The office didn\u2019t seem to be aware that the list was available on a <\/span><a href=\"https:\/\/mapyourtaxes.mo.gov\/MAP\/TaxCredits\/\" target=\"_blank\"><span>state-run website<\/span><\/a><span> detailing state spending.<\/span><\/p>\n<p><span>According to Internet Archive\u2019s Wayback Machine, donor information was <\/span><a href=\"https:\/\/web.archive.org\/web\/20240726070150\/https:\/\/mapyourtaxes.mo.gov\/Map\/TaxCredits\/Categories\/Default.aspx?year=2024\" target=\"_blank\"><span>wiped by the end of the month<\/span><\/a><span>.<\/span><\/p>\n<p><span>Jackson Bailey, chief of staff to Missouri Treasurer Vivek Malek, chalked the situation up to a \u201cclerical error,\u201d saying the office never intended the information to be posted in the first place.<\/span><\/p>\n<p><span>The office declined to answer further questions on the removal, including whether or not the information is available upon request.\u00a0<\/span><\/p>\n<p><span>In 2022, Missouri lawmakers <\/span><a href=\"https:\/\/missouriindependent.com\/2022\/07\/05\/new-missouri-law-shields-nonprofit-donor-identities-allow-llcs-to-give-to-candidates\/\"><span>passed a law<\/span><\/a><span> to shield nonprofits from being forced to disclose donor information. And it was quickly used to conceal public records, such as <\/span><a href=\"https:\/\/missouriindependent.com\/2023\/01\/24\/donor-privacy-law-being-used-by-missouri-agencies-to-conceal-public-records\/\"><span>then-Gov. Mike Parson redacting the names of donors and attendees<\/span><\/a><span> of his holiday gala.<\/span><\/p>\n<p><span>A year later, lawmakers approved a fix to the law <\/span><a href=\"https:\/\/missouriindependent.com\/2023\/05\/19\/changes-to-missouri-donor-privacy-law-would-restore-access-to-state-contracts\/\"><span>clarifying how it should be implemented<\/span><\/a><span>.\u00a0\u00a0<\/span><\/p>\n<p><span>Missouri\u2019s tax-credit scholarship program, called MOScholars, is set up using state-approved nonprofits. Donors apply for a tax credit through the State Treasurer\u2019s Office and donate to the nonprofits, which are called educational assistance organizations. At tax time, they are able to deduct the donation amount from their state tax obligations, so long as it\u2019s less than half of their total bill.<\/span><\/p>\n<p>        <a href=\"https:\/\/missouriindependent.com\/subscribe\"><\/a><\/p>\n<div class=\"subscribeShortcodeContainer\">\n<div class=\"subscribeTextContainer\">\n                <i class=\"fas fa-envelope\"><\/i>\n<p>GET THE MORNING HEADLINES.<\/p>\n<\/div>\n<div class=\"subscribeButtonContainer\">\n                <button>SUBSCRIBE<\/button>\n            <\/div>\n<\/div>\n<p>        <\/p>\n<p><span>Because the program is set up using private nonprofit organizations as an intermediary, the state might be barred, or at least exempt, from disclosing the donation information, according to Dave Roland, director of litigation at the Freedom Center of Missouri.<\/span><\/p>\n<p><span>Programs like MOScholars, Roland said, are \u201cspecifically designed to have the funding treated as private money rather than public money.\u201d<\/span><\/p>\n<p><span>\u201cDue to the connection to a government-created program, the government might be able to require public disclosure of the persons donating to these programs (and thus receiving the tax credits), but they are not obligated to make this information public if they don\u2019t want to,\u201d he wrote in an email.<\/span><\/p>\n<p><span>But for those wary about the MOScholars program, less transparency only makes frustrations worse.<\/span><\/p>\n<p><span>Senate Minority Leader Doug Beck, a Democrat from Affton, has been a vocal critic of MOScholars and <\/span><a href=\"https:\/\/missouriindependent.com\/2024\/04\/10\/missouri-treasurer-vivek-malek-transparency-moscholars\/\"><span>has sought clarity from program administrators<\/span><\/a><span>, including Malek. In 2024, Beck asked for \u201call the data\u201d the office had compiled on MOScholars and received a screenshot of a webpage with basic demographic information.<\/span><\/p>\n<p><span>\u201cWe should have accountability and transparency,\u201d he told The Independent. \u201cWe don\u2019t know where the money is coming from. We don\u2019t know how much money it is. How do we know it\u2019s getting where it is supposed to go?\u201d<\/span><\/p>\n<p><span>He pointed to <\/span><a href=\"https:\/\/auditor.mo.gov\/AuditReport\/CitzSummaryDirect?id=1039\" target=\"_blank\"><span>a report from the State Auditor\u2019s Office<\/span><\/a><span> released earlier this month which called out Malek\u2019s office for <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/07\/16\/missouri-auditor-says-treasurer-put-35-million-into-wrong-state-fund\/\"><span>depositing $35 million of general revenue into the wrong fund<\/span><\/a><span>.<\/span><\/p>\n<p><span>The audit also identified a lack of transparency in the administration of the MOScholars program. The treasurer\u2019s office wasn\u2019t hiring annual audits of the program as required and it missed inconsistencies in quarterly reports from educational assistance organizations.<\/span><\/p>\n<p><span>Trent Blair, director of programs in the State Treasurer\u2019s Office, told The Independent that the office has already rectified this mistake and recently hired an auditing company.<\/span><\/p>\n<p><span>The demand for more oversight of MOScholars has accelerated in recent months, with state lawmakers passing a <\/span><a href=\"https:\/\/missouriindependent.com\/2025\/06\/04\/new-funding-for-private-school-vouchers-will-set-precedent-for-future-missouri-budgets\/\"><span>$51 million direct appropriation<\/span><\/a><span> to the program.
