{"id":4757,"date":"2025-09-09T16:16:17","date_gmt":"2025-09-09T21:16:17","guid":{"rendered":"https:\/\/westplexnews.com\/index.php\/2025\/09\/09\/new-initiative-petition-would-regulate-missouri-marijuana-hemp-products-the-same-as-alcohol-2\/"},"modified":"2025-09-09T16:16:17","modified_gmt":"2025-09-09T21:16:17","slug":"new-initiative-petition-would-regulate-missouri-marijuana-hemp-products-the-same-as-alcohol-2","status":"publish","type":"post","link":"https:\/\/westplexnews.com\/index.php\/2025\/09\/09\/new-initiative-petition-would-regulate-missouri-marijuana-hemp-products-the-same-as-alcohol-2\/","title":{"rendered":"New initiative petition would regulate Missouri marijuana, hemp products the same as alcohol"},"content":{"rendered":"<p><img decoding=\"async\" width=\"1024\" height=\"614\" src=\"https:\/\/missouriindependent.com\/wp-content\/uploads\/2025\/07\/Total-Wine-THC-infused-3-e1754506477718-1024x614.jpeg\" class=\"attachment-large size-large wp-post-image\" alt=\"\" loading=\"lazy\" \/><\/p>\n<p>Hemp-derived THC beverages like these Mighty Kind THC seltzers can be found at Total Wine and other large liquor stores throughout Missouri (photo submitted).<\/p>\n<p><span>A coalition of Missouri hemp business leaders and advocates formally filed four initiative petitions Tuesday that would ask voters to allow marijuana and intoxicating hemp products to be sold in the same stores as alcohol and tobacco.<\/span><\/p>\n<p><span>The goal of the effort, led by Kansas-City-based hemp business American Shaman, is to repeal the 41-page constitutional amendment that legalized recreational marijuana in 2022.\u00a0<\/span><\/p>\n<p><span>Each version of the proposed initiative petition would replace the marijuana legalization amendment with language that instructs Missouri lawmakers to create regulations that are \u201cno more burdensome than what we already have for alcohol and tobacco,\u201d said Eapen Thampy, a longtime hemp lobbyist.<\/span><\/p>\n<p><span>\u201cMarijuana and hemp are one plant,\u201d Thampy said in an interview Tuesday. \u201cThey should be regulated in the same way. It should be a free, fair and regulated market.\u201d<\/span><\/p>\n<p><span>The effort is being organized under a new political action committee called <\/span><a href=\"https:\/\/mec.mo.gov\/MEC\/Campaign_Finance\/CommInfo.aspx?MECID=C253534#gsc.tab=0\" target=\"_blank\"><span>Missourians for a Single Market<\/span><\/a><span>.<\/span><\/p>\n<p><span>The four petitions differ slightly, but they each would take out criminal offenses for possessing too much marijuana. They\u2019d also retain the current taxes on the products for at least the next 10 years, and allow businesses to obtain licenses to sell the products through a similar process as they do with alcohol and tobacco products.\u00a0<\/span><\/p>\n<p><span>Currently marijuana facility licenses are limited and highly regulated, but businesses don\u2019t need a license to sell intoxicating hemp products \u2014 despite numerous legislative attempts to outright ban them.\u00a0<\/span><\/p>\n<p><span>\u201cLegislative efforts to ban hemp products allow the illegal market to flourish,\u201d said Gary Wiegert, a retired St. Louis City police sergeant, in the group\u2019s Tuesday press release announcing the initiative petition campaign. \u201cRegulating these products and preserving legal access to the market ensures public safety by allowing business owners to serve the consumer market instead.\u201d<\/span><\/p>\n<figure class=\"wp-caption aligncenter\"><img decoding=\"async\" loading=\"lazy\" class=\"size-full wp-image-27023\" src=\"https:\/\/missouriindependent.com\/wp-content\/uploads\/2025\/09\/Hemp-IP.jpg\" alt=\"\" width=\"1536\" height=\"1150\" \/><figcaption class=\"wp-caption-text\"><em>Hemp lobbyist Eapen Thampy and Deb Nash of Canna Answers filed four initiative petitions on hemp and marijuana regulations on Tuesday with the Missouri Secretary of State\u2019s Office in Jefferson City (photo submitted).<\/em><\/figcaption><\/figure>\n<p><span>In many ways, it\u2019s the latest showdown between the marijuana industry, which has operated legally in Missouri since 2018 but is still outlawed federally,\u00a0 and the hemp industry, whose products were legalized by the 2018 Farm Bill.<\/span><\/p>\n<p><span>At the end of the day, what\u2019s the difference between intoxicating hemp products and intoxicating marijuana products?<\/span><\/p>\n<p><span>Hemp and marijuana are essentially terms the government uses to distinguish between the part of the cannabis plant that has high amounts of THC, or their psychoactive component.<\/span><\/p>\n<p><span>Any part of the plant containing 0.3% or less THC by dry weight is defined as hemp. And that\u2019s why in 2018 Congress removed hemp and hemp seeds from the Drug Enforcement Administration\u2019s schedule of controlled substances as part of the Farm Bill.<\/span><\/p>\n<p><span>Cannabis buds \u2013 or what the industry calls \u201cflower\u201d \u2013 must be smoked or heated to release Delta-9 THC that produces a high.\u00a0<\/span><\/p>\n<p><span>So eating most raw cannabis flower shouldn\u2019t get someone high.<\/span><\/p>\n<p><span>There is a growing legal argument that marijuana sold in dispensaries that doesn\u2019t contain .3% Delta-9 THC before it\u2019s smoked or heated is actually hemp.<\/span><\/p>\n<p><span>Currently, a number of Missouri cannabis events \u2013 where people are selling weed outside of dispensaries \u2013 are operating under this interpretation of the federal definition.<\/span><\/p>\n<p><span>The initiative petitions filed Tuesday support this interpretation.\u00a0<\/span><\/p>\n<p><span>The effort also aims to regulate products, such as edibles, beverages and vapes, that are currently being sold in gas stations and stores without any testing or tracking requirements. The lack of state regulation has led some <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/07\/14\/war-between-intoxicating-hemp-and-marijuana-industries-resumes-in-st-louis\/\"><span>municipal governments<\/span><\/a><span> to try and find a way to regulate them through city health departments.\u00a0<\/span><\/p>\n<p><span>\u201cOur position is that marijuana legalization has always been not about getting \u2018high\u2019 but to end prohibition against one of the most beneficial plants on earth,\u201d said Tim Gilio, founder of the Missouri Marijuana Legalization Movement. \u201cOur goal is to open up a free and open market to all and prevent a monopoly from encroaching on any benefits of the cannabis plant.\u201d<\/span><\/p>\n<p><span>However, Andrew Mullins, executive director for the Missouri Cannabis Trade Association, told The Independent in June that the idea is a \u201cbait and switch.\u201d\u00a0<\/span><\/p>\n<p><span>The state\u2019s regulated marijuana industry, he said, generated $241 million in state and local tax revenues last year alone and is regarded as one of the most successful marijuana programs in the country, citing a <\/span><a href=\"https:\/\/www.wsj.com\/us-news\/missouri-cannabis-market-business-34dd47ad?mod=e2tw&amp;gaa_at=eafs&amp;gaa_n=ASWzDAi6PE3BQERvbb-fuJyCT3TUHPqzyDmZaOBA7z2p4IrJNE448pqQQlOJuYZuLnI%3D&amp;gaa_sig=589hKhzJJ83VibbJThKqws5L0tFMC4cfGLVI7iP9s6rCqnTgzMAFY3xKdfW3eaoC4-voDJHOVTTiObvrNWiHgw%3D%3D&amp;gaa_ts=68507e7e\" target=\"_blank\"><span>Wall Street Journal article<\/span><\/a><span>. At a <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/09\/05\/missouri-cannabis-sales-remain-steady-as-new-products-emerge\/\"><span>marijuana industry conference <\/span><\/a><span>last week, company leaders agreed that limited licenses for dispensaries and grow facilities was key to Missouri\u2019s success.\u00a0<\/span><\/p>\n<p><span>Voters have twice voted for cannabis regulation, Mullins said in June, and any effort to roll back those constitutional protections would be a \u201cspectacular failure.\u201d<\/span><\/p>\n<p><span>\u201cMissourians aren\u2019t about to take hundreds of millions away from local communities, veterans and our justice system, all in hopes that politicians will eventually replace it with something down the road,\u201d Mullins said.\u00a0\u00a0<\/span><\/p>\n<p><span>Thampy said that tax revenue wouldn\u2019t go away. The taxable market would increase by about a third, he said, \u201cmeaning tens of millions in new revenue for public defenders, substance abuse prevention, and the Missouri Veterans Commission.\u201d<\/span><\/p>\n<p><span>The petitions were filed with the Missouri Secretary of State on Tuesday afternoon.
