(McKenzie Romero\/Utah News Dispatch)<\/p>\n<p dir=\"ltr\">WASHINGTON \u2014 The U.S. Department of Justice asked a federal judge Friday to reverse course and allow the Trump administration to implement a provision in the \u201cbig, beautiful\u201d law that prevents Medicaid funding from going to Planned Parenthood for one year.<\/p>\n<p dir=\"ltr\">The request was filed just days after Judge Indira Talwani\u00a0<a href=\"https:\/\/www.newsfromthestates.com\/article\/federal-judge-quickly-rules-favor-planned-parenthood-suit-over-medicaid-funding\" target=\"_blank\" rel=\"noopener\">issued a temporary restraining order<\/a>, blocking the federal government from implementing that section of the law while the case progresses.<\/p>\n<p dir=\"ltr\">The Department of Justice\u2019s motion asks Talwani to withdraw her prior order, arguing she didn\u2019t follow procedure and should have given the government\u2019s lawyers time to respond before ruling.<\/p>\n<p dir=\"ltr\">\u201cEnjoining an Act of Congress signed by the President of the United States is among the most serious and consequential exercises of the judicial power,\u201d the DOJ filing states. \u201cIt must be exercised with caution and restraint, as the separation of powers counsels against one branch of government effectively seizing for itself the powers of the other two branches.<\/p>\n<p dir=\"ltr\">\u201cYet here, without even awaiting a response from the Government, the Court exercised that power through an extraordinary, highly unusual temporary restraining order (TRO), preventing the enforcement of duly enacted legislation approved by Congress and signed by the President barely a week ago.\u201d<\/p>\n<p dir=\"ltr\">Planned Parenthood\u2019s\u00a0<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mad.286600\/gov.uscourts.mad.286600.1.0.pdf\" target=\"_blank\" rel=\"noopener\">lawsuit<\/a>, filed in the U.S. District Court for the District of Massachusetts on Monday, alleges the law violates the organization\u2019s equal protection and represents First Amendment retaliation.<\/p>\n<p dir=\"ltr\">\u201cThe Defund Provision purposefully treats Planned Parenthood Members unlike other organizations that provide the same medical care,\u201d the lawsuit states. \u201cOthers who provide abortion and also receive Medicaid payments for Medicaid-covered care are not similarly targeted by the Defund Provision and are not prohibited from receiving Medicaid funds as a result.\u201d<\/p>\n<p dir=\"ltr\">The filing contends that \u201cunequal treatment burdens Planned Parenthood Members\u2019 fundamental right to free association under the First Amendment.\u201d<\/p>\n<p dir=\"ltr\">Congress already bars federal taxpayer dollars from going to abortion, with limited exceptions. The\u00a0<a href=\"https:\/\/www.newsfromthestates.com\/article\/fourth-july-trump-signs-his-big-beautiful-bill-law\" target=\"_blank\" rel=\"noopener\">new law<\/a> would prevent Medicaid funding from going to Planned Parenthood for other types of health care services, like annual physicals, birth control and cancer screenings.<\/p>\n<p dir=\"ltr\">Planned Parenthood asked for the temporary restraining order shortly after filing the lawsuit Monday and Talwani, who was nominated to the bench by former President Barack Obama, issued it a few hours later.<\/p>\n<p dir=\"ltr\">The Department of Justice wrote in its Friday brief the temporary restraining order should have never been entered.<\/p>\n<p dir=\"ltr\">\u201cAs the Government\u2019s forthcoming opposition will make plain, Plaintiffs\u2019 claims are devoid of merit from start to finish,\u201d the DOJ filing states. \u201cGranting a high-stakes motion based on such empty legal theories cries out for explanation; indeed, everything about this case makes following the rules especially critical.
