Joe Nicola of Grain Valley, would have specified that liability for harm caused by an AI system always resides with a person or organization.<\/span><\/p>\n<p><span>The 11-0 defeat of the <\/span><a href=\"https:\/\/www.senate.mo.gov\/BillTracking\/Bills\/BillInformation?year=2026&amp;billid=469\" target=\"_blank\"><span>bill<\/span><\/a><span> came after Nicola dialed back chatbot restrictions and liability guidelines for AI developers at the behest of President Donald Trump\u2019s AI team.<\/span><\/p>\n<p><span>Nicola told The Independent Tuesday evening he had hoped the White House go-ahead would be enough to win his colleagues\u2019 support.<\/span><\/p>\n<p><span>\u201cMy hope was that working with the White House and them saying, \u2018We\u2019re neutral on it,\u2019\u2026 [if] I communicated that to the senators and to the representatives, that that would have made them feel better and more at ease to vote for it,\u201d Nicola said. \u201cBut it sure didn\u2019t.\u201d<\/span><\/p>\n<p><span>Republican state Sens. Jamie Burger of Benton and Jason Bean of Holcomb <\/span><a href=\"https:\/\/missouriindependent.com\/2026\/04\/07\/missouri-ai-regulations-stall-as-lawmakers-fear-loss-of-rural-broadband-funds\/\"><span>raised <\/span><\/a><span>concerns last month that the bill could jeopardize nearly $900 million in remaining federal funds for rural high-speed internet expansion by violating Trump\u2019s December executive order on AI.\u00a0<\/span><\/p>\n<p><span>The executive order indicated that states with \u201conerous\u201d laws conflicting with \u201ca minimally burdensome national policy framework for AI\u201d would be ineligible to receive \u201cnon-deployment\u201d funds set aside for the $42.5 billion federal <\/span><a href=\"https:\/\/broadbandusa.ntia.gov\/funding-programs\/broadband-equity-access-and-deployment-bead-program\" target=\"_blank\"><span>Broadband Equity Access and Deployment Program<\/span><\/a><span>.<\/span><\/p>\n<p><span>Though the revised bill passed the Senate last week 20-10, Burger and Bean still voted against it.\u00a0<\/span><\/p>\n<p><span>Burger said regulating AI development could put U.S. entrepreneurs at a disadvantage.<\/span><\/p>\n<p><span>\u201cI know we need curbs in place at some point in time with AI,\u201d Burger said. \u201cI just don\u2019t know that this is the time.\u201d<\/span><\/p>\n<p><span>In a House committee hearing Tuesday, Nicola said his bill would \u201cclarif[y] that existing law applies to artificial intelligence\u201d rather than creating a new regulatory scheme.<\/span><\/p>\n<p><span>But some said the revised bill leaves it unclear where liability for AI harm resides.<\/span><\/p>\n<p><span>Democratic state Rep. Elizabeth Fuchs of St. Louis asked who would be held responsible for harm caused by the sharing of a false, AI-generated image on Facebook \u2014 the person who shared the image or Mark Zuckerberg, the controlling shareholder of the platform\u2019s parent company, Meta.<\/span><\/p>\n<p><span>\u201cYou said a person, which I appreciate, but which person?\u201d Fuchs said. \u201cThat\u2019s where I\u2019m curious.\u201d<\/span><\/p>\n<p><span>Nicola said that while the \u201cend user\u201d who shared the image wouldn\u2019t be liable in that situation, the state wouldn\u2019t be able to hold Facebook responsible either.<\/span><\/p>\n<p><span>Lobbyists representing Americans for Prosperity and the Missouri Chamber of Commerce and Industry testified against the bill during the House committee hearing, pointing to drafting errors and a lack of enforcement mechanisms.\u00a0<\/span><\/p>\n<p><span>Nicola\u2019s original bill would have allowed courts to hold parent companies or key shareholders responsible for \u201csignificant harm\u201d caused by their products in cases of \u201creckless, negligent or deceptive conduct.\u201d And it would have required developers of AI systems to report suspected incidents of \u201csignificant bodily harm\u201d or property damage due to AI to the Missouri Attorney General for investigation.<\/span><\/p>\n<p><span>The White House pressed for changes to those provisions, Nicola said.<\/span><\/p>\n<p><span>\u201cWe had some pretty strong liability in there for developers,\u201d he said, \u201cand they were very concerned about that, so we scaled it all the way back just to state product liability.\u201d<\/span><\/p>\n<p><a href=\"https:\/\/revisor.mo.gov\/main\/OneSection.aspx?section=537.760&amp;bid=28570\" target=\"_blank\"><span>Missouri law<\/span><\/a><span> allows people to file civil claims against companies for defective products that are unreasonably dangerous, or when companies failed to warn consumers of potential dangers.<\/span><\/p>\n<p><span>Nicola\u2019s bill would have required companies that use AI to interact with customers or patients to clearly indicate when they are interacting with an AI system.<\/span><\/p>\n<p><span>White House staff also asked Nicola to dial back restrictions on AI chatbots, borrowing language from a 2025 <\/span><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202520260SB243\" target=\"_blank\"><span>California law<\/span><\/a><span>, Nicola said.<\/span><\/p>\n<p><span>An earlier version of the bill would have required age verification to prevent minors from using AI chatbots and made it unlawful to develop or publish chatbots likely to encourage minors to engage in self-harm or sexual conduct.<\/span><\/p>\n<p><span>The revised version removed age verification requirements and reduced the upper limit on liability from $100,000 to $1,000.<\/span><\/p>\n<p><span>Nicola, who plans to file AI legislation next year if Congress doesn\u2019t act, said working with the White House made his bill \u201cweaker.\u201d<\/span><\/p>\n<p><span>\u201cThey wanted me to pare it back,\u201d Nicola said. \u201c\u2026If we\u2019re holding people liable for harm and protecting people, that, to me, makes it stronger.\u201d<\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>State Sen.
