Chuck Grassley are sparring on social media over whether the Judiciary Committee chairman should abandon a century-old tradition that allows senators to block the advancement of judicial nominees who would serve in the senators\u2019 home states.<\/p>\n<p dir=\"ltr\">The practice, referred to as \u201cblue slips,\u201d has irked Trump, who has had some of his picks for the federal bench opposed by Democratic senators.\u00a0<\/p>\n<p dir=\"ltr\">Trump posted on social media over the weekend that he wanted GOP Senate leaders to move his judicial nominees through, regardless of the level of opposition from Democrats, and said Monday he would sue over the practice, which he called \u201cunconstitutional.\u201d\u00a0<\/p>\n<p dir=\"ltr\">\u201cWe\u2019re also going to be filing a lawsuit on blue slipping,\u201d he said in the Oval Office Monday morning. \u201cYou know, blue slips make it impossible for me as president to appoint a judge or a U.S. attorney, because they have a gentleman\u2019s agreement \u2014 nothing memorialized.\u201d<\/p>\n<p dir=\"ltr\">The White House comments came after Trump slammed the practice on social media over the weekend and told Grassley how to proceed.<\/p>\n<p dir=\"ltr\">\u201cI have a Constitutional Right to appoint Judges and U.S. Attorneys, but that RIGHT has been completely taken away from me in States that have just one Democrat United States Senator,\u201d Trump posted on social media.\u00a0<\/p>\n<p dir=\"ltr\">\u201cThis is because of an old and outdated \u2018custom\u2019 known as a BLUE SLIP, that Senator Chuck Grassley, of the Great State of Iowa, refuses to overturn, even though the Democrats, including Crooked Joe Biden (Twice!), have done so on numerous occasions,\u201d he added. \u201cTherefore, the only candidates that I can get confirmed for these most important positions are, believe it or not, Democrats! Chuck Grassley should allow strong Republican candidates to ascend to these very vital and powerful roles, and tell the Democrats, as they often tell us, to go to HELL!\u201d<\/p>\n<h4>Grassley won\u2019t end blue slips<\/h4>\n<p dir=\"ltr\">Grassley responded on Monday morning that he wouldn\u2019t be ending the blue slip tradition.\u00a0<\/p>\n<p dir=\"ltr\">\u201cA U.S. Atty\/district judge nominee without a blue slip does not hv the votes to get confirmed on the Senate floor &amp; they don\u2019t hv the votes to get out of cmte As chairman I set Pres Trump noms up for SUCCESS NOT FAILURE,\u201d Grassley wrote.\u00a0<\/p>\n<p dir=\"ltr\">He wrote in a separate post that Alina \u201cHabba was withdrawn as the President\u2019s nominee for New Jersey U.S. Atty on July 24 &amp;the Judic cmte never received any of the paperwork needed for the Senate to vet her nomination.\u201d\u00a0<\/p>\n<p dir=\"ltr\">A federal judge on Thursday said Habba\u00a0<a href=\"https:\/\/newjerseymonitor.com\/2025\/08\/21\/trump-pick-for-us-attorney-for-new-jersey-has-no-lawful-authority-judge-rules\/\" target=\"_blank\">has no lawful authority<\/a> to be New Jersey\u2019s acting U.S. attorney.<\/p>\n<p dir=\"ltr\">Grassley was\u00a0<a href=\"https:\/\/iowacapitaldispatch.com\/2022\/11\/08\/grassley-wins-eighth-term-in-u-s-senate\/\" target=\"_blank\">reelected in November 2022<\/a>, for a six-year term that will end in January 2029.\u00a0<\/p>\n<h4>Tradition since 1917<\/h4>\n<p dir=\"ltr\">The nonpartisan Congressional Research Service writes in a\u00a0<a href=\"https:\/\/www.congress.gov\/crs_external_products\/R\/PDF\/R44975\/R44975.9.pdf\" target=\"_blank\">report<\/a> on the process that since \u201cat least 1917, the committee\u2019s use of the blue slip has been a feature of its consideration of such nominations.\u201d<\/p>\n<p dir=\"ltr\">\u201cAfter a President selects a nominee for a U.S. circuit or district court judgeship, the chairman sends a blue-colored form to the two Senators representing the home state of the nominee,\u201d the report explains.<\/p>\n<p dir=\"ltr\">\u201cThe form seeks the home state Senators\u2019 assessment of the nominee. If a home state Senator has no objection to a nominee, the blue slip is returned to the chairman with a positive response. If, however, a home state Senator objects to a nominee, the blue slip is either withheld or returned with a negative response.
