(Photo by Mario Tama\/Getty Images.)<\/p>\n<p dir=\"ltr\">WASHINGTON \u2014 The U.S. Supreme Court on Monday lifted a lower court\u2019s ban on immigration agents\u2019 racial profiling of Latinos in Southern California, backing President Donald Trump\u2019s immigration crackdown.<\/p>\n<p dir=\"ltr\"><a href=\"https:\/\/www.supremecourt.gov\/docket\/docketfiles\/html\/public\/25a169.html\" target=\"_blank\">The order<\/a> is temporary as\u00a0<a href=\"https:\/\/www.supremecourt.gov\/docket\/docketfiles\/html\/public\/25a169.html\" target=\"_blank\">the suit<\/a> continues in lower courts, but it indicates a majority of the court is likely to side with the Trump administration\u2019s defense against a complaint that targeting Latino and Spanish-speaking workers for immigration enforcement violated the U.S. Constitution\u2019s Fourth Amendment that bars unreasonable search and seizure.<\/p>\n<p dir=\"ltr\">The high court ruled that the officers could use \u201capparent ethnicity\u201d as one factor in determining reasonable suspicion, as long as it is not the only factor.<\/p>\n<p dir=\"ltr\">\u201cWhether an officer has reasonable suspicion depends on the totality of the circumstances,\u201d Justice Brett Kavanaugh wrote for the majority.<\/p>\n<p dir=\"ltr\">\u201cHere, those circumstances include: that there is an extremely high number and percentage of illegal immigrants in the Los Angeles area; that those individuals tend to gather in certain locations to seek daily work; that those individuals often work in certain kinds of jobs, such as day labor, landscaping, agriculture, and construction, that do not require paperwork and are therefore especially attractive to illegal immigrants; and that many of those illegally in the Los Angeles area come from Mexico or Central America and do not speak much English,\u201d he continued.<\/p>\n<p dir=\"ltr\">Justice Sonia Sotomayor, the first Latin American member of the court, wrote a scathing dissent that the two other liberal justices, Elena Kagan and Ketanji Brown Jackson, joined.<\/p>\n<p dir=\"ltr\">\u201cWe should not have to live in a country where the Government can seize anyone who looks Latino, speaks Spanish, and appears to work a low wage job,\u201d\u00a0Sotomayor wrote.\u00a0<\/p>\n<p dir=\"ltr\">Los Angeles Mayor Karen Bass also slammed Monday\u2019s decision from the Supreme Court.\u00a0<\/p>\n<p dir=\"ltr\">\u201cToday, the highest court in the country ruled that the White House and masked federal agents can racially profile Angelenos with no due process, snatch them off the street with no evidence or warrant, and take them away with no explanation,\u201d she said in a statement. \u201cThis decision will lead to more working families being torn apart and fear of the very institutions meant to protect \u2013 not persecute \u2013 our people.\u201d\u00a0<\/p>\n<p dir=\"ltr\">California Gov. Gavin Newsom said in a statement that the decision from the high court will cause \u201cracial terror in Los Angeles.\u201d\u00a0<\/p>\n<p dir=\"ltr\">\u201cTrump\u2019s private police force now has a green light to come after your family \u2014 and every person is now a target \u2014 but we will continue fighting these abhorrent attacks on Californians,\u201d Newsom, a Democrat, said.<\/p>\n<h4>Temporary ruling<\/h4>\n<p dir=\"ltr\">The ruling responded to an emergency appeal the administration made to the court last month, seeking to put on hold a temporary restraining order from Central California\u00a0U.S. District Judge Maame Ewusi-Mensah Frimpong.\u00a0<\/p>\n<p dir=\"ltr\">The case in the lower court is ongoing.<\/p>\n<p dir=\"ltr\">The lower court blocked immigration agents from using \u201capparent ethnicity\u201d as a method for determining if an individual violated immigration law.\u00a0<\/p>\n<p dir=\"ltr\">Agents used a broad variety of factors to determine someone\u2019s apparent ethnicity, including speaking Spanish or accented English, certain types of work and locations such as bus stops or car washes.<\/p>\n<p dir=\"ltr\">Kavanaugh also said that the civil rights groups and individuals targeted by immigration agents who brought the suit against the Department of Homeland Security lacked legal standing for the challenge \u201cto seek a broad injunction restricting immigration officers from making these investigative stops.\u201d<\/p>\n<h4>\u2018Fair game to be seized at any time\u2019<\/h4>\n<p dir=\"ltr\">Sotomayor penned the dissent, criticizing Monday\u2019s order for violating Fourth Amendment rights and allowing Latinos to be racially profiled.<\/p>\n<p dir=\"ltr\">\u201cThe Government, and now the concurrence, has all but declared that all Latinos, U. S. citizens or not, who work low wage jobs are fair game to be seized at any time, taken away from work, and held until they provide proof of their legal status to the agents\u2019 satisfaction,\u201d she continued.\u00a0<\/p>\n<p dir=\"ltr\">And she questioned Kavanaugh\u2019s assumption that anyone who is a U.S. citizen and is questioned by an immigration officer will simply be let go once their citizenship is explained.<\/p>\n<p dir=\"ltr\">\u201cThat blinks reality,\u201d she wrote, noting that two U.S. citizen plaintiffs in the suit tried to explain their citizenship status to an immigration officer.\u00a0<\/p>\n<p dir=\"ltr\">\u201cOne was then pushed against a fence with his arms twisted behind his back, and the other was taken away from his job to a warehouse for further questioning,\u201d she wrote.\u00a0<\/p>\n<p dir=\"ltr\">Sotomayor said the decision would create a second-class citizen status and require people to carry around proof of citizenship or legal status.<\/p>\n<p dir=\"ltr\">She added that the Fourth Amendment \u201cprohibits exactly what the Government is attempting to do here: seize individuals based solely on a set of facts that \u2018describe[s] a very large category of presumably innocent\u2019 people.\u201d<\/p>\n<p dir=\"ltr\">\u201cThe Fourth Amendment protects every individual\u2019s constitutional right to be \u2018free from arbitrary interference by law officers,\u2019\u201d she wrote. \u201cAfter today, that may no longer be true for those who happen to look a certain way, speak a certain way, and appear to work a certain type of legitimate job that pays very little.\u201d<\/p>\n<h4>National Guard responds to protests over tactics<\/h4>\n<p dir=\"ltr\">The administration\u2019s mass raids this summer on Los Angeles-area Home Depot stores and other sites where day laborers gather sparked massive protests in the city that were the basis of National Guard troops and U.S. Marines deploying to the city, over Newsom\u2019s objection.\u00a0<\/p>\n<p dir=\"ltr\">A federal judge last week said the military members\u2019 conduct\u00a0<a href=\"https:\/\/www.newsfromthestates.com\/article\/judge-warns-national-police-force-ruling-trump-broke-law-sending-guard-la\" target=\"_blank\">violated<\/a> a law against military personnel conducting domestic law enforcement.<\/p>\n<p dir=\"ltr\">The president has also deployed the National Guard of the District of Columbia and has directed thousands of federal law enforcement officers to\u00a0<a href=\"https:\/\/www.newsfromthestates.com\/article\/immigration-crackdown-intensifies-dc-under-trump-order-federal-control\" target=\"_blank\">set up checkpoints\u00a0<\/a>in the city to inquire about immigration status.\u00a0<\/p>\n<p dir=\"ltr\"><a href=\"https:\/\/www.newsfromthestates.com\/article\/protesters-dc-flood-streets-demanding-end-trumps-military-deployment\" target=\"_blank\">Thousands in the district on Saturday<\/a> protested the deployment.\u00a0<\/p>\n<h4>Further deployments?<\/h4>\n<p dir=\"ltr\">The president\u00a0<a href=\"https:\/\/www.newsfromthestates.com\/article\/trump-speculates-new-orleans-next-he-weighs-national-guard-expansion\" target=\"_blank\">has threatened<\/a> to send National Guard members to more predominantly Democratic cities such as Baltimore, Chicago, New Orleans, New York, and\u00a0<a href=\"https:\/\/www.newsfromthestates.com\/article\/trump-floats-portland-oregon-next-national-guard-deployment\" target=\"_blank\">Portland, Oregon<\/a>. He has said those deployments would\u00a0 help contain crime \u2014 despite violent crime in those cities decreasing in recent years \u2014 while also highlighting immigration enforcement.<\/p>\n<p dir=\"ltr\">Trump over the weekend posted an artificial intelligence-generated image that referenced the Vietnam War film \u201cApocalypse Now.\u201d\u00a0<\/p>\n<p dir=\"ltr\">The image is of Trump in a military uniform in front of the Chicago skyline with flames in the background.\u00a0<\/p>\n<p dir=\"ltr\">The caption read: \u201cI love the smell of deportations in the morning\u2026 Chicago about to find out why it\u2019s called the Department of WAR,\u201d referring to the new secondary name Trump\u00a0<a href=\"https:\/\/www.newsfromthestates.com\/article\/trump-signs-order-change-name-department-defense-department-war\" target=\"_blank\">gave<\/a> the Defense Department on Friday.\u00a0<\/p>\n<p dir=\"ltr\">Speaking at an event at the Museum of the Bible in Washington, D.C., Monday morning, Trump said that he \u201cwould love to go into Chicago\u201d but was waiting on a request from Illinois Gov. J.B. Pritzker before he sent troops there.
