{"id":3569,"date":"2025-08-06T13:53:05","date_gmt":"2025-08-06T18:53:05","guid":{"rendered":"https:\/\/westplexnews.com\/index.php\/2025\/08\/06\/st-louis-county-will-revisit-bill-to-regulate-intoxicating-hemp-products-in-september-2\/"},"modified":"2025-08-06T13:53:05","modified_gmt":"2025-08-06T18:53:05","slug":"st-louis-county-will-revisit-bill-to-regulate-intoxicating-hemp-products-in-september-2","status":"publish","type":"post","link":"https:\/\/westplexnews.com\/index.php\/2025\/08\/06\/st-louis-county-will-revisit-bill-to-regulate-intoxicating-hemp-products-in-september-2\/","title":{"rendered":"St. Louis County will revisit bill to regulate intoxicating hemp products in September"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"614\" src=\"https:\/\/missouriindependent.com\/wp-content\/uploads\/2025\/07\/Total-Wine-THC-infused-3-e1754506477718-1024x614.jpeg\" class=\"attachment-large size-large wp-post-image\" alt=\"\" \/><\/p>\n<p>Hemp-derived THC beverages like these Mighty Kind THC seltzers can be found at Total Wine and other large liquor stores throughout Missouri (photo submitted).<\/p>\n<p><span>A final vote on a St. Louis County bill to regulate intoxicating hemp products stalled out Tuesday night after about a dozen business owners and lobbyists opposed it at the county council meeting.<\/span><\/p>\n<p><span>The bill\u2019s sponsor, St. Louis County Councilwoman Lisa Clancy, told The Independent on Wednesday morning that she plans on revisiting the bill\u2019s language and will hold a public hearing no later than the end of September.<\/span><\/p>\n<p><span>\u201cI don\u2019t know what the final version looks like yet,\u201d Clancy said, \u201cbut I think that there\u2019s a sincere appetite from enough members on the council that recognize there\u2019s some problems that need to be addressed with this industry and some of the products on the market.\u201d<\/span><\/p>\n<p><span>In January, Clancy proposed a <\/span><a href=\"https:\/\/www.documentcloud.org\/documents\/25997307-bill-no-15-2025\/\" target=\"_blank\"><span>bill<\/span><\/a><span> to prohibit products like beverages and edibles that are often labeled as \u201chemp-derived Delta-9\u201d or \u201cDelta-8\u201d from being sold outside of marijuana dispensaries.\u00a0<\/span><\/p>\n<p><span>If enacted, the bill would effectively ban those products in Missouri\u2019s largest county.\u00a0\u00a0<\/span><\/p>\n<p><span>The county\u2019s health department would be tasked with enforcement, including seizing and destroying the products.<\/span><\/p>\n<p><span>Brian Riegel, owner of two Missouri intoxicating-hemp companies, said Tuesday that he encourages the council to regulate the products but not ban them.\u00a0\u00a0<\/span><\/p>\n<p><span>\u201cWe can maybe use this platform\u2026 to encourage the state to regulate this in the proper manner, rather than outlaw it,\u201d Riegel said. \u201cThis is going to drive a black market bigger than we\u2019ve ever seen because it\u2019s already here.\u201d<\/span><\/p>\n<p><span>For the past three years, Missouri lawmakers have attempted to pass legislation that would put hemp-derived THC products under the same regulatory framework as marijuana. The proposals were met by fierce opposition, particularly from associations representing convenience stores, hemp companies and veterans.<\/span><\/p>\n<p><span>This past spring, Republican state Sen. Nick Schroer of Defiance offered a proposal that <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/01\/22\/missouri-cannabis-trade-group-offers-compromise-in-fight-over-regulating-intoxicating-hemp\/\"><span>carved out <\/span><\/a><span>an exception for low-dose THC beverages, which have been sold in Missouri\u2019s bars and liquor stores for seven years. It still required things like high-dose gummies, THCA flower and vapes to only be sold in marijuana dispensaries.\u00a0<\/span><\/p>\n<p><span>Schroer\u2019s bill was <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/04\/10\/intoxicating-hemp-regulations-stall-in-missouri-senate-after-7-hour-filibuster\/\"><span>filibustered<\/span><\/a><span> by state Sen. Karla May and other St. Louis Democratic senators, who argued that it would create a monopoly for the marijuana industry and harm small businesses.<\/span><\/p>\n<p><span>Hemp naturally has very little THC, the intoxicating component mostly associated with marijuana. But that potency can be increased with some <\/span><a href=\"https:\/\/missouriindependent.com\/2023\/04\/14\/missouri-lawmakers-take-aim-at-unregulated-delta-8-thc-hemp-products\/\"><span>science<\/span><\/a><span>.<\/span><\/p>\n<p><span>While marijuana products must be sold in dispensaries and be grown and manufactured in state-regulated facilities, <\/span><a href=\"https:\/\/missouriindependent.com\/briefs\/with-missouri-regulations-in-flux-whats-the-difference-between-hemp-and-marijuana\/\"><span>intoxicating hemp products have been completely unregulated<\/span><\/a><span> by any governmental agency since 2018 \u2014 when Congress passed a Farm Bill that legalized hemp.<\/span><\/p>\n<p><span>The St. Louis City NAACP submitted a letter to the council stating that its members \u201cstand in <\/span><span>solidarity\u201d with May as she opposed legislation that had the same language as Clancy\u2019s.<\/span><\/p>\n<p><span>\u201cWhile we recognize efforts to promote public safety, we are gravely concerned that this bill will disproportionately impact small, often minority-owned businesses\u2014vape shops, convenience stores, and independent retailers\u2014that have legally entered the hemp market under the protections of the federal 2018 Farm Bill,\u201d the NAACP letter states.\u00a0<\/span><\/p>\n<p><span>When Clancy held the bill from going to a vote Tuesday night, she said the goal is to protect public health. But she said she understands \u201cthere\u2019s still some discussions that need to happen.\u201d<\/span><\/p>\n<p><span>She told <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/07\/14\/war-between-intoxicating-hemp-and-marijuana-industries-resumes-in-st-louis\/\"><span>The Independent last month<\/span><\/a><span> that she\u2019s most concerned about the edibles that look like candy and are sold in places children can access. Her bill doesn\u2019t ban non-intoxicating products, like CBD seltzers or lotions, she said.<\/span><\/p>\n<p><span>Several people testified Tuesday that Clancy\u2019s bill would put companies out of business. Clancy told The Independent Wednesday those allegations are \u201cunfounded.\u201d\u00a0<\/span><\/p>\n<p><span>\u201cWe don\u2019t have data to support that,\u201d she said. \u201cA lot of these companies, what they\u2019re not saying is that they\u2019ve existed long before the 2018 Farm Bill.\u201d<\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>Hemp-derived THC beverages like these Mighty Kind THC seltzers can be found at Total Wine and other large liquor stores throughout Missouri (photo submitted).
