-federal-reserves-lisa-cook-2","status":"publish","type":"post","link":"https:\/\/westplexnews.com\/index.php\/2025\/09\/16\/appeals-court-says-trump-cant-remove-federal-reserves-lisa-cook-2\/","title":{"rendered":"Appeals court says Trump can\u2019t remove Federal Reserve\u2019s Lisa Cook"},"content":{"rendered":"<p dir=\"ltr\">WASHINGTON \u2014 An appeals court late Monday rejected the Trump administration\u2019s request to move ahead with firing Federal Reserve board member Lisa Cook, as the president tries to pressure the independent board to lower interest rates.\u00a0<\/p>\n<p dir=\"ltr\"><a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cadc.42372\/gov.uscourts.cadc.42372.01208775757.0.pdf\" target=\"_blank\">The 2-1 decision<\/a> will allow Cook to partake in Tuesday\u2019s Federal Reserve meeting, where the board will vote on whether to adjust interest rates.\u00a0<\/p>\n<p dir=\"ltr\">The Trump administration is likely to appeal the decision to the Supreme Court.\u00a0<\/p>\n<p dir=\"ltr\">If Trump is successful in removing Cook and is able to nominate a replacement, he could have a majority of Fed members who are aligned with his desire to lower interest rates to boost the economy.<\/p>\n<h4>Trump nominee approved<\/h4>\n<p dir=\"ltr\">Cook, appointed by former President Joe Biden, is the first Black woman appointed to the Fed, and she has consistently voted against lowering interest rates since joining the board in 2022. Her term ends in 2038.\u00a0<\/p>\n<p dir=\"ltr\">Late Monday, the U.S. Senate also approved Trump\u2019s nominee for an open spot at the Fed,\u00a0Stephen Miran, in a\u00a0<a href=\"https:\/\/www.senate.gov\/legislative\/LIS\/roll_call_votes\/vote1191\/vote_119_1_00519.htm\" target=\"_blank\">48-47 vote.<\/a><\/p>\n<p dir=\"ltr\">While the Fed is an independent agency, Miran will continue to serve as the head of the White House\u2019s Council of Economic Advisers.<\/p>\n<p dir=\"ltr\">In a social media post Monday, the president called out Federal Reserve Chair Jerome Powell, and pressed that he \u201cMUST CUT INTEREST RATES, NOW, AND BIGGER THAN HE HAD IN MIND. HOUSING WILL SOAR!!!.\u201d<\/p>\n<h4>Appeals court splits<\/h4>\n<p dir=\"ltr\">In the appeals court decision on Cook, D.C. Circuit Judge Gregory G. Katsas, whom Trump appointed in 2017, split with Judges\u00a0J. Michelle\u00a0Childs and Bradley N. Garcia, both appointed by Biden.<\/p>\n<p dir=\"ltr\"><a href=\"https:\/\/www.newsfromthestates.com\/article\/trump-appeals-ruling-keeps-fed-member-he-tried-fire-board-now\" target=\"_blank\">Last week\u00a0<\/a>a federal judge ruled to keep Cook in her position, determining that Trump administration allegations of mortgage fraud lacked evidence and did not meet the threshold for removing Cook under \u201cjust cause.\u201d<\/p>\n<p dir=\"ltr\">Katsas agreed with the Trump administration\u2019s argument that the president has the right to remove a Fed member for \u201cjust cause.\u201d\u00a0<\/p>\n<p dir=\"ltr\">\u201cThis broad definition \u2018give[s] the President more removal authority than other removal provisions\u2019 imposed by Congress or reviewed by the Supreme Court,\u201d Katsas wrote in his dissent.\u00a0<\/p>\n<p dir=\"ltr\">Childs and Garcia did not address the \u201cjust cause\u201d argument but said the lack of due process Cook received in her removal warranted blocking Trump\u2019s attempt to fire her.\u00a0\u00a0<\/p>\n<p dir=\"ltr\">\u201cBecause Cook\u2019s due process claim is very likely meritorious, there is no need to address the meaning of \u2018for cause\u2019 in the Federal Reserve Act in this emergency posture,\u201d the majority wrote in the opinion.<\/p>\n<p>A Trump official referred Cook to the Department of Justice, accusing her of improperly filing paperwork about her residence that allowed her to get a more favorable mortgage rate.
