(Photo by Mario Tama\/Getty Images)\" loading=\"lazy\" \/><\/p>\n<p>California National Guard members stand guard at an entrance to the Wilshire Federal Building on June 13 in Los Angeles, California (Mario Tama\/Getty Images)<\/p>\n<p dir=\"ltr\">President Donald Trump\u2019s move to send National Guard troops and U.S. Marines to quell immigration protests in Los Angeles this summer violated a federal law against military members conducting domestic law enforcement, a federal judge in California ruled early Tuesday.<\/p>\n<p dir=\"ltr\">The ruling from Senior U.S. District Judge Charles R. Breyer represents an obstacle to any further use of National Guard troops to assist local police in more cities. Following deployments to LA and Washington, D.C., Trump has\u00a0<a href=\"https:\/\/www.newsfromthestates.com\/article\/trump-mobilizes-dc-national-guard-pledges-similar-crackdown-democratic-cities\" target=\"_blank\">openly mused<\/a> about federalizing other state National Guard troops and sending them to major cities like Chicago and Baltimore he says are overwhelmed with crime.<\/p>\n<p dir=\"ltr\">Breyer, whom Democratic President Bill Clinton appointed in 1997, said Trump could not use the National Guard for a wide array of police activities in California. His order goes into effect Sept. 12.<\/p>\n<p dir=\"ltr\">Breyer said the roughly 4,700 Guard members and Marines engaged in police activity in violation of the Posse Comitatus Act of 1878, which he said built on the constitutional framers\u2019 wariness of a centralized military force conducting police work.<\/p>\n<p dir=\"ltr\">\u201cContrary to Congress\u2019s explicit instruction, federal troops executed the laws,\u201d Breyer wrote in a\u00a0<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.450934\/gov.uscourts.cand.450934.176.0_1.pdf\" target=\"_blank\">52-page opinion<\/a>. \u201cDefendants systematically used armed soldiers (whose identity was often obscured by protective armor) and military vehicles to set up protective perimeters and traffic blockades, engage in crowd control, and otherwise demonstrate a military presence in and around Los Angeles. In short, Defendants violated the Posse Comitatus Act.\u201d<\/p>\n<h4>National Guard expanded<\/h4>\n<p dir=\"ltr\">The judge expressed concern about Trump and Defense Secretary Pete Hegseth\u2019s statements they wanted to expand the role of National Guard troops for law enforcement.<\/p>\n<p dir=\"ltr\">\u201cPresident Trump and Secretary Hegseth have stated their intention to call National Guard troops into federal service in other cities across the country\u2026 thus creating a national police force with the President as its chief,\u201d he wrote.<\/p>\n<p dir=\"ltr\">The issue itself dates much further back in U.S. history, forming part of the basis for the country\u2019s break from the English monarchy, Breyer noted.<\/p>\n<p dir=\"ltr\">\u201cIndeed, resentment of Britain\u2019s use of military troops as a police force was manifested in the Declaration of Independence, where one of the American colonists\u2019 grievances was that the King had \u2018affected to render the Military independent of and superior to the Civil power,\u2019\u201d he wrote.<\/p>\n<p dir=\"ltr\">California Gov. Gavin Newsom, a Democrat who sued to block Trump\u2019s federalization of the state\u2019s National Guard, said the ruling \u201csided with democracy and the Constitution\u201d and echoed Breyer\u2019s warning about Trump leading a national police force.<\/p>\n<p dir=\"ltr\">\u201cNo president is a king \u2014 not even Trump \u2014 and no president can trample a state\u2019s power to protect its people,\u201d Newsom said. \u201cTrump\u2019s attempt to use federal troops as his personal police force is illegal, authoritarian, and must be stopped in every courtroom across this country.\u201d<\/p>\n<p dir=\"ltr\">Los Angeles Mayor Karen Bass also cheered the decision.<\/p>\n<p dir=\"ltr\">\u201cThe White House tried to invade the second largest city in the country,\u201d she wrote. \u201cThat\u2019s illegal. Los Angeles will not buckle and we will not break. We will not be divided and we will not be defeated.\u201d<\/p>\n<p dir=\"ltr\">Spokespeople for the White House did not immediately return a message seeking comment.<\/p>\n<h4>Return to appeals court likely<\/h4>\n<p dir=\"ltr\">Trump is likely to appeal the ruling to the U.S. 9th Circuit Court of Appeals, where\u00a0<a href=\"https:\/\/www.newsfromthestates.com\/article\/vance-dispatched-la-after-trump-administration-court-victory-national-guard-case\" target=\"_blank\">he won a victory<\/a> early in the case.<\/p>\n<p dir=\"ltr\">After Breyer<a href=\"https:\/\/www.newsfromthestates.com\/article\/judge-says-trump-takeover-california-national-guard-illegal-orders-return-governor\" target=\"_blank\"> issued a temporary restraining order<\/a> in June calling on Trump to return control of the state\u2019s National Guard to Newsom, a 9th Circuit panel unanimously blocked it from going into effect, ruling that U.S. Supreme Court precedent allowed Trump to make the determination that the proper circumstances existed to federalize National Guard troops.<\/p>\n<p dir=\"ltr\">That appeals ruling dealt with Breyer\u2019s finding that Trump likely violated the president\u2019s legal authority to federalize National Guard troops.<\/p>\n<p dir=\"ltr\">The appeal did not consider potential Posse Comitatus Act violations, Breyer said Tuesday.\u00a0<\/p>","protected":false},"excerpt":{"rendered":"<p>California National Guard members stand guard at an entrance to the Wilshire Federal Building on June 13 in Los Angeles, California (Mario Tama\/Getty Images) President Donald Trump\u2019s move to send National Guard troops and U.S. Marines to quell immigration protests in Los Angeles this summer violated a federal law against military members conducting domestic law&#8230;<\/p>\n","protected":false},"author":2,"featured_media":4494,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_kadence_starter_templates_imported_post":false,"_kad_post_transparent":"","_kad_post_title":"","_kad_post_layout":"","_kad_post_sidebar_id":"","_kad_post_content_style":"","_kad_post_vertical_padding":"","_kad_post_feature":"","_kad_post_feature_position":"","_kad_post_header":false,"_kad_post_footer":false,"footnotes":""},"categories":[1],"tags":[],"class_list":["post-4493","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-uncategorized"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.2 -
