Ed Lewis, a Republican from Moberly, presents his proposal to require majorities in every congressional district to vote in favor of proposals put on the ballot by initiative petition in order for them to pass  (Tim Bommel\/Missouri House Communications).<\/p>\n<p><span>A <\/span><a href=\"https:\/\/house.mo.gov\/Bill.aspx?bill=HJR3&amp;year=2025&amp;code=S2\" target=\"_blank\"><span>proposal<\/span><\/a><span> that would make it virtually impossible for voters to change the constitution or state law through the initiative petition process cleared a Missouri House committee Thursday evening.<\/span><\/p>\n<p><span>The legislation sponsored by state Rep. Ed Lewis, a Republican from Moberly, largely mirrors <\/span><a href=\"https:\/\/governor.mo.gov\/press-releases\/archive\/governor-kehoe-announces-special-session-congressional-redistricting-and\" target=\"_blank\"><span>a request from Gov. Mike Kehoe<\/span><\/a> <span>to require a majority of voters in all of Missouri\u2019s eight congressional districts and a statewide majority in order to pass a constitutional amendment or state law on the ballot. <\/span><\/p>\n<p><span>This means a very small percentage of statewide voters in just one district could defeat a ballot measure and it would only apply to citizen-led initiatives, not those placed on the ballot by the legislature. <\/span><span>Based on <\/span><a href=\"https:\/\/www.sos.mo.gov\/CMSImages\/Elections\/Petitions\/MakeYourVoiceHeard_02.07.2025.pdf\" target=\"_blank\"><span>last year\u2019s general election<\/span><\/a><span>, where 2,960,266 votes were cast for governor and only 311,915 in the 1st District, under the proposed change only 156,000 voters could defeat ballot question \u2014 or just shy of 5.3% of the statewide vote.<\/span><\/p>\n<p><span>If approved by lawmakers, the proposed constitutional amendment debated Thursday would go on the statewide ballot and require a simple majority to be enacted.<\/span><\/p>\n<p><span>Missouri is one of <\/span><a href=\"https:\/\/www.ncsl.org\/elections-and-campaigns\/initiative-and-referendum-processes\" target=\"_blank\"><span>24 states<\/span><\/a><span> that allows citizen initiative petitions. They can be used to either amend the constitution or change state law, though the path to successfully doing so is often <\/span><a href=\"https:\/\/missouriindependent.com\/2023\/12\/05\/missouri-abortion-2024-initiative-petition-ballot\/\"><span>arduous and expensive<\/span><\/a><span>, requiring tens of thousands of signatures to even land on the ballot.\u00a0<\/span><\/p>\n<p><span>In the past few years alone, a majority of Missourians voted to legalize abortion and recreational marijuana and to increase minimum wage and mandate paid sick leave through the initiative petition process, all issues opposed by the Republican-dominated legislature.\u00a0<\/span><\/p>\n<p><span>These ballot measures, Lewis said, compelled him to sponsor legislation raising the threshold for passing initiative petitions. He pointed specifically to a 2022 amendment legalizing recreational marijuana use.<\/span><\/p>\n<p><span>\u201cThe voices of those voters in less populated counties were not heard and were overwhelmed by the few heavily populated counties,\u201d he said.<\/span><\/p>\n<p><span>Lewis also criticized a constitutional amendment passed last November that overturned Missouri\u2019s abortion ban.\u00a0<\/span><\/p>\n<p><span>\u201cThis (abortion) amendment didn\u2019t pass in most areas in Missouri, and I believe, would not have passed in even half of the congressional districts,\u201d he said.<\/span><\/p>\n<p><span>Last November, the <\/span><a href=\"https:\/\/missouriindependent.com\/2024\/11\/05\/missouri-voters-overturn-states-near-total-abortion-ban\/\"><span>abortion rights amendment won<\/span><\/a><span> with just shy of <\/span><a href=\"https:\/\/apnews.com\/projects\/election-results-2024\/missouri\/?r=83071\" target=\"_blank\"><span>52% of the vote<\/span><\/a><span> by drawing support from the state\u2019s urban and more populous areas. Voters in all but eight of Missouri\u2019s 115 counties opposed the amendment.<\/span><\/p>\n<p><span>Lewis said the current process disenfranchises rural Missouri because it doesn\u2019t require \u201cbroad geographic support.\u201d\u00a0<\/span><\/p>\n<p><span>\u201cEvery last inch of the state of Missouri needs to be represented when we\u2019re changing the constitution,\u201d he said.<\/span><\/p>\n<p><span>State lawmakers are considering the resolution <\/span><a href=\"https:\/\/missouriindependent.com\/briefs\/missouri-lawmakers-begin-work-on-trump-backed-congressional-redistricting-plan\/\"><span>alongside a proposal to gerrymander the state\u2019s congressional districts<\/span><\/a><span>.<\/span><\/p>\n<p><span>State Rep. Eric Woods, a Kansas City Democrat, said the two issues could not be \u201cdecoupled.\u201d<\/span><\/p>\n<p><span>\u201cIf your concern is that certain underpopulated or rural parts of the state don\u2019t have a voice and are using congressional districts as a (corrective) measure,\u201d he said. \u201cIf that is important for a ballot measure, how does that argument fly when we\u2019re about to pass a map joining downtown Kansas City to rural Webster County 200 miles away.\u201d<\/span><\/p>\n<figure class=\"wp-caption aligncenter\"><a href=\"https:\/\/missouriindependent.com\/tyson-smith-initiative-petition-090425\/\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-26967 size-full\" src=\"https:\/\/missouriindependent.com\/wp-content\/uploads\/2025\/09\/Tyson-Smith-initiative-petition-090425-scaled.jpeg\" alt=\"\" width=\"2560\" height=\"1707\" \/><\/a><figcaption class=\"wp-caption-text\"><em>State Rep. David Tyson Smith, a Democrat from Columbia, said the changes to the initiative petition process would remove a pathway for Missourians to remedy redistricting they believe is unfair.<\/span><\/p>\n<p><span>A slew of initiative petitions have been approved for circulation this year ahead of the 2026 General Election. Many <\/span><a href=\"https:\/\/www.sos.mo.gov\/petitions\/2026IPcirculation\" target=\"_blank\"><span>focus on preserving the current initiative petition process.<\/span><\/a><\/p>\n<p><span>The state\u2019s initiative petition process has been in place since 1908, when it was approved by a majority of voters.<\/span><\/p>\n<p><span>\u201cThis whole special session is insidious,\u201d Smith said. \u201cBecause it is not just about the initiative process, it\u2019s also about redistricting\u2026 The two go hand in hand.\u201d<\/span><\/p>\n<p><span>Lewis said he didn\u2019t believe the two are \u201clinked.\u201d<\/span><\/p>\n<p><span>His legislation also seeks to bar ballot measure campaigns from accepting contributions from citizens of countries deemed \u201cforeign adversaries\u201d of the United States. Kehoe\u2019s request called for banning contributions from \u201cforeign nationals.\u201d<\/span><\/p>\n<p><span>\u201cFor far too long, Missouri\u2019s Constitution has been the victim of out-of-state special interests who deceive voters to pass out-of-touch policies,\u201d Kehoe said in a statement last week. \u201cIt\u2019s time we give voters a chance to protect our Constitution.\u201d<\/span><\/p>\n<p><span>This year, Kehoe signed into law \u200b\u200ba <\/span><a href=\"https:\/\/www.senate.mo.gov\/25info\/BTS_Web\/Bill.aspx?SessionType=R&amp;BillID=330\" target=\"_blank\"><span>restriction on foreign spending on state ballot measures.<\/span><\/a><\/p>\n<p><span>Smith said the inclusion of proposals seeking to ban things that are already illegal is simply \u201cballot candy\u201d seeking to deceive voters.\u00a0<\/span><\/p>\n<p><span>\u201cWe are going to load this up with all this other stuff as a charade to trick people because no one is going to vote for this resolution if they knew exactly what it is going to be,\u201d Smith said.<\/span><\/p>\n<p><span>Lewis rejected that claim, saying contributions from foreign adversaries were not yet illegal when he began sponsoring initiative-petition reform legislation.<\/span><\/p>\n<p>        <a href=\"https:\/\/missouriindependent.com\/subscribe\"><\/a><\/p>\n<div class=\"subscribeShortcodeContainer\">\n<div class=\"subscribeTextContainer\">\n                <i class=\"fas fa-envelope\"><\/i>\n<p>GET THE MORNING HEADLINES.<\/p>\n<\/div>\n<div class=\"subscribeButtonContainer\">\n                <button>SUBSCRIBE<\/button>\n            <\/div>\n<\/div>\n<p>        <\/p>\n<p><span>Republican members of the committee suggested Lewis amend the proposal to ban all foreign contributions, mirroring Kehoe\u2019s request.<\/span><\/p>\n<p><span>The state of Kansas recently passed a law to ban foreign contributions to initiative petition campaigns. The law was <\/span><a href=\"https:\/\/kansasreflector.com\/2025\/07\/01\/judge-allows-kansas-law-barring-foreign-contributions-to-constitutional-amendment-campaigns\/\" target=\"_blank\"><span>affirmed by a federal judge<\/span><\/a><span> in July.<\/span><\/p>\n<p><span>Lewis, when asked about foreign spending in Missouri, could not give an in-state example.<\/span><\/p>\n<p><span>The citizen-led campaign to legalize abortion in Missouri, known as Missourians for Constitutional Freedom, raised more than $30 million last year. <\/span><a href=\"https:\/\/missouriindependent.com\/2024\/10\/30\/missouri-anti-abortion-pac-donation-leonard-leo-amendment-3\/\"><span>This included millions of dollars from U.S.-based liberal groups<\/span><\/a><span> known as dark money organizations because they don\u2019t disclose their donors. A dark money group was also <\/span><a href=\"https:\/\/missouriindependent.com\/2024\/10\/30\/missouri-anti-abortion-pac-donation-leonard-leo-amendment-3\/\"><span>among the main contributors to the anti-abortion movement,<\/span><\/a><span> which ultimately raised far less money.<\/span><\/p>\n<p><span>Lewis\u2019 proposal would also require a public hearing before an initiative petition is placed on the ballot and that the full text of the ballot measure be on display at polling places.<\/span><\/p>\n<p><span>Another provision would create a criminal election offense for anyone who fraudulently signs or gathers signatures for an initiative petition. This includes those who sign initiative petitions while knowingly not being a registered voter and would charge them with a class-A misdemeanor.<\/span><\/p>\n<p><span>Smith called the provision \u201cridiculous.\u201d It \u201cdoesn\u2019t make any sense,\u201d he said, because corporations could break the law and lack an individual for the charge.<\/span><\/p>\n<p><span>Lewis said he was open to changes to improve the legislation.<\/span><\/p>\n<p><span>\u201cThe only way to make this bill better is to burn it,\u201d Smith said, with applause from hearing attendees.<\/span><\/p>\n<p><span>A majority of those who testified spoke in opposition to the proposal, with many calling out a perceived \u201cdouble standard\u201d between voter-led ballot measures and those placed on the ballot by lawmakers.<\/span><\/p>\n<p><span>\u201cThe most offensive part of (the resolution) is the fact that it creates a double standard when you continue to let the legislature place things on the ballot that will be ratified with a simple majority vote,\u201d Ron Calzone, an activist and executive director of Missouri First, told the committee. \u201cThat is a shift of power to the government. That\u2019s not a Republican thing either. That\u2019s not a conservative thing either.\u201d<\/span><\/p>\n<figure class=\"wp-caption aligncenter\"><a href=\"https:\/\/missouriindependent.com\/032625_righttolifesusanklein\/\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-24577 size-full\" src=\"https:\/\/missouriindependent.com\/wp-content\/uploads\/2025\/03\/032625_RighttoLifeSusanKlein-scaled.jpg\" alt=\"\" width=\"2560\" height=\"1536\" \/><\/a><figcaption class=\"wp-caption-text\"><em>Susan Klein, executive director of Missouri Right to Life, hosts a rally in the Missouri State Capitol rotunda in March (Annelise Hanshaw\/Missouri Independent).<\/em><\/figcaption><\/figure>\n<p><span>Opponents who testified Thursday included people who have gathered signatures for recent ballot-measure campaigns and groups involved in recent initiative petitions.<\/span><\/p>\n<p><span>Truman Oaks, a 19-year-old Columbia resident who gathered signatures for a ballot measure last year, said the proposal would set an unfair standard for citizen-led petitions.<\/span><\/p>\n<p><span>\u201cIf this joint resolution passes, it is the end of the petition process, though not formally,\u201d he said. \u201cI speak for myself and so many other people I know that have been involved in this work in saying that maybe there is a one in 100 chance we win all eight districts.\u201d<\/span><\/p>\n<p><span>Susan Klein, executive director of anti-abortion group Missouri Right to Life, said the proposal would safeguard the State Constitution from \u201cone or two districts that are making the rest of us live by constitution (changes).\u201d<\/span><\/p>\n<p><span>State Rep. Keri Ingle, a Lee\u2019s Summit Democrat, asked whether Klein would support the stricter standards for an <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/05\/14\/missouri-republicans-shut-down-senate-debate-to-pass-abortion-ban-repeal-sick-leave-law\/\"><span>upcoming anti-abortion ballot measure proposed by lawmakers<\/span><\/a><span>.<\/span><\/p>\n<p><span>\u201cWould you bet that Missouri is so pro-life that it could pass by a majority in every congressional district next year, if you were to put it on the ballot by that standard?\u201d she asked.<\/span><\/p>\n<p><span>\u201cThat is not what we are here to testify on today,\u201d Klein said.<\/span><\/p>\n<p><span>The committee rejected an amendment offered by Ingle that would apply the stricter standards to resolutions placed on the ballot by state lawmakers in a party-line vote.<\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>State Rep.
